Probable cause affidavit: |
SUBMITTED BY: CLARK, CORRY 0711 (AR11123810) did, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(2). ON 120511 AT APPROXIMATELY 1418 HOURS, I OBSERVED A GREEN IN COLOR HATCHBACK HONDA TRAVELLING WESTBOUND ON ROOSEVELT BOULEVARD NEAR HARRISON STREET. I OBSERVED the DRIVER TO BE MR BRIAN BOVA, THE DEFENDANT. I HAD PREVIOUSLY DEALT with MR BOVA in the PAST AND HAD BEEN AWARE HIS DRIVER'S LICENSE STATUS WAS SUSPENDED. ALSO, ON TODAY'S DATE I WAS INFORMED BY DEPUTY CORBIN THAT MR BOVA HAD BEEN DRIVING THIS MORNING AT APPROXIMATELY 0500 HOURS AND DEPUTY CORBIN CONDUCTED A TRAFFIC STOP FOR THE DEFENDANT'S SPEED. DEPUTY CORBIN THEN ISSUED THE DEFENDANT SPEEDING CITATION NUMBER 9953-FXZ4. HE WAS ALSO ISSUED CITATION NUMBER 9953-FXZ5 FOR EXPIRED REGISTRATION FOR THE VEHICLE FOR MORE THAN SIX MONTHS WITH MANDATORY COURT DATE OF 122211 AT 1300 HOURS. DEPUTY CORBIN ISSUED CITATION NUMBER 9955-FXZ6 FOR DRIVING WHILE LICENSE SUSPENDED, KNOWINGLY, WITH COURT DATE OF 122211 AT 1300 HOURS. DEPUTY CORBIN ADVISED SHORTLY AFTER the TRAFFIC STOP THE DEFENDANT STATED HE WAS GOING TO WAIT FOR A RIDE; HOWEVER, JUST MOMENTS LATER THE VEHICLE HAD LEFT the SCENE OF THE TRAFFIC STOP. AT THAT TIME, I PULLED A PHOTO OF THE DEFENDANT AND REFRESHED MYSELF ONCE AGAIN. AT THAT TIME, I OBSERVED MR BOVA WESTBOUND ON ROOSEVELT BOULEVARD AND HE WAS OBSERVED TO BE the ONLY SUBJECT INSIDE OF THE VEHICLE. ALSO THE WINDOWS OF THE VEHICLE WERE NOT TINTED WHICH I WAS ABLE TO POSITIVELY IDENTIFY THE DEFENDANT AS THE DRIVER. AT THAT TIME, I GOT BEHIND MR BOVA'S VEHICLE AND ACTIVATED MY OVERHEAD LIGHTS OF MY PATROL VEHICLE. MR BOVA THEN CONTINUED DOWN HARRISON STREET UNTIL HE HAD PULLED INTO the DRIVEWAY OF 40 SOUTH HARRISON WHERE I THEN MADE CONTACT WITH MR BOVA. UPON MAKING CONTACT WITH MR BOVA, HE WAS VISIBLY UPSET DUE TO BEING PULLED OVER ONCE AGAIN. AT THAT TIME, MR BOVA PROVIDED ME with A COPY OF HIS CITATIONS THAT HE HAD RECEIVED EARLIER THIS MORNING FROM DEPUTY CORBIN. THE DEFENDANT EXITED HIS VEHICLE WHERE HE WAS THEN PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN the REAR OF MY PATROL VEHICLE. HE WAS THEN TRANSPORTED TO THE DETENTION FACILITY FOR BOOKING AND PROCESSING. ALL OF MR BOVA'S PROPERTY HE HAD ON HIS PERSON WAS THEN COLLECTED AND PLACED IN A BROWN PAPER BAG AND TURNED OVER TO CJ STAFF. I ALSO WROTE MR BOVA A CITATION FOR DWLS KNOWINGLY WITH COURT DATE OF 122211 AT 1300 HOURS, CITATION NUMBER 4342-GQF2, WHICH WAS ALSO TURNED IN WITH MR BOVA PROPERTY. MR BOVA'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE.
