SUBMITTED BY: POLLARD, RANDALL 0677 (AR10117745) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS APPROXIMATELY 30.02 GRAMS, WITH THE INTENT TO SELL THE SAID SUBSTANCE TO ANOTHER PERSON, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(1)(A)(2). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, MARIJUANA, TO WIT: A SCALE COUPLED WITH THE MARIJUANA AND SANDWICH BAGS COUPLED WITH THE MARIJUANA, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 110310 WHILE ON ROUTINE PATROL IN THE AREA OF 3RD AVENUE AND NE 11TH STREET IN CRYSTAL RIVER, I OBSERVED A GOLD OLDSMOBILE SPORTS UTILITY VEHICLE (SUV) ROLL THROUGH A STOP SIGN LOCATED AT NE 3RD AVENUE/NE 11TH STREET. THE SUBJECT AT THAT TIME WAS HEADING TOWARD US HIGHWAY 19 IN A SOUTH WESTERLY DIRECTION. AT THAT TIME, I CONDUCTED A TRAFFIC STOP ON THAT VEHICLE BY INITIATING MY LIGHTS AND SIREN. AT THAT TIME, WE CAME TO A STOP ON NE 3RD AVENUE AND NE 4TH STREET. UPON MAKING CONTACT WITH THE DRIVER/DEFENDANT, HE PROVIDED ME WITH A FLORIDA DRIVER'S LICENSE AND IDENTIFIED HIMSELF AS MR CAMERON JOHN STOKES WITH A DATE OF BIRTH OF 121188. I RETURNED TO MY VEHICLE TO RUN THE SUBJECT FOR WANTS AND WARRANTS AND A DRIVER'S LICENSE STATUS. WHILE RUNNING THE DEFENDANT FOR WANTS AND WARRANTS, K-9 DEPUTY NEWTON ARRIVED ON SCENE. AT THAT TIME, I RETURNED TO THE DRIVER'S SIDE OF THE DEFENDANT'S VEHICLE AND ASKED HIM IF THERE WAS ANYTHING INSIDE THE VEHICLE WHICH I NEEDED TO BE AWARE OF BEFORE K-9 DEPUTY NEWTON WALKED HER DOG AROUND THE VEHICLE. THE DEFENDANT SHOOK HIS HEAD AND STATED "I'M JUST GOING TO GIVE IT TO YOU". HE PULLED OUT A CLEAR PLASTIC BAGGIE CONTAINING A GREEN LEAFY SUBSTANCE WHICH I RECOGNIZED IN MY TRAINING AND EXPERIENCE TO BE MARIJUANA. HE THEN HELD THE BAGGIE OUT THE WINDOW, AT which TIME, I TOOK THE BAGGIE AND ADVISED THE DEFENDANT TO STEP OUT OF THE VEHICLE. I THEN ORDERED THE DEFENDANT TO STEP TO THE FRONT OF MY VEHICLE WHILE I CONDUCTED A PRESUMPTIVE FIELD TEST ON THE GREEN LEAFY SUBSTANCE INSIDE THE BAGGIE WHICH DID TEST POSITIVE FOR MARIJUANA. WHILE DOING SO, K-9 DEPUTY NEWTON SEARCHED THE INTERIOR OF THE VEHICLE FOR ANY MORE NARCOTICS. THE DEFENDANT THEN SPONTANEOUSLY UTTERED THAT THERE WAS ANOTHER "QUARTER" IN THE VEHICLE. AT THAT TIME, I READ THE DEFENDANT HIS MIRANDA RIGHTS VIA A PREPRINTED CARD. SHORTLY AFTER, K-9 DEPUTY NEWTON REMOVED TWO MORE CLEAR PLASTIC BAGGIES BOTH CONTAINING A GREEN LEAFY SUBSTANCE THAT APPEARED TO BE MARIJUANA ALONG WITH A WINCHESTER LIMITED ADDITION WOOD BOX WHICH CONTAINED MARIJUANA SEEDS AND STEMS ALONG WITH A PORTABLE SCALE MADE BY AWS, MODEL BLADE 100. K-9 DEPUTY NEWTON ADVISED ALL THESE ITEMS WERE LOCATED NEAR ONE ANOTHER. SHE ALSO STATED SHE FOUND A BOX FULL OF SANDWICH BAGS IN THE SAME VICINITY. I PLACED THE DEFENDANT UNDER ARREST FOR POSSESSION OF MARIJUANA WITH INTENT TO DISTRIBUTE AND POSSESSION OF PARAPHERNALIA. I ASKED THE DEFENDANT HOW MUCH HE PAID FOR THE MARIJUANA TO WHICH HE STATED "30 A QUARTER" AND THAT HE BUYS IT FROM THE OTHER SIDE OF THE COUNTY. THE DEFENDANT ALSO STATED THAT THE MARIJUANA WAS FOR HIS PERSONAL USE AND THAT HE DOES NOT SELL THE MARIJUANA. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. WHILE AT THE DETENTION FACILITY, I WEIGHED THE THREE CLEAR PLASTIC BAGGIES CONTAINING THE MARIJUANA FOR A TOTAL OF 30.20 GRAMS INCLUDING THE BAGGIES. THE MARIJUANA WILL BE WEIGHED AGAIN AS EVIDENCE BEFORE BEING SUBMITTED AND THE TRUE WEIGHT OF THE MARIJUANA ONLY WILL BE DOCUMENTED IN THE FINAL REPORT. THE DEFENDANT WAS ISSUED A WARNING CITATION FOR RUNNING THE STOP SIGN, NUMBER 312636-B, WHICH WAS PLACED IN HIS PROPERTY AT THE DETENTION FACILITY.
