SUBMITTED BY: WATTS, ROSCOE 1299 (AR15-17331) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: GRABBED THE VICTIM BY THE HAIR AND DRAGGED HER ACROSS THE PARKING LOT, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 112015 AT 1150 HOURS, I WAS DISPATCHED TO THE CHEVRON GAS STATION, LOCATED AT 79 NORTH FLORIDA AVENUE, INVERNESS, IN REFERENCE TO A PHYSICAL DISTURBANCE. UPON ARRIVAL AT 1213 HOURS, I MADE CONTACT WITH THE VICTIM, MS RENEE TREMBLEY, WHO ADVISED THAT SHE AND HER BOYFRIEND/WITNESS, MR JEFFREY HALE JR, WERE WALKING WITH HER SON IN FRONT OF THE CHEVRON, WHEN THE DEFENDANT PULLED IN THE PARKING LOT DRIVING HER 2009 DARK BLUE TOYOTA COROLLA, WITH FLORIDA TAG ESWU31, AND STARTED A FIGHT. THE VICTIM ADVISED THAT AFTER THE DEFENDANT EXITED HER VEHICLE, SHE GRABBED THE VICTIM BY HER HAIR AND DRAGGED HER ACROSS THE PARKING LOT. THE VICTIM ADVISED THAT HER BOYFRIEND, MR HALE, ATTEMPTED TO HELP HER BY SEPARATING THEM. THE VICTIM ADVISED THAT THE DEFENDANT THEN SPED OFF IN HER VEHICLE. THE VICTIM COMPLETED A SWORN WRITTEN STATEMENT THAT WILL BE TURNED IN TO RECORDS. I TOOK PHOTOGRAPHS OF THE VICTIM'S INJURIES; SEE MY CRIME SCENE TECHNICIAN'S (CST) REPORT. I THEN MADE CONTACT WITH MR HALE, WHO ADVISED THAT THE DEFENDANT PULLED INTO THE PARKING LOT BEING VERBALLY ABUSIVE TOWARDS THE VICTIM, AT WHICH TIME, SHE PARKED HER VEHICLE AND EXITED IT. MR HALE ADVISED THAT THE DEFENDANT BEGAN TO PULL THE VICTIM'S HAIR AND PULL HER TO THE GROUND. MR HALE ADVISED THAT AT THE CONCLUSION OF THE SCUFFLE THE DEFENDANT THREW A GLASS BOTTLE AT THE VICTIM. MR HALE COMPLETED A SWORN WRITTEN STATEMENT, WHICH WILL BE TURNED IN TO RECORDS. I THEN MADE CONTACT WITH WITNESS, MR THOMAS BOOTH, WHO WAS AN INDEPENDENT WITNESS THAT WORKED ACROSS THE STREET AT BROWN'S AUTOMOTIVE, LOCATED AT 70 NORTH FLORIDA AVENUE, INVERNESS. MR BOOTH ADVISED THAT HE WITNESSED THE DEFENDANT, WHO HE DESCRIBED AS BEING A WHITE FEMALE IN A BLUE CAR, VERBALLY ATTACK THE VICTIM, THROW HER TO THE GROUND, AND DRIVE AWAY. MR BOOTH COMPLETED A SWORN WRITTEN STATEMENT, WHICH WILL BE TURNED IN TO RECORDS. I THEN MADE CONTACT WITH WITNESS, MR ROBERT MILEY, WHO WAS AN INDEPENDENT WITNESS THAT WORKED ACROSS THE STREET AT BROWN'S AUTOMOTIVE, LOCATED AT 70 NORTH FLORIDA AVENUE, INVERNESS. MR MILEY ADVISED THAT HE WITNESSED THE DEFENDANT EXCHANGE WORDS WITH THE VICTIM. MR MILEY ADVISED THAT THE DEFENDANT THEN ATTACKED THE VICTIM BY GRABBING HER HAIR AND THROWING HER TO THE GROUND. MR MILEY DID COMPLETE A SWORN WRITTEN STATEMENT THAT WILL BE TURNED IN TO RECORDS. I THEN MADE CONTACT WITH WITNESS, MS KIMBERLY ZARBO, WHO HAD LEFT HER TELEPHONE NUMBER WITH THE CLERK OF THE CHEVRON FOR THE PURPOSE OF BEING A WITNESS ON BEHALF OF THE VICTIM. I MADE CONTACT WITH MS ZARBO AT HER PLACE OF EMPLOYMENT, WHICH WAS THE BABY BARGAINS, LOCATED AT 687 NORTH FLORIDA AVENUE, INVERNESS. MS ZARBO ADVISED THAT AS SHE PULLED INTO THE CHEVRON, SHE WITNESSED THE DEFENDANT GET OUT OF HER VEHICLE AND DRAG THE VICTIM TO THE GROUND BY HER HAIR. MS ZARBO ADVISED THAT BOTH PARTIES ENGAGED IN A SHORT FIGHT. MS ZARBO ADVISED THAT WHEN THE VICTIM STOOD UP, THE DEFENDANT THREW A GLASS BOTTLE DIRECTLY AT THE VICTIM'S FACE MISSING HER. MS ZARBO ADVISED THAT THE DEFENDANT THEN JUMPED INTO HER VEHICLE AND DROVE OFF QUICKLY AS PEOPLE WERE STOPPING TO HELP. MS ZARBO ADVISED THAT THE VICTIM WAS CRYING AND UPSET. MS ZARBO DID COMPLETE A SWORN WRITTEN STATEMENT THAT WILL BE TURNED IN TO RECORDS. I THEN MADE CONTACT WITH THE VICTIM AND GAVE HER AN AGENCY ISSUED CARD WITH MY NAME AND THE CASE NUMBER AND ADVISED HER THAT I WOULD BE CONTINUING TO CONDUCT A THOROUGH INVESTIGATION. I ADVISED THE VICTIM TO CONTACT THIS AGENCY WITH ANY FURTHER INFORMATION PERTAINING TO THE CASE. I THEN "BOLO'D" THE AREA IN SEARCH FOR THE DEFENDANT. I EVENTUALLY SPOTTED THE DEFENDANT'S VEHICLE TURNING SOUTHBOUND ONTO INDEPENDENCE HIGHWAY FROM PERRY STREET. THE DEFENDANT'S IDENTITY WAS VERIFIED THROUGH "DAVID," WHICH ALLOWED ME TO CONFIRM THAT SHE WAS INDEED THE DRIVER OF THE VEHICLE. I THEN CONDUCTED A TRAFFIC STOP ON THE DEFENDANT'S VEHICLE. I MADE CONTACT WITH THE DEFENDANT AND ADVISED HER WHY I WAS STOPPING HER, WHICH WAS FOR INVESTIGATIVE PURPOSES. I THEN READ THE DEFENDANT HER MIRANDA VIA AN AGENCY ISSUED CARD AT 1415 HOURS, AT WHICH TIME, SHE ADVISED THAT SHE UNDERSTOOD HER RIGHTS AND WISHED TO SPEAK WITH ME FREELY. THE DEFENDANT ADVISED THAT WHILE TRAVELING NORTHBOUND ON NORTH FLORIDA AVENUE, SHE SAW HER EX-BOYFRIEND, MR JEFFREY HALE, WALKING IN FRONT OF THE CHEVRON. THE DEFENDANT ADVISED THAT SHE WANTED TO GIVE MR HALE SOME IMPORTANT PAPERS CONCERNING A PRIVATE MATTER. THE DEFENDANT ADVISED THAT SHE STARTED ARGUING WITH THE VICTIM AND AFTER SHE BEGAN TO ARGUE WITH HER, THE DEFENDANT ADVISED THAT SHE GOT OUT OF HER VEHICLE, AT WHICH TIME, MR HALE PUSHED HER BACK. THE DEFENDANT ADVISED THAT THE VICTIM PUSHED HER, SO SHE PUSHED THE VICTIM BACK, AT WHICH TIME, THEY BOTH FELL TO THE GROUND. THE DEFENDANT ADVISED THAT SHE GOT OFF THE GROUND AND THEN LEFT THE AREA. THE DEFENDANT COMPLETED A SWORN WRITTEN STATEMENT THAT WILL BE TURNED IN TO RECORDS. I THEN ADVISED THE DEFENDANT THAT DUE TO THE CONSISTENT AND ACCURATE ACCOUNTS OF THE EVENTS FROM THE DEPENDANT AND INDEPENDENT WITNESSES, SHE WAS BEING PLACED UNDER ARREST FOR SIMPLE BATTERY AT 1435 HOURS. THE DEFENDANT WAS HANDCUFFED IN THE REAR (DOUBLE LOCKED) AND SEARCHED FOR CONTRABAND, WHICH YIELDED NEGATIVE RESULTS, PLACED IN THE REAR OF MY PATROL VEHICLE, TRANSPORTED TO THE DETENTION FACILITY, AND TURNED OVER TO STAFF WHERE HER BOND WAS SET AT $1,000.00 PER THE BOND SCHEDULE. NO FURTHER BY THIS DEPUTY. |
