SUBMITTED BY: WEAR, KENNETH 0073 (AR08103605) SUBJECT DID KNOWINGLY ACQUIRE OR ATTEMPT TO ACQUIRE POSSESSION OF A CONTROLLED SUBSTANCE, TO WIT: OXYCODONE, AS DESCRIBED IN FLORIDA STATE STATUTE NUMBER 893.13, AND IN THE COURSE THEREOF UTILIZED MISREPRESENTATION, FRAUD, DECEPTION OR SUBTERFUGE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 893.13(7)(A)(9). TO WIT: ATTEMPTED TO SUBMIT A FRAUDULENT PRESCRIPTION WRITTEN IN THE DEFENDANT'S NAME, MS CARMEN MCGREW, DATED 060508, FROM DOCTOR NASIM AHMED, FOR OXYCODONE 30 MILLIGRAMS, 200 COUNT. ON 060608, THIS DETECTIVE WAS CONTACTED BY BRASHEAR'S PHARMACY, IN LECANTO, IN REFERENCE TO THE DEFENDANT BEING PRESENT AND ATTEMPTING TO PASS A FRAUDULENT PRESCRIPTION IN HER NAME. THE COMPLAINANT ADVISED THAT THE DEFENDANT HAD BEEN AT THE PHARMACY IN THE PAST AND HAD PICKED UP PRESCRIPTIONS FOR THE CO-DEFENDANT, STATING THAT SHE WAS THE OFFICE MANAGER OF THE DOCTOR AND HAD AUTHORIZATION TO PICK UP THE PRESCRIPTIONS. HOWEVER, AT THE TIME CONTACT COULD NOT BE MADE WITH HER AND CONFIRMATION WITH THE DOCTOR'S OFFICE COULD NOT BE MADE DUE TO THE LATE TIME OF DAY. THE COMPLAINANT DID REMEMBER THE DEFENDANT ON THIS DATE AND CALLED THE DOCTOR'S OFFICE. THE DEFENDANT SAID SHE WORKED FOR AND ASKED A WORKER IF SHE WAS A PATIENT IN THEIR OFFICE. THE WORKER ADVISED THAT THE DEFENDANT WAS NOT A PATIENT WHICH CAUSED SUSPICION PROMPTING A CALL THIS DETECTIVE. UPON ARRIVAL, THIS DETECTIVE MADE CONTACT WITH THE COMPLAINANT AND THE DEFENDANT. THE PRESCRIPTION WAS OBSERVED TO BE WRITTEN IN THE DEFENDANT'S NAME FOR OXYCODONE 30 MILLIGRAM, 200 COUNT, AND SIGNED BY DOCTOR NASIM AHMED. THE DEFENDANT MADE THE STATEMENT THAT THE PRESCRIPTION WAS FRAUDULENT AND THAT SHE HAD WRITTEN IT. MIRANDA WARNING WAS THEN READ TO THE DEFENDANT, WHERE SHE AGREED TO ANSWER QUESTION WITHOUT AN ATTORNEY PRESENT. THE DEFENDANT ADVISED THAT SHE DOES WORK FOR DOCTOR NASIM AHMED AS HIS OFFICE MANAGER AND THAT SHE HAS ROUTINELY WRITTEN THE SAME PRESCRIPTION FOR HER AND HER BOYFRIEND, MR RUSSELL KNECHT (CO-DEFENDANT). SHE FURTHER STATED THAT SHE DID SO, BEING HER BOYFRIEND (CO-DEFENDANT) IS AN ADDICT. FURTHER INVESTIGATION REVEALED THAT THE DEFENDANT HAD OBTAINED OXYCODONE IN HER NAME ON SIX PRIOR OCCASIONS DATING BACK TO 111907, AND FOR HER BOYFRIEND (CO-DEFENDANT), SIXTEEN PRIOR OCCASIONS SINCE 082707. THIS WAS CONFIRMED BY PRESCRIPTION PROFILES ON BOTH SUBJECTS AND BY THE DEFENDANT'S OWN ADMITTANCE. CONTACT WAS ALSO MADE WITH DOCTOR AHMED AND ADVISED HIM OF THIS INCIDENT. THE DOCTOR ADVISED THAT HE HAD NOT AUTHORIZED OR SIGNED ANY PRESCRIPTIONS FOR THE DEFENDANT OR HER BOYFRIEND (CO-DEFENDANT), NOR WERE THEY HIS PATIENTS. THE DEFENDANT WAS PLACED UNDER ARREST AND TRANSPORTED TO CITRUS COUNTY DETENTION FACILITY FOR PROCESSING AND GIVEN A BOND OF $5,000.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
