Probable cause affidavit: | SUBMITTED BY: SEROCKI, ED 0322 (AR10115046) (0120) DID UNLAWFULLY ATTEMPT TO ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO WIT: AN OCCUPIED DWELLING, LOCATED IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM , WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: THEFT, IN VIOLATION OF FLORIDA STATUTE 810.02(1) AND 810.02(3)(A). DID AGREE, CONSPIRE, COMBINE OR CONFEDERATE WITH ANOTHER PERSON OR PERSONS TO COMMIT AN OFFENCE TO WIT: BURGLARY, IN VIOLATION FLORIDA STATE STATUTE 777.04(3). ON 052610 AT APPROXIMATELY 1928 HOURS, DEPUTIES OF THE CITRUS COUNTY SHERIFF'S OFFICE WERE DISPATCHED TO THE VICTIM'S RESIDENCE IN HOMOSASSA IN REFERENCE TO A POSSIBLE BURGLARY IN PROGRESS. UPON ARRIVAL DEPUTY REEVES MADE CONTACT WITH A JUVENILE VICTIM WHO ADVISED THAT APPROXIMATELY FIFTEEN MINUTES PRIOR TO HIS ARRIVAL THE JUVENILE VICTIM WAS WORKING ON HIS COMPUTER INSIDE OF HIS RESIDENCE WHEN HE OBSERVED THREE WHITE MALES WALKING IN FRONT OF HIS RESIDENCE. THE JUVENILE VICTIM FURTHER ADVISED THAT TWO OF THE MALES WERE WEARING TANK TOPS AND A THIRD WAS WEARING WHAT HE BELIEVED TO BE RED CLOTHING. HE OBSERVED ALL THREE HIDING BEHIND A TALL PINE TREE IN HIS FRONT YARD. APPROXIMATELY THIRTY SECONDS LATER THE TWO WHO WERE WEARING TANK TOPS WALKED TOWARDS THE RESIDENCE WITH THEIR SHIRTS PULLED OVER THEIR HEADS. THEY SEPARATED AND WALKED AROUND THE RESIDENCE PULLING ON THE DOORS. THE JUVENILE WITNESS THEN RAN AND HID IN THE BEDROOM, BUT COULD HEAR ATTEMPTS TO OPEN THE DOORS AND A LARGE BANGING SOUND FROM THE GARAGE DOOR. DEPUTY REEVES MADE CONTACT WITH A SUBJECT IN THE AREA WHO WAS WEARING A WHITE TANK TOP AND HAD SHOES WHICH MATCHED THE PATTERN FOUND IN THE DIRT AROUND THE RESIDENCE AND ON THE GARAGE DOOR. AFTER QUESTIONING (POST MIRANDA) THAT SUBJECT, HE ADMITTED THAT HE HAD TOLD TWO CO-DEFENDANTS THAT HE HAD BEEN "SCOPING" THE VICTIM'S RESIDENCE FOR SEVERAL DAYS AND WAS GOING TO "ROB" AND "HIT" THE RESIDENCE. THE SUBJECT FURTHER STATED THAT ALL THREE OF THEM THEN WALKED DOWN TO THE RESIDENCE WHERE THEY HID BEHIND A TREE. HE FURTHER ADMITTED TO PULLING HIS SHIRT OVER HIS HEAD ATTEMPTED TO OPEN THE DOORS AND THAT HE ATTEMPTED TO KICK IN THE GARAGE DOOR. AT THAT TIME HE ALSO NAMED THE OTHER TWO SUBJECTS WHO WERE WITH HIM. HE WAS THEN PLACED INTO CUSTODY. A SECOND SUBJECT WAS ALSO LOCATED (WHO HAD BEEN NAMED BY DEFENDANT ONE) AND POST MIRANDA ADMITTED THAT DEFENDANT ONE HAD TOLD HIM THAT HE AND A THIRD SUBJECT NOT YET IN CUSTODY, THE SAME INFORMATION PERTAINING TO SCOPING THE RESIDENCE AND ROBBING IT. HE ALSO ADVISED THAT ALL THREE OF THEM WALKED TO THE RESIDENCE AND HID BEHIND THE TREE. HE DENIED GOING UP TO THE RESIDENCE WITH DEFENDANT ONE. A CITRUS COUNTY DETECTIVE PLACED A RECORDER IN A MARKED PATROL UNIT WHICH RECORDED CONVERSATION BETWEEN DEFENDANT ONE AND TWO WHERE THEY AGAIN ADMITTED GOING TO THE RESIDENCE WITH A THIRD NAMED SUBJECT NOT YET IN CUSTODY WITH DEFENDANT ONE STATING HE WOULD TAKE FULL RESPONSIBILITY FOR ATTEMPTING THE BURGLARY. THE THIRD SUBJECT WAS NOT APPREHENDED AT THAT TIME, BUT HAD BEEN IDENTIFIED. AN AGENCY WIDE "BOLO" WAS ISSUED FOR THE THIRD SUBJECT. ON 052710, THIS DETECTIVE WAS CONTACTED BY SCHOOL RESOURCE OFFICER BARRY WHO INFORMED ME HE WAS PRESENT WITH THE THIRD SUBJECT. I REQUESTED THAT HE PLACE HIM IN CUSTODY AND TRANSPORT HIM TO THE CITRUS COUNTY DETENTION FACILITY. THIS DETECTIVE THEN RESPONDED TO THE CITRUS COUNTY DETENTION FACILITY WHERE I MADE CONTACT WITH DEFENDANT THREE, MR BRANDON GILBERT, WHO WAS READ MIRANDA WARNINGS AND SIGNED A CONSTITUTIONAL RIGHTS WAIVER FORM. THE DEFENDANT AT FIRST DENIED HAVING BEEN PRESENT AT THE INCIDENT LOCATION, BUT AFTER FURTHER QUESTIONING ADMITTED THAT HE AND THE TWO OTHERS ALREADY IN CUSTODY DID WALK TO THE VICTIM'S RESIDENCE WHERE DEFENDANT ONE SAID HE WAS GOING TO DO SOMETHING STUPID. DEFENDANT GILBERT DENIED PRIOR KNOWLEDGE OF THE BURGLARY ATTEMPT. HE FURTHER STATED THAT AFTER LEARNING THE OTHER TWO DEFENDANTS PLANNED TO BURGLARIZE THE RESIDENCE HE LEFT THE SCENE RECEIVING A RIDE FROM AN ADDITIONAL WITNESS IN THIS CASE. THE DEFENDANT DID PROVIDE A SWORN DIGITALLY RECORDED STATEMENT. THE DEFENDANT WAS INFORMED THAT HE WOULD BE CHARGED WITH ONE COUNT OF ATTEMPTED BURGLARY TO AN OCCUPIED DWELLING WITH A BOND SET AT $3,000.00 ACCORDING TO THE BOND SCHEDULE AND ONE COUNT OF CRIMINAL CONSPIRACY WITH A BOND SET AT $1,000 ACCORDING TO THE BOND SCHEDULE. *NOT-EXEMPT* |
