Probable cause affidavit: SUBMITTED BY: O'MELIAN, TIMOTHY 0182 (AR09111338) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO-WIT: VICTIM'S RESIDENCE, LOCATED AT 6675 WEST PARK DRIVE, HOMOSASSA, IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF VICTIM, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: VANDALISM, IN VIOLATION OF FLORIDA STATUTE 810.02(1) AND 810.02(4); (AND) DID UNLAWFULLY, WILLFULLY AND MALICIOUSLY INJURE OR DAMAGE CERTAIN PROPERTY OF THE VICTIM, TO-WIT: BUY CUTTING THE SCREEN ON THE WEST SIDE OF RESIDENCE, MAKING ENTRY INTO THE PORCH AND BREAKING THE WINDOW ON THE DOOR TO THE RESIDENCE, SAID DAMAGE BEING OF A VALUE OF $200.00 OR LESS, IN VIOLATION OF FLORIDA STATUTES 806.13(1)(A) AND 806.13(1)(B)1. ON 100709 I RESPONDED AS BACKUP TO DEPUTY RUBY AT 6675 WEST PARK DRIVE IN REFERENCE TO A BURGLARY IN PROGRESS. WE WERE ADVISED BY DISPATCH THAT ONE SUSPECT WAS ALREADY IN CUSTODY BY THE VICTIM'S SON. UPON ARRIVAL DEPUTY RUBY ADVISED ME THAT HE HAD MADE CONTACT WITH THE VICTIM'S SON WHO ADVISED THAT WHILE IN HIS RESIDENCE LOCATED ON THE VICTIM'S PROPERTY, HE HEARD GLASS BREAK. HE ADVISED HE PROCEEDED TO THE SCREENED DOOR WHICH LEADS INTO THE PORCH AND UPON OPENING THE DOOR HE OBSERVED TWO SUBJECTS. THE DEFENDANT AND CO-DEFENDANT EXITED THE PORCH THROUGH A HOLE IN THE SCREEN. HE ADVISED ONE SUBJECT RAN NORTH AND JUMPED OVER A FENCE WEARING A GRAY SHIRT AND SHORTS AND WAS OVER SIX FEET TALL. THE OTHER SUBJECT PROCEEDED WEST ON FOOT RUNNING INTO THE CHAIN LINK FENCE, WHEN THE VICTIM'S SON GOT ON TOP OF HIM AND HELD HIM UNTIL I ARRIVED. THE DEFENDANT A 16 YEAR OLD JUVENILE WAS HANDCUFFED, DOUBLE LOCKED BEHIND THE BACK AND PLACED IN DEPUTY RUBY'S PATROL CAR. DEPUTY RUBY WAS THEN APPROACHED BY ANOTHER WITNESS, THE VICTIM'S SON'S GIRLFRIEND WHO ADVISED THAT WHILE HER BOYFRIEND WAS CHASING THE OTHER SUBJECTS, SHE OBSERVED A THIRD SUBJECT WALKING TOWARD CARDINAL STREET, ON PARK DRIVE. SHE ADVISED IT WAS A WHITE MALE APPROXIMATELY FIVE FOOT SIX, SLIM BUILD AND DID NOT APPEAR TO HAVE A SHIRT ON. SHE ADVISED SHE YELLED AT THE SUBJECT TO STOP AND COME BACK, WHEN HE BEGAN RUNNING DOWN PARK DRIVE. DEPUTY TACKETT AND CANINE PRIEST ARRIVED ON SCENE AND STARTED TRACKING IN THE DIRECTION OF CARDINAL ON PARK DRIVE. AND I ASSISTED DEPUTY TACKETT IN THE TRACK. THE AIR UNIT WAS ALSO DISPATCHED TO OUR LOCATION. DETECTIVE STRICKLAND WAS RESPONDING TO AN OFF DUTY DETAIL AND ALSO ASSISTED IN THE CASE. MYSELF AND DEPUTY TACKETT WERE ON A CANINE TRACK FROM INCIDENT LOCATION TO SONATA, SOUTH ON SONATA, TO APIAN, THEN BACK NORTH ON SONATA TO SNOWBIRD COURT AND AFTER SNOWBIRD COURT WE RETURNED NORTHBOUND ON SONATA, AT WHICH POINT WE SAW AN INDIVIDUAL CROSS OVER SONATA HEADING WESTBOUND DIRECTLY TO 6990 SOUTH SONATA AVENUE. MYSELF, DEPUTY TACKETT AND DETECTIVE STRICKLAND TRACKED THE SUBJECT TO A VACANT TRAILER ON THAT PROPERTY. THE TRAILER WAS UNSECURED AND MYSELF AND DEPUTY TACKETT MADE ENTRY. THE DEFENDANT WAS FOUND UNDERNEATH A COT COVERED UP WITH A WHITE BLANKET AND CLOTHING. AT THAT TIME THE DEFENDANT SURRENDERED AND WS PLACED IN HANDCUFFS DOUBLE LOCKED AND WAS RETURNED TO DETECTIVE STRICKLAND'S PATROL CAR WHICH WAS PARKED ON SONATA. DETECTIVE STRICKLAND MIRANDIZED THE DEFENDANT AT WHICH POINT HE WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT PROVIDED A VOLUNTARY STATEMENT TO DETECTIVE STRICKLAND, WHICH HE STATED HE DID NOT ENTER THE RESIDENCE, HOWEVER, THE TWO CO-DEFENDANTS ADVISED IN THEIR STATEMENTS THAT THE DEFENDANT MADE ENTRY INTO THE RESIDENCE AND ATTEMPTED TO REMOVE A 13 INCH TELEVISION. AT THE RESIDENCE THE DEFENDANT WAS HANDCUFFED DOUBLE LOCKED BEHIND THE BACK AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. DETECTIVE STRICKLAND SPOKE WITH ALL THREE SUBJECTS. SWORN WRITTEN STATEMENTS WERE PROVIDED BY THE THREE DEFENDANTS AND TURNED OVER TO RECORDS. THE STATEMENTS GATHERED FROM THE OTHER PARTIES INVOLVED HAD PUT THE DEFENDANT INSIDE THE RESIDENCE AT THE TIME THE BURGLARY AND VANDALISM WAS COMMITTED. CRIME SCENE TECHNICIAN'S REPORT WILL BE CONDUCTED AT THE INCIDENT LOCATION AT A LATER TIME. *NOT-EXEMPT*
