SUBMITTED BY: LAKATIS, KENNETH 0585 (AR11122264) DID UNLAWFULLY AND FELONIOUSLY SELL, MANUFACTURE OR DELIVER OR POSSESS WITH INTENT TO SELL, MANUFACTURE OR DELIVER OR CAUSE TO BE SOLD, MANUFACTURED OR DELIVERED TO ANOTHER PERSON, A CONTROLLED SUBSTANCE, TO-WIT: OXYCODONE IN VIOLATION OF FLORIDA STATUTES 893.135, AND 893.13(1)(A)(C), 893.03(D)(E), AND 893.13(1)(A)(1). ON 081611 AT APPROXIMATELY 1945 HOURS, I WAS CONTACTED BY DEPUTY CRUZ WHO ASKED ME TO RESPOND TO THE MOBILE GAS STATION LOCATED AT STATE ROAD 44 AND COUNTY ROAD 491 IN REFERENCE TO A DRUG INVESTIGATION. UPON ARRIVAL, I MADE CONTACT WITH DEPUTY CRUZ AND DEPUTY BERGEN. DEPUTY BERGEN EXPLAINED WHILE FUELING HIS UNMARKED PATROL VEHICLE, HE OBSERVED TWO WHITE MALES IN A RED FORD EXPLORER MAKING SOME TYPE OF EXCHANGE AND DUE TO HIS TRAINING AND EXPERIENCE, HE BELIEVED IT WAS A NARCOTICS TRANSACTION. DEPUTY BERGEN THEN PUT ON HIS CITRUS COUNTY SHERIFF'S OFFICE (CCSO) VEST, WHICH CLEARLY STATES SHERIFF ACROSS THE FRONT OF IT IN YELLOW LETTERS. DEPUTY BERGEN THEN PARKED HIS VEHICLE ON THE PASSENGER SIDE OF THE RED FORD EXPLORER. FROM THIS VANTAGE POINT, DEPUTY BERGEN COULD SEE INTO THE RED FORD EXPLORER WHERE HE OBSERVED THE DEFENDANT COUNTING OUT SMALL BLUE PILLS AND PLACING THEM INTO A WHITE HAT AND ANOTHER SUBJECT COUNTING OUT MONEY. AS THEY WERE MAKING THE EXCHANGE, DEPUTY BERGEN MADE CONTACT WITH THE SUBJECTS EXPLAINING TO THEM THAT HE WAS A DEPUTY WITH THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO). THE DEFENDANT WAS READ MIRANDA VIA A PRE-PRINTED CARD, AT WHICH TIME, HE AGREED TO SPEAK WITH DEPUTY BERGEN. POST MIRANDA, THE DEFENDANT ADMITTED THAT HE WAS SELLING OXYCODONE, 30 MILLIGRAM, PILLS TO THE OTHER SUBJECT IN THE VEHICLE FOR $10.00 A PIECE. THE OTHER SUBJECT, WHO WAS ALSO READ MIRANDA VIA A PRE-PRINTED CARD, ADVISED THAT HE WAS PURCHASING OXYCODONE FROM THE DEFENDANT. THE DEFENDANT EXPLAINED THAT HE DOES HAVE A PRESCRIPTION FOR OXYCODONE AND STATED THAT HE WAS HELPING A FRIEND OUT BY SELLING THEM TO HIM. THE DEFENDANT WAS PLACED UNDER ARREST FOR POSSESSION OF A CONTROLLED SUBSTANCE WITH THE INTENT TO SELL. THE PILLS ALONG WITH THE PROCEEDS OF THE TRANSACTION AND THE DEFENDANT'S CELLULAR TELEPHONE WHICH HAD TEXT MESSAGES BETWEEN THE TWO SUBJECTS SETTING UP THE TRANSACTION, WERE SEIZED AND TURNED IN TO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) EVIDENCE DIVISION. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY (CCDF) FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. AN ADDITIONAL REPORT WILL BE SUBMITTED TO THE STATE ATTORNEY'S OFFICE (SAO) IN REFERENCE TO THE OTHER SUBJECT IN THE VEHICLE.
