submitted by: DANNER, RUDY (1441) 17-37952 DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: TWO AND A HALF PILLS OF PERCOCET, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 031617 AT 0408 HOURS WHILE PATROLLING MY ASSIGNED AREA, I OBSERVED A GRAY IN COLOR PICK UP TRUCK HEADED WEST ON WEST MEADOW STREET TRAVELING AT 48 MILES PER HOUR IN A 35 MILES PER HOUR ZONE. I THEN POSITIONED MYSELF BEHIND THE VEHICLE, ACTIVATED MY OVERHEAD LIGHTS, AND PERFORMED A TRAFFIC STOP IN THE AREA OF SOUTH GROSS AVENUE AND WEST OST-WEST STREET. I MADE CONTACT WITH THE DRIVER/WITNESS of the VEHICLE, MS JESSICA YATES, AT WHICH TIME I OBSERVED THE PASSENGER OF THE VEHICLE, THE DEFENDANT, MS BRANDI WILBUR, TO BE VERY NERVOUS AND VISIBLY SHAKING. DUE TO THE BEHAVIOR OF THE OCCUPANT, I ASKED IF THERE WAS ANYTHING ILLEGAL IN THE VEHICLE, TO WHICH BOTH THE DRIVER AND DEFENDANT STATED THAT THERE WAS NOT. I THEN ASKED IF IT WAS OKAY IF I SEARCHED THE VEHICLE, TO WHICH THE DRIVER STATED "GO AHEAD, I DON'T CARE." UPON SEARCHING THE VEHICLE, LOCATED ON THE PASSENGER SIDE SEAT NEXT TO A BROWN IN COLOR MICHAEL KORS PURSE, WAS AN UNZIPPED MAKE UP BAG THAT WAS BLACK IN COLOR WITH THE WORD "GLAMOUR" WRITTEN ON THE SIDE. LOCATED INSIDE THE UNZIPPED MAKE UP BAG WAS A CLEAR CELLOPHANE WRAPPER WITH 2-1/2 PILLS WRAPPED INSIDE. UPON LOCATING THE UNKNOWN PILLS, I ASKED WHO THE MAKE UP BAG BELONGED TO, TO WHICH THE DEFENDANT STATED IT WAS HERS. I THEN ASKED WHAT KIND OF PILLS WERE IN THE WRAPPER, TO WHICH THE DEFENDANT STATED THEY WERE PERCOCET AND THAT SHE did not HAVE A PRESCRIPTION FOR THEM. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED, (DOUBLE LOCKED), BEHIND HER BACK, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $ 2000.00, PER THE BOND SCHEDULE. POISON CONTROL WAS CONTACTED AND CONFIRMED THE PILLS TO BE PERCOCET, A SCHEDULE 2 CONTROLLED SUBSTANCE. THE PILLS WERE COLLECTED AND LATER TURNED IN TO EVIDENCE. THE DRIVER OF THE VEHICLE WAS GIVEN A WRITTEN WARNING FOR SPEEDING, WARNING NUMBER 419070b. NO FURTHER ACTION TAKEN BY THIS DEPUTY. |
