Probable cause affidavit: SUBMITTED BY: BRIGGS, RICHARD 0089 (AR13-8181) \tDID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATUTE 322.34(2)(A). ON 120213, AT APPROXIMATELY 0939 HOURS, I WAS TRAVELING NORTHBOUND ON HIGHWAY 41 WHILE CONDUCTING MOVING RADAR. AT THAT TIME, I OBSERVED A VEHICLE TO BE TRAVELING SOUTHBOUND AT WHAT APPEARED TO BE PAST THE POSTED SPEED LIMIT. AS THE VEHICLE APPROACHED MY PATROL VEHICLE, A CLEAR TONE FROM THE AUDIO DOPPLER OF THE RADAR SOUNDED WHICH REVEALED THAT THE VEHICLE WAS GOING PAST THE POSTED SPEED LIMIT OF 70 MILES PER HOUR IN A 50 MILES PER HOUR ZONE. I THEN TURNED MY PATROL VEHICLE AROUND AND ACTIVATED MY EMERGENCY EQUIPMENT IN ORDER TO CONDUCT A TRAFFIC STOP. THE VEHICLE MADE A WIDE RIGHT TURN ONTO NORTH COUNTRY CLUB DRIVE AND PULLED ONTO THE NORTHBOUND SHOULDER. AT THAT TIME, I OBSERVED THE DRIVER/ DEFENDANT, MR BRENT PHILBURN, JUMP FROM THE FRONT DRIVER’S SEAT TO THE REAR PASSENGER SIDE OF THE VEHICLE. I THEN OBSERVED A WHITE FEMALE SLIDE FROM THE PASSENGER SIDE OF THE VEHICLE TO THE DRIVER’S SIDE. I WALKED TO THE REAR OF THE VEHICLE AND HAD THE DEFENDANT STEP OUT. I ASKED THE DEFENDANT WHY HE JUMPED FROM THE DRIVER’S SEAT TO THE REAR PASSENGER SEAT, WHERE HE ADVISED ME THAT HE GOT SCARED KNOWING HIS DRIVER’S LICENSE WAS SUSPENDED AND JUMPED IN TO THE BACK SEAT. I THEN OBTAINED THE DEFENDANT’S NAME AND DATE OF BIRTH, RETURNED TO MY PATROL VEHICLE AND CONDUCTED A DRIVER’S LICENSE CHECK VIA TELETYPE. THIS REVEALED THE DEFENDANT’S DRIVER’S LICENSE WAS NOT VALID, WITH HIS LICENSE BEING SUSPENDED INDEFINITELY ON 112211 FOR FAILURE TO PAY A TRAFFIC FINE; LICENSE SUSPENDED ON 121211 FOR FINANCIAL RESPONSIBILITY, AND ALSO SUSPENDED INDEFINITELY ON 010912 FOR FAILURE TO PAY TRAFFIC FINES. I AGAIN MADE CONTACT WITH THE DEFENDANT AT HIS VEHICLE AND PLACED HIM UNDER ARREST FOR KNOWINGLY DRIVING WHILE LICENSE SUSPENDED. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SEATED IN THE REAR OF MY PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY. PRIOR TO LEAVING THE SCENE, THE DEFENDANT’S VEHICLE WAS TURNED OVER TO HIS WIFE, KAYLA, AT HIS REQUEST. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT WAS CHARGED WITH KNOWINGLY DRIVING WHILE LICENSE SUSPENDED, WHERE HIS BOND WAS SET AT $500.00. THE DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION, 3506- GZP (3) FOR VIOLATION OF A TRAFFIC CONTROL DEVICE (70/55) WITH A $166.00 FINE PAYABLE WITHIN 60 DAYS AT THE CITRUS COUNTY COURTHOUSE. HE WAS ALSO ISSUED UNIFORM TRAFFIC CITATION 3507-GZP (4) FOR DRIVING WHILE LICENSE SUSPENDED KNOWINGLY, WITH A MANDATORY COURT HEARING AT 010914 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE.
