DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY W HOLLOWAY, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: PLACING DEFENDANT UNDER ARREST, WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. On 121313 at approximately 1835 hOUrs, I along with other members of the Tactical Impact Unit (TIU) were at the Super Wal-Mart located at 2461 EAST Gulf To Lake Highway in Inverness. While standing outside the General Merchandise doors located on the east side of the store, I received a TELEphone call from Wal-Mart Loss Prevention officer, MR Joseph Compostella, who advised that he was following a black male who had concealed items and was headed for the exit that I was at. While still on the TELEphone with MR COMPOSTELLA, I observed the defendant walking towards the exit with a plastic Wal-Mart Bag. I confirmed it was the defendant with Mr Compostella, At WHICH time I entered the doorway. The defendant looked at me and I started to approach him. He started to try to evade me. I then yelled Sheriff's office. At that point, the defendant dropped his bag and attempted to evade me. I went to grabbed him and we struggled for a second and the defendant was able to break free. The defendant then proceeded to run south through the parking lot. At thAT time, Deputies Slingerland, Schaffer and C Phillips started to also run after the defendant. The defendant ran to the south end of the parking lot and then went around the Bank Of America turning west towards the Murphy Gas Station. During this time you could clearly hear Deputies Schaffer and Slingerland yell several times "Sheriff's Office stop". Eventually the subject was caught at the Murphy Gas Station. There he was handcuffed (Double Locked) and transported back to the security office of Wal-Mart. Once inside the office, the defendant was asked his name. Initially he stated he was MR Ronald Leslie. I asked him if he was sure that was his name and he stated it was. I then advised him that once at the jail we would be able to determine if it was him. He then advised that he lied and his real name was MR Bruce Karl Blanford. The merchandise that the defendant stole, two PS3 Video game systems, valued at $199.00 each, were later returned to Wal-Mart. The defendant was then transported to THE Citrus County DETENTION FACILITY. once there He was read his Miranda Rights via Agency Miranda Card. The defendant initially stated that he would give post Miranda Recording. Upon starting the recording, the defendant stated he did nOt steal anything. After the defendant stated this a couple OF times, I concluded the interview. The defendant did acknowledge that he passED all points of sale with the stolen merchandise. He further stated that he was takING the game stations for Christmas Gifts for his CHILDREN. The defendant was then charged with Retail Grand Theft and resisting without violence. He was held on a combined bond of $2,500.00 PER THE BOND SCHEDULE. |
