SUBMITTED BY: HESSE, BRYAN 0755 (AR16-19756) DID ENGAGE IN A SCHEME TO DEFRAUD AND OBTAIN PROPERTY THEREBY IS GUILTY OF ORGANIZED FRAUD WITH THE AMOUNT OF PROPERTY OBTAINED OF A VALUE OF LESS THAN $20.000.00, IN VIOLATION OF FLORIDA'S STATE STATUTE 817.034(4)(A)(3). DID KNOWINGLY UTTER, OR PASS OR TENDER IN PAYMENT AS TRUE, ANY SUCH FALSE, ALTERED, FORGED, OR COUNTERFEIT NOTE, OR ANY BANK BILL, CHECK, DRAFT, OR PROMISSORY NOTE, PAYABLE TO THE BEARER THEREOF OR TO THE ORDER OF ANY PERSON, ISSUED AS AFORESAID, KNOWING THE SAME TO BE FALSE, ALTERED, FORGED, OR COUNTERFEIT, WITH INTENT TO INJURE OR DEFRAUD ANY PERSON: TO WIT: THE DEFENDANT USED COUNTERFEIT ONE HUNDRED DOLLAR BILLS AND/OR ATTEMPTED TO USE COUNTERFEIT ONE HUNDRED DOLLAR BILLS AT SEVERAL DIFFERENT BUSINESSES IN ORDER TO RECEIVE CASH BACK AS WELL AS MERCHANDISE, IN VIOLATION OF FLORIDA STATE STATUTE 831.09. ON 060416, AT APPROXIMATELY 1730 HOURS, I RECEIVED A CALL FROM LIEUTENANT BALL IN REFERENCE TO A FRAUD THAT HAD JUST OCCURRED. LIEUTENANT BALL STATED THERE HAD BEEN MULTIPLE UTTERINGS AND ATTEMPTED UTTERINGS OF COUNTERFEIT ONE HUNDRED DOLLAR BILLS MADE AT SEVERAL DIFFERENT INVERNESS LOCATIONS DURING THE AFTERNOON. LIEUTENANT BALL STATED AFTER A 'BOLO' WAS SENT OUT, DEPUTY HRYC (0701) LOCATED A TRUCK MATCHING THE DESCRIPTION OF THE SUSPECTS TRUCK IN THE PARKING LOT OF ADVANCE AUTO PARKS LOCATED AT 6850 WEST GULF TO LAKE HIGHWAY. AFTER VERIFYING THE LICENSE PLATE OF THE TRUCK MATCHED THAT OF THE TRUCK SEEN LEAVING ONE OF THE BUSINESSES, A YOUNG BLACK MALE (WHO ALSO MATCHED THE SUSPECT DESCRIPTION) WALKED OUT OF THE STORE, GOT IN THE TRUCK, AND ATTEMPTED TO DRIVE AWAY. AT THAT TIME, DEPUTY HRYC CONDUCTED A TRAFFIC STOP ON THAT VEHICLE. UPON APPROACHING THE VEHICLE, DEPUTY HRYC AND OTHER DEPUTIES NOTICED A STRONG ODOR OF MARIJUANA, AS WELL AS SEVERAL BAGS OF MERCHANDISE THAT APPEARED TO BE FROM THE VICTIMS. LOCATED IN SEVERAL BAGS THERE WERE RECEIPTS FOR MERCHANDISE THAT WAS BOUGHT AT LOCATIONS THROUGHOUT CITRUS COUNTY. AFTER CHECKING THE RECEIPTS, SEVERAL DEPUTIES WENT TO THE LOCAL BUSINESSES TO CHECK THE SURVEILLANCE VIDEO, AT WHICH TIME MR BYRON PETERSON AND MR JORDAN JOHNSON WERE SEEN ON THE VIDEO IN SEVERAL DIFFERENT STORES (DOMINOâS, PUBLIX, SAVE-A-LOT, WINN DIXIE, BIG LOTS, DOLLAR GENERAL, BEALLS OUTLET, AND ADVANCE AUTO PARTS) UTTERING THE COUNTERFEIT ONE HUNDRED DOLLAR BILLS. AFTER VERIFYING THAT THE MERCHANDISE WAS PURCHASED FROM THE STORES USING THE COUNTERFEIT BILLS PASSED BY MR PETERSON AND MR JOHNSON, THEY WERE ARRESTED AND TAKEN TO THE CITRUS COUNTY DETENTION FACILITY. AFTER SPEAKING WITH ALL THREE DEFENDANTS (MR BYRON PETERSON, MR JORDAN JOHNSON, AND MR BRANDON PELMORE), THEY ALL STATED THAT MR PELMORE NEVER UTTERED OR ATTEMPTED TO UTTER ANY OF THE COUNTERFEIT BILLS. ALL THREE DEFENDANTS STATED THAT MR PELMORE WAS IN THE VEHICLE AT ALL TIMES AND NOT ONCE DID HE ENTER ANY OF THE BUSINESS THAT THEY WENT TO. INTERVIEWS WERE CONDUCTED AT THE CITRUS COUNTY DETENTION FACILITY; SEE SUPPLEMENT FOR FURTHER. MR PELMORE WAS CHARGED WITH ONE COUNT OF SCHEME TO DEFRAUD LESS THAN $20,000.00, WITH A BOND SET AT $5,000.00 PER THE BOND SCHEDULE. |
