| Comments: | Brittany PASZTOR was convicted of Rape of a Child 1st degree and Child Molestation 1st degree in 2002. According to official file documents, PASZTOR (age 14) was playing Truth or Dare with two non-familial males. PASZTOR dared the known male victim (age 10) to have sex with her which he refused. PASZTOR grabbed a circular saw blade from the wall of the garage and threatened to cut the victim's neck if he refused. The victim complied and PASZTOR sexually assaulted the him. After that assault she had sexual contact with the 7 year old victim while he protested and attempted to push her away. Afterward she told the 10 year old victim if he ever told anyone she would find him and cut his neck open. PASZTOR was sentence to 30-72 weeks of confinement with the Juvenile Rehabilitation Administration. In 2007 PASZTOR was convicted of Assault 3rd degree with sexual motiviation. According to official file documents, PASZTOR (age 19) sexually assaulted her 55 year old developmentally disabled cell mate while incarcerated. The victim reported PASZTOR got on top of her while she was sleeping and sexually assaulted her. The victim struggled and yelled at PASZTOR to get off of her, but PASZTOR continued the assault despite the victim's attempts to stop it. PASZTOR was charged with Rape 3rd degree but the charges were amended to Assault 3rd degree with sexual motivation because she would be facing civil commitment proceedings. PASZTOR pleaded guilty and was sentenced to 51 months confinement. In 2009 PASZTOR was found to meet the criteria as a sexually violent predator and subsequently sent to the Special Commitment Center (SCC) on 12/8/10. She enrolled in Sex Offender Treatment in January 2012. While at the SCC she participated minimally in Sex Offender Treatment with no marked progress towards reducing her reoffense risk. PASZTOR was reevaluated by the same evaluator in a report dated 3/1/12 and the evaluator concluded that PASZTOR does NOT meet the criteria as a Sexually Violent Predator and was released from the SCC on 5/17/12 with 36 months of Department of Corrections supervision. Due to her sexual criminal history, PASZTOR has been classified a LEVEL 3 sex offender. |
