| Probable cause affidavit: | SUBMITTED BY: HRYC, CHRISTOPHER 0701 (AR10116742) DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2). WHILE TRAVELING SOUTHBOUND ON NORTH SUNCOAST BOULEVARD I WITNESSED A BLUE SPORT UTILITY VEHICLE TURN RIGHT OUT OF THE OAR HOUSE RESTAURANT AND LOUNGE. I NOTICED THAT THE VEHICLE NEVER CAME TO A COMPLETE STOP AS IT EXITED THE RESTAURANT AND MADE AN IMMEDIATE RIGHT HAND TURN ONTO WEST ASHBURN LANE. AT that TIME I CONDUCTED A U-TURN AND ATTEMPTED TO CATCH UP TO THE VEHICLE. I CAUGHT UP TO THE VEHICLE AT NORTH WILLIAMS AVENUE AND WEST DEEP WOODS DRIVE. AS I GOT BEHIND THE VEHICLE TO INITIATE A TRAFFIC STOP THE BLUE FORD EXPEDITION CAME TO A COMPLETE STOP and THE DRIVER OF THE VEHICLE, WHO WAS WEARING A WHITE TEE SHIRT, JUMPED FROM the DRIVER SEAT TO THE SEAT DIRECTLY BEHIND THE DRIVER SEAT. I WAS ABLE TO SEE THIS BECAUSE THE DRIVER SIDE WINDOW WAS DOWN AND I HAD CLEAR VISUAL BECAUSE I HAD STAGGERED MY VEHICLE to the LEFT OF HIS VEHICLE AND HAD MY SPOTLIGHT ON THE VEHICLE. AT THAT TIME I APPROACHED THE DRIVER SIDE and MADE CONTACT WITH THE SUBJECT THAT WAS DRIVING the VEHICLE, WHO WAS STILL SITTING BEHIND THE DRIVER SEAT AND WAS IDENTIFIED AS BRIAN PEDROZA, WHO I HAVE SEVERAL ENCOUNTERS with IN REFERENCE TO CALLS FOR SERVICE AT HIS RESIDENCE AND WAS WEARING A WHITE TEE SHIRT. AT THAT TIME I ASKED MR PEDROZA TO STEP OUT OF THE VEHICLE. I THEN READ HIM HIS MIRANDA RIGHTS VIA PRE-PRINTED CARD AND HE STATED HE UNDERSTOOD AND WOULD TALK TO ME. I ASKED HIM WHY HE JUMPED FROM the DRIVER SEAT. HE STATED HE WAS SCARED BECAUSE HE KNEW HIS DRIVER'S LICENSE WAS SUSPENDED AND HE DID NOT WANT TO GO BACK TO JAIL BECAUSE HAD FAMILY TO GO HOME TO. i confirmed through teletype that mr pedroza did not have a florida driver's license and also did not have a valid illinois license. MR PEDROZA WAS THEN HANDCUFFED (DOUBLED LOCKED) BEHIND his BACK AND SECURED IN THE REAR OF MY PATROL VEHICLE. THE REGISTERED OWNER OF THE VEHICLE WAS THEN CONTACTED AND THE VEHICLE WAS TURNED OVER TO HER. MR PEDROZA WAS THEN TRANSPORTED to the CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL TO THE DETENTION FACILITY, MR PEDROZA AGREED TO FILL OUT A STATEMENT. THE STATEMENT READ "I WAS DRIVING the BLUE EXPEDITION AND WHEN the DEPUTY SAW ME I JUMPED IN THE BACK". THE DEFENDANT'S BOND WAS SET AT $500.00 PER THE BOND SCHEDULE AND HE WAS TURNED OVER TO DETENTION FACILITY STAFF. THE DEFENDANT WAS ALSO ISSUED A CRIMINAL CITATION, NUMBER 3407-GJX-1 FOR DRIVING WHILE LICENSE SUSPENDED WITH A MANDATORY COURT DATE OF 092310 AT 1300 HOURS AND A WARNING CITATION NUMBER 304594B FOR NOT STOPPING AS HE ENTERED A HIGHWAY EMERGING FROM A PARKING LOT.
