SUBMITTED BY: SMITH, STEVE 0292 (AR11120499) DID knowingly and willfully obstruct, resist, or oppose any officer or person aiding such officer, in serving or attempting to serve or execute any search warrant, or DID shall assault, beat or wound any person or officer, or his or her deputies or assistants, knowing him or her to be such an officer or person so authorized, IN VIOLATION OF FLORIDA STATE STATUTE 933.15. ON 042711, A LAWFUL SEARCH WARRANT WAS EXECUTED AT 11162 NORTH NIGHTHAWK TERRACE IN CRYSTAL RIVER. UPON ARRIVAL, A KNOCK AND ANNOUNCE WAS DONE. AT THAT TIME, ONE OF THE DEFENDANTS OPENED THE FRONT DOOR AND SHE WAS TAKEN INTO CUSTODY. AT THAT TIME, THE ENTRY TEAM MADE ENTRY INTO THE RESIDENCE ALL THE WHILE ANNOUNCING, "CITRUS COUNTY SHERIFF'S OFFICE SEARCH WARRANT." CONTACT WAS MADE WITH SEVERAL SUBJECTS WHO WERE TAKEN INTO CUSTODY. THE ENTRY TEAM THEN APPROACHED A BEDROOM DOOR WHICH WAS LOCKED AND ANNOUNCED NUMEROUS TIMES FOR THE DEFENDANTS INSIDE TO OPEN THE DOOR, WHICH THEY DID NOT, THEREFORE, THE DOOR WAS BREACHED ENTRY WAS MADE AND THE SUSPECTS WERE TAKEN INTO CUSTODY. IT should BE NOTED THAT THIS BEDROOM WAS DIRECTLY ADJACENT TO DEFENDANT BRENDA SPEARS' BEDROOM. THERE IS NO WAY THAT SHE COULD NOT HAVE HEARD THIS COMMOTION. AT THAT TIME, THE ENTRY TEAM MADE CONTACT WITH DEFENDANT BRENDA SPEARS'S BEDROOM DOOR, WHICH WAS LOCKED. THEY KNOCKED AND ANNOUNCED AND DEFENDANT BRENDA SPEARS REFUSED TO ANSWER. AT THAT TIME, THE ENTRY TEAM ATTEMPTED TO BREACH THE DOOR TO MAKE ENTRY, WHICH WAS UNSUCCESSFUL DUE TO DEFENDANT BRENDA SPEARS PLACING A LARGE HEAVY DRESSER IN FRONT OF THE DOOR. THE ENTRY CONTINUED TO ANNOUNCE AND AFTER A PERIOD OF TIME DEFENDANT BRENDA SPEARS MADE VOICE CONTACT WITH THEM. SHE THEN REMOVED THE DRESSER ALLOWING THE ENTRY TEAM TO MAKE ENTRY WHERE SHE WAS TAKEN INTO CUSTODY. THIS DEPUTY WAS ABLE TO CONDUCT A DIGITAL INTERVIEW WITH DEFENDANT BRENDA SPEARS. SHE WAS READ MIRANDA FROM A PREPRINTED CARD. WHEN ASKED IF SHE UNDERSTOOD HER RIGHTS SHE ADVISED SHE DID. WHEN ASKED IF SHE STILL WANTED TO SPEAK WITH THIS DEPUTY SHE ADVISED SHE DID. SHE DENIED HAVING ANY INVOLVEMENT WITH THE ILLEGAL ACTIVITIES AT THE RESIDENCE. SHE DID ADVISE THAT SHE HAD KNOWLEDGE OF THE MARIJUANA CULTIVATION, BUT KNEW NOTHING ABOUT THE METHAMPHETAMINE MANUFACTURING. WHEN ASKED ABOUT THE DRESSER BEING PLACED IN FRONT OF THE DOOR, SHE ADVISED THAT SHE DID IT THE PREVIOUS NIGHT FOR SECURITY. WHEN ASKED WHY SHE DID NOT IMMEDIATELY REMOVE THE DRESSER WHEN LAW ENFORCEMENT ANNOUNCED, SHE ADVISED THAT SHE DID. DEFENDANT BRENDA SPEARS COULD BE HEARD MOVING AROUND IN THE ROOM. IT IS BELIEVED THAT DURING THIS TIME FRAME SHE WAS DISPOSING OF ILLEGAL CONTRABAND. SHE WAS ARRESTED, HANDCUFFED (DOUBLE LOCKED), AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WITHOUT INCIDENT. BOND SET AT $500.00 PER THE BOND SCHEDULE.
