SUBMITTED BY: WEST, JAMES 1286 (AR15-16560)(15-126114) DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A SMALL METAL ALTOIDS TIN AND FIVE SMALL PLASTIC BAGGIES, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1) DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: APPROXIMATELY ONE GRAM OF METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 092515, AT APPROXIMATELY 0150 HOURS, WHILE TRAVELING EAST ON WEST HOMOSASSA TRAIL, I OBSERVED THE LICENSE PLATE LIGHT TO A WHITE CROWN VICTORIA, BEARING FLORIDA LICENSE PLATE BFRY84 TO BE INOPERABLE. I CONDUCTED A TRAFFIC STOP NEAR THE INTERSECTION OF SOUTH OHIO AVENUE AND WEST HOMOSASSA TRAIL. THE VEHICLE CONTINUED EAST, TURNING ONTO WEST BAVARIAN STREET WHERE IT CAME TO A STOP. I APPROACHED THE DRIVER AND REQUESTED HIS DRIVER'S LICENSE, REGISTRATION, AND PROOF OF INSURANCE, TO WHICH HE PROVIDED. I ALSO OBSERVED A FEMALE, LATER IDENTIFIED AS DEFENDANT, MS BRANDY SPARKS, SITTING IN THE PASSENGER SEAT. I REQUESTED TO SEE HER IDENTIFICATION IF POSSIBLE. THE DRIVER, LATER IDENTIFIED AS MR MICHAEL SPARKS, PROVIDED HER DRIVER'S LICENSE. DEPUTY DEARDEN ARRIVED ON SCENE AND REMAINED NEAR THE VEHICLE WHILE I RETURNED TO MINE TO VERIFY THE INFORMATION GIVEN TO ME. DEPUTY DEARDEN CONDUCTED A CANINE WALK AROUND THE VEHICLE AND INFORMED ME THAT CANINE TYSON HAD ALERTED ON THE VEHICLE, SEE DEPUTY DEADENâS SUPPLEMENT. DEPUTY HESSE (0755) ARRIVED ON SCENE. BOTH THE DRIVER AND PASSENGER WERE REMOVED FROM THE VEHICLE AND WALKED BACK TO THE FRONT OF MY VEHICLE. I SPOKE WITH THE PASSENGER/DEFENDANT, MS SPARKS, AND ASKED IF SHE HAD ANYTHING ILLEGAL ON HER PERSON OR ANY WEAPONS, THE DEFENDANT RESPONDED NO. I ASKED HER IF I WAS ABLE TO SEARCH, TO WHICH SHE RESPONDED YES. WHILE CONDUCTING A PAT DOWN ON EACH POCKET ON THE FRONT LEFT POCKET OF HER JEAN SHORTS I FELT A BULGE. I ASKED THE DEFENDANT WHAT THAT WAS, TO WHICH SHE REACHED INTO HER POCKET AND PRODUCED A SMALL ALTOIDS TIN. I OPENED THE ALTOIDS TIN AND OBSERVED FOUR EMPTY SMALL PLASTIC BAGS AND ONE SMALL PLASTIC BAG CONTAINING A CRYSTAL LIKE SUBSTANCE. THROUGH MY TRAINING AND EXPERIENCE I IDENTIFIED IT TO BE CONSISTENT WITH THE SUBSTANCE KNOWN TO ME AS METHAMPHETAMINE. AT THAT TIME I PLACED THE DEFENDANT IN HANDCUFFS (DOUBLE LOCKED) AND CONDUCTED A THOROUGH SEARCH OF HER PERSON. THE DEFENDANT WAS SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. THE TOTAL WEIGHT OF THE BAGGY AND THE METHAMPHETAMINE WAS APPROXIMATELY 1.2 GRAMS. THE DEFENDANTâS BOND WAS SET AT $3,000.00, PER THE BOND SCHEDULE. THE DRIVER OF THE VEHICLE WAS ISSUED WARNING CITATION NUMBER 384471B FOR A FAULTY LICENSE PLATE LIGHT. BOND SET AT $1,000.00 FOR THE DRUG PARAPHERNALIA AND $2,000.00 FOR THE POSSESSION OF A CONTROLLED SUBSTANCE. A FIELD TEST WAS CONDUCTED ON THE SUBSTANCE FOUND IN THE ALTOIDS TIN, WHICH YIELDED POSITIVE RESPONSE FOR METHAMPHETAMINE. THE ALTOIDS TIN AND ALL OF ITS CONTENTS WERE COLLECTED AND SUBMITTED IN TO EVIDENCE. |
