Probable cause affidavit: | SUBMITTED BY: FHP OFFICER RICHARD TAYLOR 1488 (AR12-3129) (0650) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193. On this date and time I was dispatched to a vehicle crash on E Stokes Rd in Hernando Citrus County. As I arrived on scene I observed 2 Citrus county deputies and several people on the side of the road. I located the driver Ms. Catherine Neeld. I discussed with her on what took place and the events that led up to the vehicle going off of the road and down the embankment. Ms. Neeld stated that she was coming around the corner and swerved to miss a deer. Then her vehicle traveled through a barb wired fence and down the embankment coming to final rest just before a canal. As I was talking to Ms. Neelds I could detect an odor of alcohol emitting from the driver's mouth that intensified as she spoke. I also observed her speech was slurred at times and her eyes were bloodshot and watery. As I spoke with Ms. Neeld she was swaying slightly as she stood. I explained to Ms. Neeld that I had concluded the crash investigation at this time and had changed hats to conduct a DUI Investigation. Ms. Neeld understood and she stated that she had consumed approximately 5 beers and took 2 shots from a bottle of Captain Morgan earlier that night at a friendâs house. She stated that she was the designated driver and that they were on their way to a friendâs house. She also stated that she wasn't feeling any effects of the alcohol. I asked Ms. Neeld if she would be willing to conduct a series of Roadside Sobriety Tasks and she stated yes. It should be noted that the weather was clear and traffic was extremely light. Horizontal Gaze Nystagmus: Left Eye: Lack of smooth pursuit, had maximum deviation, had onset prior to 45 degrees Right Eye: Lack of smooth pursuit, had maximum deviation, had onset prior to 45 degrees One Leg Stand: Driver swayed while balancing, used arms to balance, put right foot down on 13, 17 and 28 seconds. Walk and Turn: Driver did not touch heel to toe on steps 6,8 on the way down taking 10 steps and on the way back did not touch heel to toe on step 5 taking only 8 steps back. I explained to the driver that I felt she was still under the effects of alcohol and that she was going to be placed under arrest for DUI. I read implied consent to Ms. Neeld and she stated she would give a breath sample. I placed handcuffs on the driver and checked for fit and to double lock them. Ms. Neeld was placed in the rear right passenger seat of my patrol vehicle and was transported to Citrus County Jail. Due to the time that had elapsed from when the call came out to when Ms. Neeld had submitted a breath sample the results were .040 and .038 It should be noted that Ms. Neeld was very cooperative throughout.
