Probable cause affidavit: SUBMITTED BY: STRICKLAND, DALE 0276 (AR14-9977) DID UNLAWFULLY AND KNOWINGLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: MARIJUANA, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1) ON 042014 AT 2240 HOURS, I WAS CONDUCTING ROUTINE PATROL IN THE AREA OF HIGHWAY 19 AND TURKEY OAK WHEN I OBSERVED A SILVER EXPEDITION WITH AN INOPERABLE LICENSE PLATE LIGHT TRAVELING SOUTH ON HIGHWAY 19. I THEN PULLED out BEHIND THE VEHICLE AND CAUGHT UP TO IT IN THE AREA OF HIGHWAY 19 AND HIGHWAY 44 AT WHICH TIME I INITIATED MY OVERHEAD LIGHTS. THE VEHICLE CAME TO AN ABRUPT STOP IN THE TURN LANE IN FRONT OF THE CVS PHARMACY. I THEN ASKED THE DRIVER TO PULL INTO THE CVS PHARMACY PARKING LOT AND INSTEAD OF GOING TO THE DRIVEWAY WHICH WAS DIRECTLY TO HIS LEFT, WHICH I HAD POINTED OUT TO HIM, HE MADE A U-TURN AND DROVE ONTO HIGHWAY 44 AND AROUND TO THE BACK DRIVEWAY OF THE PARKING LOT. THE VEHICLE THEN CAME TO A STOP IN THE PARKING LOT OF CVS PHARMACY. I APPROACHED THE DRIVER AND ASKED HIM FOR HIS DRIVER'S LICENSE, REGISTRATION, AND INSURANCE. THE DRIVER APPEARED TO BE NERVOUS AND COULD NOT FIND HIS REGISTRATION. I THEN INFORMED HIM WHY I PULLED HIM OVER, WHICH WAS DUE TO HIM HAVING AN INOPERABLE LICENSE PLATE LIGHT. I ADVISED HIM I WOULD BE JUST A MOMENT AND RETURNED TO MY PATROL VEHICLE TO FILL OUT A WRITTEN WARNING. I THEN REQUESTED K-9 DEPUTY VIGGIANO TO RESPOND TO MY LOCATION. DEPUTY VIGGIANO ARRIVED ON SCENE AND ADVISED THE DEFENDANT, MR KENNETH SANDERS JR, THAT HE WOULD BE CONDUCTING A K-9 SNIFF AROUND THE VEHICLE. DEPUTY VIGGIANO WALKED K-9 CONAN AROUND THE VEHICLE AND K-9 CONAN GAVE A VISIBLE ALERT ON THE DRIVER DOOR. DEPUTY VIGGIANO RETURNED TO MY PATROL VEHICLE AND ADVISED ME THAT K-9 CONAN ALERTED TO THE VEHICLE. THE DRIVER WAS ASKED TO EXIT THE VEHICLE. HE WAS THEN PATTED DOWN AND ESCORTED TO THE FRONT OF MY PATROL VEHICLE. THE PASSENGER/DEFENDANT, MS CAROLYN WILLIAMS, WAS THEN ESCORTED BACK TO THE FRONT OF MY PATROL VEHICLE. DEPUTY VIGGIANO APPROACHED THE OTHER PASSENGER, MS ZHANE JOHNSON. HE OBSERVED WHAT APPEARED TO BE REMNANTS OF CANNABIS ON HER LAP AND ASKED HER TO EXIT THE VEHICLE. SHE WAS THEN PLACED IN HANDCUFFS. DEFENDANT SANDERS JR THEN BEGAN TO APPROACH DEPUTY VIGGIANO STATING “ANYTHING THAT SHE HAS IS MINE.” MYSELF AND DEPUTY FERGUSON (0505), WHO HAD ALSO ARRIVED ON SCENE, COMMANDED DEFENDANT SANDERS JR TO STOP. HE WAS THEN ESCORTED BACK TO MY PATROL VEHICLE AND PLACED IN HANDCUFFS. DEFENDANT SANDERS JR WAS PLACED IN THE REAR OF MY PATROL VEHICLE WHILE A SEARCH OF THE INTERIOR OF THE VEHICLE WAS CONDUCTED. DEPUTY VIGGIANO PULLED OUT A PINK BAG, WHICH BELONGED TO DEFENDANT JOHNSON, AND DISCOVERED A PLASTIC BAGGIE CONTAINING WHAT APPEARED TO BE CRACK COCAINE. IT WAS THEN REMOVED AND PLACED ON THE HOOD OF MY PATROL VEHICLE. ALSO INSIDE OF THE PINK BAG, THERE WAS A SMALL GREEN BAG WHICH HAD TWO SMALL MARIJUANA BLUNTS WHILE SEARCHING THE REST OF MS JOHNSON’S BELONGINGS AND PURSE, IT WAS DISCOVERED IN A PINK WALLET WITH RHINESTONES ON IT, A $1.00 BILL WITH CANNABIS WAS ROLLED UP INSIDE OF IT IN AN ATTEMPT TO HIDE IT. THIS DEPUTY ALONG WITH DEPUTY VIGGIANO CONFIRMED THESE ITEMS WERE MS JOHNSON’S DUE TO HER HAVING AN ITT TECHNICAL INSTITUTE ENVELOPE WITH HER NAME AND ADDRESS LOCATED ON THE OUTSIDE OF IT. SHE WAS THEN ASKED IF THE PURSE AND THOSE ITEMS WERE HERS AND SHE STATED YES. HER IDENTIFICATION WAS TAKEN OUT OF A BROWN WALLET WITH A PICTURE OF BETTY BOOP WHICH WAS LOCATED IN THE SAME AREA OF BOTH THE PINK WALLET, which the CANNABIS WAS FOUND, AND THE PINK PURSE. ANOTHER SEARCH WAS CONDUCTED IN THE REAR OF THE VEHICLE. WHILE SEARCHING MS CAROLYN WILLIAMS’ PURSE, IT WAS DISCOVERED THERE WAS A CELLOPHANE BAGGIE WHICH THROUGH TO MY TRAINING AND EXPERIENCE, I BELIEVED TO BE CANNABIS. ALSO IN THAT SAME PURSE WE LOCATED A GRINDER WHICH IS USED TO GRIND UP CANNABIS. THIS DEPUTY ALONG WITH DEPUTY VIGGIANO WEIGHED THE CRACK COCAINE AND IT WAS APPROXIMATELY 8.7 GRAMS. WE THEN WEIGHED THE CANNABIS WHICH WAS REMOVED FROM MS JOHNSON’S PURSE WHICH WEIGHED APPROXIMATELY ONE GRAM. WE THEN WEIGHED THE CANNABIS REMOVED FROM MS WILLIAMS’’ PURSE WHICH WEIGHED APPROXIMATELY 2.6 GRAMS. ALL ITEMS WERE PACKAGED AND LATER TURNED INTO CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE. THIS DEPUTY READ DEFENDANT SANDERS JR HIS MIRANDA WARNING VIA AN AGENCY PRINTED CARD WHERE HE WAS QUESTIONED ABOUT THE CRACK COCAINE. HE STATED ALL OF THE “DOPE” THAT WAS IN THE VEHICLE WAS HIS. ALL DEFENDANTS WERE HANDCUFFED (DOUBLE LOCKED) BEHIND THEIR BACKS AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. DEFENDANT SANDERS JR’S BOND WAS SET AT $5,000.00, PER THE BOND SCHEDULE FOR POSSESSION OF CRACK COCAINE. MS JOHNSON AND MS WILLIAMS WERE LATER RELEASED ON THEIR OWN RECOGNIZANCE.
