Probable cause affidavit: | SUBMITTED BY: CLOUD, TOD FHP3745 (AR11123466) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193(1). ON 110611 AT APPROXIMATELY 0652 HOURS, I ARRIVED AT US HIGHWAY 19 AND YULEE DRIVE FOR AN ASSIST CALL FROM THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) WITH A TRAFFIC STOP. UPON ARRIVAL, I MET WITH DEPUTY SHERIFF DALE JOHNSON. HE ADVISED ME THAT THE DEFENDANT'S VEHICLE WAS STOPPED IN THE MIDDLE OF YULEE DRIVE AND US 19. HE ALSO ADVISED ME THE DRIVER WAS NOT RESPONDING TO HIS COMMANDS FROM HIS VEHICLE'S "PA" SYSTEM. HE THEN MADE CONTACT WITH THE DRIVER AND HAD HIM PULL INTO THE BANK OF AMERICA PARKING LOT. UPON GETTING INFORMATION ON THE DRIVER HE COULD SMELL THE ODOR OF AN ALCOHOLIC BEVERAGE. DUE TO BEING SHORT HANDED WITH THEIR STAFFING, HE ASKED IF I WOULD ASSIST. UPON MY ARRIVAL AT 0652 HOURS, I MADE CONTACT WITH THE DRIVER, MR BUREN SOWELL, WHO WAS STILL SITTING IN THE DRIVER'S SEAT PASSED OUT OR ASLEEP BEHIND THE WHEEL. I COULD SMELL THE ODOR OF AN ALCOHOLIC BEVERAGE EMITTING FROM HIS BREATH. HE ALSO HAD BLOOD-SHOT EYES AND MUMBLED SPEECH. I HAD THE DEFENDANT EXIT HIS VEHICLE, AT WHICH TIME, HE WAS UNSTEADY EXITING HIS VEHICLE. HE WAS ALSO UNSTEADY WALKING AND STANDING. HE NEEDED HELP TO GET TO THE FRONT OF MY PATROL VEHICLE. HE THEN HAD TO LEAN AGAINST DEPUTY SHERIFF JOHNSON'S VEHICLE. I THEN ASKED THE DEFENDANT IF HE HAD BEEN DRINKING. HE STATED HE HAD BEEN DRINKING. I THEN ASKED THE DEFENDANT IF HE WOULD DO SOME FIELD SOBRIETY TASKS, AT WHICH TIME HE REFUSED. I THEN READ THE DEFENDANT IMPLIED CONSENT AND HE REFUSED REQUEST FOR A BREATH TEST. HE ALSO REFUSED A SECOND TIME UPON READING ADDITIONAL BREATH TEST INFORMATION. THE DEFENDANT WAS THEN PLACED UNDER ARREST FOR DRIVING UNDER THE INFLUENCE (DUI). HE WAS HANDCUFFED (DOUBLE LOCKED) AND PLACED IN THE REAR OF MY PATROL VEHICLE. UPON REMOVAL OF THE DEFENDANT'S VEHICLE, THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT AGAIN WAS GIVEN THE OPPORTUNITY TO DO FIELD SOBRIETY TASKS AND A "BAC" BREATH TEST. THE DEFENDANT AGAIN REUSED. THE DEFENDANT WAS THEN ISSUED CITATION NUMBER 7943-XBN FOR DUI.
