Probable cause affidavit: SUBMITTED BY: CUTLIP, JOSHUA 0721 (AR13-8230) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WALMART, TO WIT: 26 ELECTRONIC ITEMS, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF MORE THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). ON 120613, AT APPROXIMATELY 1425 HOURS, I WAS DISPATCHED TO WALMART SUPERCENTER IN INVERNESS, LOCATED AT 2461 EAST GULF TO LAKE HIGHWAY, IN REFERENCE TO A THEFT THAT HAD JUST OCCURRED WHERE THE SHOPLIFTER WAS IN CUSTODY. UPON ARRIVAL, I MADE CONTACT WITH THE LOSS PREVENTION OFFICER, MR JOSEPH COMPOSTELLA, AND THE DEFENDANT WHO WAS IN THE LOSS PREVENTION OFFICE, IDENTIFIED AS MS BRITTANY ISBELL. THE COMPLAINANT STATED THAT HE OBSERVED A WHITE FEMALE ENTER THE STORE, WHO WAS LATER IDENTIFIED AS THE DEFENDANT. THE COMPLAINANT ADVISED HE OBSERVED HER DISPLAY SUSPICIOUS BEHAVIOR IN THE ELECTRONIC DEPARTMENT. AT THAT TIME, THE COMPLAINANT CONTINUED TO CONDUCT FLOOR SURVEILLANCE AND OBSERVED HER SELECT MULTIPLE ELECTRONIC ITEMS FROM THE SHELF IN A HASTY MANNER. THE COMPLAINANT STATED THAT THE DEFENDANT PROCEEDED TOWARDS THE HOUSE WARES DEPARTMENT WHERE THE DEFENDANT CONCEALED ALL OF THE ITEMS THAT SHE HAD SELECTED IN A BLACK BOOK BAG. AFTER CONCEALING THE ITEMS IN HER BOOK BAG, THE DEFENDANT PROCEEDED TOWARDS THE FRONT OF THE STORE, WHERE SHE PASSED ALL POINTS OF FINAL SALE WITHOUT ATTEMPTING TO PAY FOR THE ITEMS THAT SHE HAD CONCEALED. THE COMPLAINANT STATED THAT HE FOLLOWED HER OUTSIDE OF THE STORE WHERE HE THEN MADE CONTACT WITH HER DIRECTLY OUT FRONT OF THE MAIN ENTRANCE AND IDENTIFIED HIMSELF AS BEING WITH LOSS PREVENTION. HE THEN ASKED IF SHE WOULD RETURN INSIDE THE STORE WHERE HE ESCORTED HER INTO THE LOSS PREVENTION OFFICE AND WAITED FOR LAW ENFORCEMENT’S ARRIVAL. AFTER RETURNING INSIDE THE STORE, THE COMPLAINANT RETRIEVED 26 ELECTRONIC ITEMS FROM THE DEFENDANT’S BOOK BAG, ALL OF WHICH HE HAD SELECTED AND CONCEALED. THE TOTAL VALUE OF THE 26 ITEMS THAT WERE RECOVERED WAS $761.39. THE DEFENDANT WAS READ HER MIRANDA WARNINGS AT APPROXIMATELY 1505 HOURS, VIA A PREPRINTED AGENCY APPROVED MIRANDA CARD. WITH THE DEFENDANT HAVING HER RIGHTS IN MIND, SHE CHOSE TO SPEAK WITH ME. THE DEFENDANT STATED, “I DID NOT KNOW THE ITEMS I TOOK COST THAT MUCH, AND I DID NOT INTEND TO STEAL.” THE DEFENDANT STATED THAT THE REASON WHY SHE TOOK THE ITEMS WAS THAT SHE NEEDED DIAPERS FOR HER BABY AND THEN CONTRADICTED HER STORY BY SAYING THAT SHE WAS PLANNING ON STEALING THE ITEMS AND AT A LATER DATE WAS INTENDING TO RETURN THEM IN ORDER TO PURCHASE CHRISTMAS GIFTS. UPON THE DEFENDANT’S VERBAL ADMISSION I PLACED HER UNDER ARREST FOR RETAIL GRAND THEFT. SHE WAS HANDCUFFED BEHIND HER BACK (DOUBLE LOCKED), PLACED IN THE REAR SEAT OF MY PATROL VEHICLE, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING WITHOUT INCIDENT. THE DEFENDANT’S BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. A SWORN WRITTEN STATEMENT WAS FILLED OUT BY THE COMPLAINANT AND LATER TURNED IN TO RECORDS ALONG WITH AN ITEMIZED RECEIPT OF THE RECOVERED MERCHANDISE. A PROPERTY RECEIPT CONTAINING SERIAL NUMBERS AND ITEM VALUES ALONG WITH A COPY OF THE IN STORE VIDEO SURVEILLANCE WAS COLLECTED AND TURNED IN TO EVIDENCE. AT THAT TIME, NO FURTHER ACTION WAS TAKEN BY THIS DEPUTY.
