SUBMITTED BY: SEFFERN, JONATHAN 0623 (AR 15-13499) (15-5692) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: GLASS METHAMPHETAMINE PIPE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 011315, WHILE CONDUCTING TRAFFIC ENFORCEMENT IN the FLORAL CITY AREA OF SOUTH FLORIDA AVENUE, I OBSERVED A BLUE AND WHITE FORD PICKUP TRUCK TRAVELING SOUTHBOUND. WHILE TRAVELING BEHIND THE VEHICLE, I OBSERVED the DRIVER TO NOT BE WEARING HIS SEATBELT. AT that TIME I CONDUCTED A TRAFFIC STOP UTILIZING ALL EMERGENCY EQUIPMENT. UPON ACTIVATING MY OVERHEAD EMERGENCY LIGHTS, I OBSERVED THE DRIVER TO THROW A GLASS OBJECT OUT OF the DRIVERS WINDOW, THAT I WAS ABLE TO IDENTIFY AS A GLASS PIPE. AT THAT TIME, I NOTIFIED CANINE DEPUTY PHILLIPS OF THE ITEM THAT WAS THROWN FROM THE WINDOW AND REQUESTED HE RETRIEVE THE ITEM THEN RESPOND TO MY TRAFFIC STOP. UPON MAKING CONTACT WITH THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR BRANDON JOHNSON, I REQUESTED HIS DRIVER'S LICENSE, VEHICLE REGISTRATION, AND PROOF OF INSURANCE. THE DEFENDANT PROVIDED THE INSURANCE AND REGISTRATION INFORMATION; HOWEVER HE WAS UNABLE TO PROVIDE ME WITH A VALID DRIVER'S LICENSE. THE DEFENDANT ADVISED HE DID NOT HAVE ONE DUE TO IT BEING SUSPENDED. I CONFIRMED THROUGH TELETYPE AND FCIC/NCIC THAT THE DEFENDANT'S DRIVER'S LICENSE WAS IN FACT SUSPENDED; MOST RECENTLY ON 042814 FOR FAILURE TO PAY TRAFFIC FINES. THE DEFENDANT WAS REQUESTED TO EXIT THE VEHICLE, WHERE HE WAS BEING PLACED UNDER ARREST. THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND PLACED IN THE REAR OF MY PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY. CANINE DEPUTY PHILLIPS ARRIVED ON SCENE AND PROVIDED ME with THE GLASS METHAMPHETAMINE PIPE THAT HAD BEEN THROWN FROM THE VEHICLE BY THE DEFENDANT. THE PIPE WAS BROKEN AS IT WAS THROWN FROM THE VEHICLE, HOWEVER, SEVERAL PIECES OF THE PIPE WERE COLLECTED AND WAS ABLE TO BE TESTED UTILIZING AN AGENCY ISSUED FIELD PRESUMPTIVE TEST KIT WHICH YIELDED POSITIVE RESULTS FOR METHAMPHETAMINE. THE DEFENDANT WAS TRANSPORTED TO CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL HE WAS TURNED OVER TO DETENTION FACILITY STAFF. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF DRIVING WHILE LICENSE SUSPENDED KNOWINGLY WITH A $1,000.00 BOND PER THE BOND SCHEDULE AND ONE COUNT OF POSSESSION OF PARAPHERNALIA WITH A $1,000.00 BOND PER THE BOND SCHEDULE FOR A TOTAL AMOUNT OF $2,000.00 PER THE BOND SCHEDULE. |
