ON 042810 WHILE SITTING STATIONARY ON US 19 IN THE AREA OF HOMOSASSA, I OBSERVED A TEAL NISSAN PICKUP TRUCK BERING FLORIDA TAG F092LK, TRAVELING NORTHBOUND PAST ME. AS THE TRUCK PASSED THIS DEPUTY IT WAS OBSERVED THAT THE PASSENGER DID NOT HAVE A SEATBELT ON. UPON PULLING OUT BEHIND THE VEHICLE, THE VEHICLE MADE AN ABRUPT LANE SHIFT FROM THE FAST LANE TO THE SLOW LANE WITHOUT THE USE OF ITS TURN SIGNAL. UPON THIS DEPUTY GETTING DIRECTLY BEHIND THE VEHICLE, THIS DEPUTY STILL OBSERVED THAT THE PASSENGER DID NOT HAVE HIS SEATBELT ON. UPON ACTIVATING MY OVERHEADS, THE PASSENGER IMMEDIATELY BEGAN REACHING DOWN UNDER THE SEAT AS IF HE WAS CONCEALING SOMETHING AND ATTEMPTED TO PULL HIS SEATBELT OVER HIS BODY AND FASTEN IT. AS THIS DEPUTY EXITED MY PATROL VEHICLE, I IMMEDIATELY SMELLED A STRONG ODOR OF ETHER EMITTING FROM THE VEHICLE. THIS SMELL, IN THIS DEPUTY'S TRAINING, WAS CONSISTENT WITH METHAMPHETAMINE MANUFACTURING. UPON MAKING CONTACT WITH THE DRIVER, DEFENDANT CHARLES KEMPER, HE WAS EXTREMELY NERVOUS. HE WAS ASKED FOR HIS LICENSE AND REGISTRATION. HE WAS ABLE TO PROVIDE ME WITH HIS LICENSE; HOWEVER, HE WAS UNABLE TO LOCATE HIS REGISTRATION. THE PASSENGER DEFENDANT, RYAN JOHNSON, WAS EXTREMELY NERVOUS AND WAS STILL STEADY SQUIRMING IN HIS SEAT. IT SHOULD BE NOTED THAT HE STILL DID NOT HAVE HIS SEATBELT FASTENED AT THAT TIME. THE STRONG SMELL OF CHEMICAL COMING FROM THE VEHICLE WAS ALMOST OVERPOWERING. AT THAT TIME, THIS DEPUTY CALLED FOR BACKUP, INCLUDING A K-9 UNIT. A K-9 UNIT DID ARRIVE AT THE SCENE AND DEPUTY DAVIS DID DEPLOY HIS CANINE WITH A POSITIVE ALERT. AT THAT TIME, I ADVISED DEFENDANT KEMPER AS WELL AS DEFENDANT JOHNSON THAT IF THEY HAD SOMETHING ILLEGAL IN THE VEHICLE THEY NEEDED TO TELL ME ESPECIALLY IF IT WAS LAB RELATED, FOR EVERYONE'S SAFETY. THEY ADVISED THERE WAS NOTHING IN THE VEHICLE. AT THAT TIME, BOTH DEFENDANTS WERE ASKED TO STEP FROM THE VEHICLE AND RETURN TO THE HOOD MY PATROL VEHICLE. A CHECK OF MR KEMPER'S POCKETS DID LEAD TO THE DISCOVER OF A SMALL WHITE STRAW CONTAINING CRYSTAL RESIDUE, WHICH DID TEST POSITIVE FOR METHAMPHETAMINE. AT THAT TIME, I ADVISED DEPUTY DAVIS THAT THE PASSENGER HAD BEEN REACHING UNDERNEATH THE PASSENGER SIDE SEAT. DEPUTY DAVIS LOOKED UNDER THE SEAT AND OBSERVED A CLEAR PLASTIC BAG CONTAINING COFFEE FILTERS, WHICH HAD BEEN USED IN THE MANUFACTURING OF METHAMPHETAMINE. AT THAT TIME, DETECTIVE BLAIR ARRIVED AT THE SCENE, WHO IS LAB CERTIFIED. THIS DEPUTY READ MIRANDA TO DEFENDANT KEMPER FROM A PREPRINTED CARD. WHEN ASKED IF HE UNDERSTOOD HIS RIGHTS HE ADVISED HE DID. WHEN ASKED IF HE STILL WANTED TO SPEAK WITH THIS DEPUTY HE ADVISED HE WOULD. MIRANDA WAS ALSO READ TO DEFENDANT JOHNSON. WHEN ASKED IF HE UNDERSTOOD HIS RIGHTS HE ADVISED THAT HE DID. WHEN ASKED IF HE STILL WANTED TO SPEAK WITH THIS DEPUTY HE ADVISED THAT HE WOULD. AT THAT TIME, I MADE CONTACT WITH DEFENDANT JOHNSON. WHEN ASKED IF THERE WAS ANYTHING IN THE VEHICLE THAT WAS GOING TO HURT ANY OF THE DEPUTIES. HE ADVISED THAT "IT SHOULDN'T" THAT "IT WAS USED COFFEE FILTERS THAT WERE IN THE BAG THAT HAD BEEN UTILIZED IN THE MANUFACTURING OF METHAMPHETAMINE." HE ALSO ADVISED THAT THERE WERE SEVERAL SYRINGES IN THE PASSENGER SIDE FLOORBOARD. UPON THIS DEPUTY ASKING DEFENDANT JOHNSON IF THAT WAS WHAT HE SHOVED UNDER THE SEAT, HE ADVISED THAT IT WAS AND HE DID NOT WANT TO GET IN TROUBLE FOR IT. UPON MAKING CONTACT WITH DEFENDANT KEMPER HE ADVISED THAT THE COFFEE FILTERS BELONGED TO DEFENDANT JOHNSON AND THEY WERE NOT HIS, HOWEVER, HE DID ADMIT THAT HE KNEW THE COFFEE FILTERS WERE INSIDE THE VEHICLE AND THAT THE THEY HAD BEEN USED IN THE MANUFACTURING OF METHAMPHETAMINE. DETECTIVE BLAIR TOOK CONTROL AND CUSTODY OVER THE FILTERS. UPON THE VEHICLE BEING MADE SAFE, A CHECK OF THE VEHICLE BY THIS DEPUTY DID LEAD TO THE DISCOVERY OF THREE SYRINGES IN THE SAME AREA WHERE THE COFFEE FILTERS WERE FOUND. ALSO LOCATED ON THE DRIVER'S KEY RING A CHROME COLORED PILL CONTAINER WAS LOCATED, WHICH DID CONTAIN WHITE RESIDUE. ALL THESE ITEMS WERE LATER TAKEN INTO MY POSSESSION AND LATER TURNED IN TO EVIDENCE. AT THAT TIME MYSELF AND DETECTIVE BLAIR MADE CONTACT WITH DEFENDANT JOHNSON. DEFENDANT JOHNSON ADVISED THAT HE COULD NOT AFFORD TO GO BACK TO "JAIL" ESPECIALLY ON A MANUFACTURING CHARGE. THIS DEPUTY AS WELL AS DETECTIVE BLAIR ADVISED DEFENDANT JOHNSON THAT WE COULD NOT MAKE ANY DEALS OR PROMISES. WHEN ASKED WHERE THE COOK WAS HE ADVISED THAT IT WAS AT BELL VILLA MOBILE HOME PARK IN DEFENDANT ISRAEL PIEDRA'S RESIDENCE, WHICH WAS A TRAILER LOCATED IN THE VERY REAR OF THE TRAILER PARK. HE WENT INTO GREAT DETAIL ADVISING AND DESCRIBING THE BOTTLE THAT THE COOK WOULD BE LOCATED IN. HE ALSO WENT INTO DETAIL DESCRIBING THE VENTILATION SYSTEM USED IN THE TRAILER TO REMOVE THE FUMES FROM THE TRAILER. AT THAT TIME, I MADE CONTACT WITH DEFENDANT KEMPER ONCE AGAIN WHO WOULD NOT PROVIDE THIS DEPUTY WITH ANY FURTHER INFORMATION. BOTH DEFENDANT KEMPER AND DEFENDANT JOHNSON WERE ARRESTED AT THE SCENE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WITHOUT INCIDENT. A TOW SHEET WAS COMPLETED BY DEPUTY DAVIS. THE VEHICLE WAS TOWED BY DAVE'S AUTO BODY IN HOMOSASSA. AT THAT TIME, MYSELF, DETECTIVE BLAIR, DEPUTY MARSHALL, AND DEPUTY TACKETT RESPONDED TO DEFENDANT PIEDRA'S RESIDENCE. UPON THIS DEPUTY KNOCKING ON THE DOOR DEFENDANT PIEDRA ANSWERED ALONG WITH DEFENDANT ALICIA DUMAL. THIS DEPUTY HAD DEALT WITH BOTH OF THESES SUBJECTS NUMEROUS TIMES. THIS DEPUTY ADVISED BOTH DEFENDANTS THAT I WAS THERE IN REFERENCE TO THE ALLEGATIONS THAT THERE WAS METHAMPHETAMINE MANUFACTURING GOING ON. IT SHOULD ALSO BE NOTED DIRECTLY TO THE END OF THE RESIDENCE A WHITE BUCKET WAS LOCATED IN PLAIN VIEW WHICH DID HAVE NUMEROUS USED COFFEE FILTERS WHICH HAD BEEN USED IN THE MANUFACTURING OF METHAMPHETAMINE. DEFENDANT PIEDRA WAS CONFRONTED WITH THIS. IT WAS AT THAT TIME, HE SAID THAT HE WOULD COOPERATE FULLY WITH THESE OFFICERS. DEFENDANT PIEDRA WAS READ MIRANDA FROM A PREPRINTED CARD. HE WENT INTO THE FACT THAT DEFENDANT JOHNSON WAS THE ACTUAL METHAMPHETAMINE COOK. HE FURTHER STATED THAT THE LAB WAS INSIDE THE RESIDENCE AND THAT HE WOULD BE WILLING TO SIGN A CONSENT TO SEARCH FORM ALLOWING THESE DETECTIVES AND DEPUTIES TO ENTER THE RESIDENCE IN REFERENCE TO THE CONTRABAND. CONTACT WAS ALSO MADE WITH DEFENDANT DUMAL WHO ALSO LIVED AT THE RESIDENCE. SHE ALSO AGREED TO COOPERATE FULLY. SHE ALSO WAS READ MIRANDA VIA PREPRINTED CARD. SHE ADVISED THAT MR JOHNSON WAS THE PRIMARY COOK AND THAT THERE WERE LAB ITEMS INSIDE THE RESIDENCE. SHE ALSO AGREED TO SIGN A CONSENT TO SEARCH FORM. AT THAT TIME, THIS DEPUTY CONDUCTED TWO TAPED STATEMENTS WITH DEFENDANT PIEDRA AND DEFENDANT DUMAL. DURING THE TAPED STATEMENT IT WAS EXPLAINED TO BOTH DEFENDANTS THAT THE CONSENT FORM WAS COMPLETELY VOLUNTARY AND THAT AT ANY TIME THEY COULD ASK FOR THE SEARCH TO BE STOPPED AND IT WOULD BE. ALSO ON THE TAPED STATEMENTS BOTH SUBJECTS WERE READ MIRANDA VIA PREPRINTED CARD. BOTH SUBJECTS STATED THAT THEY UNDERSTOOD THEIR RIGHTS AND THEY DID WANT TO SPEAK TO THIS DEPUTY. CONSENT TO SEARCH FORMS WERE COMPLETED BY DEPUTY MARSHALL. AT THAT TIME DETECTIVE BLAIR MADE ENTRY INTO THE RESIDENCE. IN THE REAR BEDROOM, EXACTLY WHERE DEFENDANT PIEDRA AND DEFENDANT DUMAL ADVISED IT WOULD BE, WAS A BLUE TUB CONTAINING A REACTIONARY VESSEL, TWO UNKNOWN BI-LAYERED LIQUIDS IN JARS, WHICH BOTH FIELD TESTED POSITIVE FOR METHAMPHETAMINE, TWO GAS GENERATORS, MISCELLANEOUS GLASSWARE, AND ONE BOTTLE OF DRAIN OPENER. THESE ITEMS WERE REMOVED FROM THE RESIDENCE BY DEPUTY BLAIR. ALSO LOCATED BY THE COUCH BY THE FRONT DOOR WAS ONE LARGE GLASS BOTTLE CONTAINING A BI-LAYERED LIQUID, WHICH ALSO TESTED POSITIVE FOR METHAMPHETAMINE. ALSO IN THIS AREA BESIDE THE COUCH WAS A BLACK BAG CONTAINING FOUR FUNNELS, ONE ACIDIC TEST STRIP BOTTLE, ONE BAG OF FILTERS, TWO TURKEY BASTERS, ONE VISINE BOTTLE CONTAINING AN UNKNOWN LIQUID, A RED PAIR OF CLIPPERS COMMONLY USED IN THE STRIPPING OF LITHIUM BATTERS, AS WELL AS TWO CONTAINERS OF DRAIN OPENER. ALL THESE ITEMS WERE REMOVED FROM THE RESIDENCE. AT THAT TIME, IT WAS DEEMED BY DETECTIVE BLAIR THAT THE RESIDENCE SHOULD BE SECURE IN REFERENCE TO UNKNOWN CHEMICALS. THE GLASS BOTTLES CONTAINING THE BI-LAYERED LIQUID TOGETHER WERE MORE THAN 200 GRAMS. AT THAT TIME DEPUTY DAVIS BEGAN A THOROUGH SEARCH OF THE RESIDENCE. HE LOCATED THE FOLLOWING ITEMS NEAR THE TELEVISION HE LOCATED TWO GREEN PLASTIC CONTAINERS CONTAINING SUDAFED PILLS. THERE WAS 96 PILLS IN ONE CONTAINER AND 193 IN ANOTHER. INSIDE THE OVEN HE LOCATED A PYREX COOK PLATE, WHICH DID HAVE A CRYSTAL RESIDUE IN IT, WHICH DID FIELD TEST POSITIVE FOR METHAMPHETAMINE. IN THE BACK BEDROOM HE LOCATED A WAL-MART BAG CONTAINING TWO CANS OF EITHER STARTING FLUID AND ONE PACKAGE OF LITHIUM BATTERIES. IN THE LIVING ROOM AREA HE LOCATED NUMEROUS EMPTY SUDAFED BLISTER PACKS ON THE COUCH. ON A WOOD TABLE BY THE FRONT DOOR HE LOCATED A LARGE QUANTITY OF MISCELLANEOUS PARAPHERNALIA TO INCLUDE STRAWS, A MARIJUANA PIPE, AND NUMEROUS BAGGIES WITH RESIDUE. ALSO ON THIS TABLE HE LOCATED SEVERAL UNKNOWN PILLS AS WELL AS A PACKAGE CONTAINING AN UNKNOWN CRYSTAL SUBSTANCE. ALSO ON THE COUCH AREA HE LOCATED A BLACK BAG WHICH CONTAINED MISCELLANEOUS PARAPHERNALIA AS WELL AS MORE UNKNOWN PILLS. THE ITEMS THAT WERE DEEMED SAFE BY DETECTIVE BLAIR TO TAKE INTO EVIDENCE WERE PACKAGED BY DEPUTY DAVIS AND LATER TURNED IN TO EVIDENCE BY HIM. ALL ITEMS IN THE RESIDENCE AS WELL AS OUTSIDE WERE PHOTOGRAPHED BY EITHER DETECTIVE BLAIR OR DEPUTY CRIDLAND. IT SHOULD ALSO BE NOTED THAT DEPUTY CRIDLAND HELPED HANDLE ALL CRIME SCENE TECHNICIAN'S (CST) WORK ON THE ITEMS THAT WERE DEEMED TO BE TURNED OVER TO THE DRUG ENFORCEMENT ADMINISTRATION (DEA) CLEAN UP CREW. AT THAT TIME, THIS DEPUTY MADE CONTACT BACK WITH DEFENDANT DUMAL WHERE A SECOND TAPED STATEMENT WAS CONDUCTED. DEFENDANT DUMAL ADVISED THAT SHE DID NOT KNOW HOW TO MANUFACTURE METHAMPHETAMINES, HOWEVER, SHE DID BUY SUDAFED, AND OTHER ITEMS USED IN THE MANUFACTURING OF METHAMPHETAMINE. SHE ALSO ADVISED THAT SHE WOULD REMOVE THE SUDAFED PILLS FROM THE BLISTER PACKS FOR THE COOKS. SHE ALSO ADVISED THAT DEFENDANT PIEDRA AND DEFENDANT KEMPER ALL PRETTY MUCH DID THE SAME THING. THEY WOULD ALL GATHER THE ITEMS NEEDED FOR THE COOKS. SHE ALSO ADVISED THAT DEFENDANT JOHNSON WOULD PAY HER CASH TO BUY THE SUDAFED AND ALSO WOULD PROVIDE HER WITH METHAMPHETAMINE FOR HER HELP. AT THAT TIME, I MADE CONTACT WITH DEFENDANT PIEDRA AND CONDUCTED A SECOND TAPED STATEMENT WITH HIM. DEFENDANT PIEDRA ALSO STATED THAT HE, DEFENDANT DUMAL, AND DEFENDANT KEMPER WOULD BUY SUDAFED FOR THE COOKS AS WELL AS OTHER CHEMICALS AND THAT THE ONLY ACTIVITY HE HAD WITH THE ACTUAL COOK WAS REMOVING THE PILLS FROM THE SUDAFED PACKAGES. HE ADVISED THAT MR JOHNSON HANDLED ALL THE MANUFACTURING. HE ALSO ADVISED THAT BOTH HE AND DEFENDANT DUMAL WOULD CLEANUP AFTER THE MANUFACTURING WAS COMPLETED. WHEN ASKED WHAT WAS IN IT FOR HIM HE ADVISED THAT MR JOHNSON PAID HIM CASH TO BUY THE ITEMS NEEDED FOR THE MANUFACTURING AND THAT HE ALSO PAID THE RENT AT THE RESIDENCE. HE ADVISED THAT HE DID NOT HAVE A JOB AND THAT MR JOHNSON HANDLED ALL OF HIS BILLS IN EXCHANGE FOR HIM ALLOWING MR JOHNSON TO COOK IN THE RESIDENCE. HE ALSO FURTHER ADVISED THAT MR JOHNSON DID PROVIDE HIM WITH METHAMPHETAMINE IN PAYMENT AS WELL. AT THAT TIME, A DECISION WAS MADE TO ARREST BOTH DEFENDANTS PIEDRA AND DUMAL. BOTH DEFENDANTS WERE TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY BY DEPUTY MARSHALL WITHOUT INCIDENT. UPON DEPUTY MARSHALL ARRIVING AT THE CITRUS COUNTY DETENTION FACILITY, HE TRIED TO CONDUCT A TAPED STATEMENT WITH DEFENDANT KEMPER AND DEFENDANT JOHNSON; HOWEVER, BOTH DEFENDANTS WERE NOT COOPERATIVE AND REFUSED TO MAKE ANY STATEMENTS. DETECTIVE BLAIR STAYED AT THE SCENE TO HANDLE ALL CLEANUP. THIS DEPUTY RESPONDED TO THE DETENTION FACILITY TO BEGIN PAPERWORK. ALL FOUR DEFENDANTS WERE CHARGED WITH THE FOLLOWING CHARGES TRAFFICKING IN METHAMPHETAMINE OVER 200 GRAMS, CONSPIRACY TO MANUFACTURE METHAMPHETAMINE, POSSESSION OF A LISTED CHEMICAL, AND POSSESSION OF PARAPHERNALIA WITH A BLANKET BOND OF $60,500.00. *NOT-EXEMPT*
