SUBMITTED BY: SLINGERLAND, DANIEL 0443 (AR16-20624 ) (16-113306) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: .1 GRAMS OF HEROIN, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A); AND DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 4 PILLS OF BUPRENORPHINE 8 MILLIGRAMS (MG), IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A); AND DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: TWO GLASS PIPES, IN VIOLATION OF FLORIDA STATE STATUTES 893.147(1). ON 081816 AT APPROXIMATELY 2153 HOURS, I OBSERVED A GOLD FOUR-DOOR CAR TRAVELING NORTH ON CARL G ROSE HIGHWAY IN HERNANDO. THE VEHICLE WAS EXCEEDING THE POSTED SPEED LIMIT. I BEGAN FOLLOWING THE VEHICLE, WHICH CONTINUED TO EXCEED THE POSTED SPEED LIMIT, GOING 58 MILES PER HOUR (MPH) IN A POSTED 50 MPH ZONE. I CONDUCTED A TRAFFIC STOP ON the VEHICLE. THE VEHICLE TOOK AN UNUSUAL AMOUNT OF TIME TO COME TO A STOP. WHILE PULLING OVER, I OBSERVED the FEMALE PASSENGER IN the BACKSEAT CONTINUE TO LEAN FORWARD, REACHING TOWARDS THE FLOORBOARD OF THE VEHICLE. UPON MAKING CONTACT with the DRIVER, I REQUESTED HIS DRIVER'S LICENSE AND VEHICLE REGISTRATION AND PROOF OF INSURANCE. THE DRIVER, LATER IDENTIFICATION AS MR VINCENT RILEY HOWARD, WAS NOT COOPERATIVE IN PROVIDING ME HIS FLORIDA IDENTIFICATION CARD; HOWEVER, HE DID STATE THAT HE BELIEVED HIS DRIVER'S LICENSE WAS SUSPENDED. WHILE INTERVIEWING MR HOWARD, K-9 DEPUTY JUSTIN WILLIAMS (0730) ARRIVED ON SCENE AND DEPLOYED HIS CANINE FOR AN EXTERIOR SNIFF OF THE VEHICLE. SEE HIS K-9 SUPPLEMENT FOR FURTHER. MR HOWARD WAS SUBSEQUENTLY DETAINED FOR AN OUT OF COUNTY WARRANT AND WAS LATER ARRESTED AFTER THE WARRANT WAS CONFIRMED. K-9 DEPUTY J WILLIAMS ADVISED HIS CANINE HAD GAVE A POSITIVE ALERT FOR NARCOTICS ON the VEHICLE. DEPUTY JAMES SUDLOW (0759) AND I CONDUCTED A SEARCH OF THE INTERIOR OF THE VEHICLE. DEPUTY SUDLOW BEGAN SEARCHING THE BACK PASSENGER SEAT. HE ADVISED ME HE OBSERVED A BAG THAT WAS IDENTIFIED AS BELONGING TO MS PRUITT. DEPUTY SUDLOW DISCOVERED A SMALL QUANTITY OF A SUBSTANCE HE IDENTIFIED AS CANNABIS. A PRESUMPTIVE FIELD TEST REVEALED POSITIVE RESULTS FOR CANNABIS. DEPUTY SUDLOW ALSO DISCOVERED SEVERAL SYRINGES THAT HAD BEEN CONCEALED UNDER THE BACK PASSENGER SEAT. DEPUTY SUDLOW ALSO ADVISED HE DISCOVERED A SMALL BLUE ZIPLOC BAG THAT CONTAINED A WHITE POWDERY SUBSTANCE. THAT SUBSTANCE WAS FIELD TESTED AND REVEALED POSITIVE RESULTS FOR HEROIN. DEPUTY SUDLOW ALSO DISCOVERED A GLASS PIPE AND A METAL SMOKING PIPE IN MS PRUITT'S BAG. AS I CONDUCTED A SEARCH OF the FRONT SEAT OF the VEHICLE, I DISCOVERED A GLASS SMOKING PIPE WITH BURNT COPPER IN THE END OF IT IN the CENTER CONSOLE. THROUGH MY TRAINING AND EXPERIENCE GLASS PIPES OF THIS NATURE ARE USED FOR SMOKING OR INGESTING NARCOTICS. ALSO IN THE CENTER CONSOLE, I FOUND A CARDBOARD BOX THAT CONTAINED ANOTHER GLASS PIPE, ALONG WITH ADDITIONAL PARAPHERNALIA. THE BOX ALSO CONTAINED A SMALL PLASTIC BOTTLE THAT CONTAINED FOUR PILLS. the FOUR PILLS WERE INSCRIBED with "M924". A CHECK OF THE WEBSITE "DRUGS.COM" IDENTIFIED THE PILLS AS BUPRENORPHINE 8MG, A SCHEDULE III NARCOTIC. NO OTHER ILLEGAL SUBSTANCES WERE LOCATED WITHIN THE VEHICLE. IN A POST MIRANDA INTERVIEW WITH MR HOWARD, MR HOWARD STATED HE UNDERSTOOD HIS MIRANDA RIGHTS AND AGREES TO ANSWER MY QUESTIONS. MR HOWARD DID ADMIT THAT HIS DRIVER'S LICENSE WAS SUSPENDED. MR HOWARD DID NOT HAVE ANY KNOWLEDGE OF THE NARCOTICS OR PARAPHERNALIA LOCATED IN THE VEHICLE. MR HOWARD STATED THE VEHICLE BELONGED TO DEFENDANT LOEWUS AND HE WAS DRIVING BECAUSE DEFENDANT LOEWUS WAS DIABETIC AND WAS NOT FEELING WELL. I THEN CONDUCTED A POST MIRANDA INTERVIEW WITH DEFENDANT LOEWUS. MS LOEWUS STATED SHE UNDERSTOOD HER MIRANDA RIGHTS AND STATED SHE WOULD ANSWER MY questions. DEFENDANT LOEWUS STATED that THE PARAPHERNALIA LOCATED IN the CENTER CONSOLE BELONGED TO HER. SHE ADVISED SHE DOES SMOKE CRACK COCAINE and USES PILLS. SHE STATED THAT SHE DID NOT HAVE A PRESCRIPTION FOR the BUPRENORPHINE. SHE STATED SHE IS ADDICTED TO OPIATES AND WAS USING THAT PRESCRIPTION TO HELP EASE HER PAIN FROM WITHDRAWALS. DEFENDANT LOEWUS ALSO ADMITTED TO POSSESSING THE HEROIN THAT WAS DISCOVERED IN the BACKSEAT. IN A POST MIRANDA INTERVIEW WITH DEFENDANT PRUITT, SHE STATED SHE UNDERSTOOD HER MIRANDA RIGHTS AND AGREED TO ANSWER MY QUESTIONS. DEFENDANT PRUITT ADMITTED THAT THE CANNABIS AND PARAPHERNALIA DISCOVERED IN HER BAG BELONGED TO HER AND NO ONE ELSE IN the VEHICLE. SHE STATED SHE HAS A PILL OPIATE ABUSE PROBLEM. AT THAT TIME, DEFENDANT HOWARD WAS PLACED UNDER ARREST FOR HIS WARRANT. DEFENDANT LOEWUS WAS ADVISED SHE WAS BEING PLACED UNDER ARREST FOR TWO COUNTS OF POSSESSION OF A CONTROLLED SUBSTANCE AND ONE COUNT OF POSSESSION OF DRUG PARAPHERNALIA. SHE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK. DEFENDANT PRUITT WAS ALSO ADVISED SHE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF CANNABIS AND POSSESSION OF DRUG PARAPHERNALIA. SHE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK. BOTH FEMALE DEFENDANTS WERE TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY BY DEPUTY SCHAFFER AND THE MALE DEFENDANT WAS TRANSPORTED BY ME. DEFENDANT LOEWUS' BOND WAS SET AT $2,000.00 EACH FOR TWO COUNTS OF POSSESSION OF A CONTROLLED SUBSTANCE AND $1,000.00 FOR ONE COUNT OF POSSESSION OF DRUG PARAPHERNALIA, FOR A TOTAL BOND OF $5,000.00, PER THE BOND SCHEDULE. DEFENDANT PRUITT'S BOND WAS SET AT $1,000.00 FOR POSSESSION OF CANNABIS AND $1,000.00 FOR POSSESSION OF DRUG PARAPHERNALIA, FOR A TOTAL BOND OF $2,000.00, PER THE BOND SCHEDULE. |
