SUBMITTED BY: BEETOW, CHARLES 0295 (AR13-8204) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: METHAMPHETAMINES, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WALGREENS, TO WIT: ELECTRIC GROOMING CLIPPERS AND TWO PAIRS OF PROFESSIONAL TWEEZERS, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(3)(A). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: GLASS CYLINDRICAL SMOKING DEVICE WITH RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTES 893.147(1). ON 120313 AT APPROXIMATELY 2235 HOURS, I WAS DISPATCHED TO THE AREA OF WALGREENS LOCATED AT 104 SOUTH APOPKA, INVERNESS, IN REFERENCE TO A SHOPLIFTER WHO WAS POSSIBLY WITHIN THE STORE. WHILE EN ROUTE, I OBSERVED A GRAY TOYOTA PICKUP TURNING EASTBOUND IN TO THE WESTBOUND LANE OF HIGHLAND BOULEVARD FROM SOUTH APOPKA. WHILE THE DRIVER WAS CONDUCTING HIS EASTBOUND TURN IN TO THE WRONG LANE OF HIGHLAND BOULEVARD, HE HIT THE BRAKES, CORRECTED AND THEN PROCEED DOWN THE EASTBOUND LANE. I ADVISED DISPATCH THAT I WAS GOING TO CONDUCT A TRAFFIC STOP ON THIS VEHICLE. AT THIS TIME, I WAS CHECKING ON THE DRIVER TO MAKE SURE THAT HE OR SHE WAS NOT IMPAIRED OR HAVING A MEDICAL PROBLEM. AS I CONDUCTED A TRAFFIC STOP ON THE VEHICLE, CONTACT WAS MADE WITH A WHITE MALE PASSENGER AND A WHITE MALE DRIVER. THE PASSENGER OF THE VEHICLE IMMEDIATELY STARTED EXPLAINING THAT WALGREENS WAS ACCUSING THEM OF STEALING. I OBSERVED THE DRIVER LATER IDENTIFIED AS THE DEFENDANT, MR CHAD EVERETT HALEY. THE DRIVER WAS WEARING BLUE JEANS, A WHITE TANK TOP AND A BALL CAP. THIS DESCRIPTION MATCHED THAT OF THE DEFENDANT WHO HAD ALLEGEDLY STOLEN ITEMS FROM WALGREENS. WITH THE ASSISTANCE OF DEPUTY ANSTEAD, SHE WAS ABLE TO MAKE CONTACT WITH TWO WALGREENS EMPLOYEES, MS SALLY GIMS AND MS JOANN PAPPALARDO. BOTH WITNESSES HAD BEEN ABLE TO HEAR THE DEFENDANT OPEN PACKAGES IN THE RESTROOM LOCATED IN THE REAR OF THE STORE. THEY COULD HEAR THE DEFENDANT CONSTANTLY FLUSHING THE TOILET, TRYING TO DISGUISE THE NOISE OF PACKAGES BEING OPENED AND OF THE ELECTRIC CLIPPER BEING TURNED OFF AND ON REPEATEDLY. WHEN BOTH EMPLOYEES CONFRONTED THE DEFENDANT, HE BECAME DEFENSIVE AND RAN OUT OF THE STORE. BOTH EMPLOYEES WERE ABLE TO FIND THE EMPTY PACKAGES OF THE STOLEN ITEMS IN THE RESTROOM. BOTH EMPLOYEES CONFIRMED THAT THESE ITEMS WERE BROUGHT INTO THE BATHROOM BY THE DEFENDANT. WHILE I SPOKE WITH THE DEFENDANT, I ADVISED HIM OF DEPUTY ANSTEADâS FINDINGS. I ASKED HIM WHERE THE ELECTRIC RAZOR WAS, WHICH HE HUNG HIS HEAD AND ADMITTED IT WAS IN THE GLOVE COMPARTMENT OF HIS VEHICLE. ALSO IN THE POSSESSION OF THE DEFENDANT WERE TWO PAIRS OF PROFESSIONAL TWEEZERS THAT WERE ORANGE IN COLOR. THE ELECTRIC RAZOR WAS LOCATED IN THE GLOVE COMPARTMENT ALONG WITH THE POWER CORD. THE VARIOUS ATTACHMENTS AND CHARGING STAND WERE LOCATED ON THE FLOORBOARD AND SEAT OF THE DEFENDANTâS VEHICLE. AT THIS TIME I PLACED THE DEFENDANT UNDER ARREST FOR RETAIL THEFT. HE WAS HANDCUFFED (DOUBLE LOCKED) AND PLACED in the REAR OF A PATROL VEHICLE. WHILE CHECKING THE INTERIOR OF THE DEFENDANTâS VEHICLE FOR ANY OTHER ATTACHMENTS TO THE RAZOR, I OBSERVED IN PLAIN VIEW IN THE CENTER CONSOLE A CYLINDRICAL GLASS SMOKING DEVICE WITH BURNT RESIDUE AND A SMALL CLEAR WHITE BAGGIE CONTAINING A WHITE POWDERY SUBSTANCE. AFTER THIS DISCOVERY, I ASKED THE DEFENDANT IF THE WHITE POWDERY SUBSTANCE WAS COCAINE OR METHAMPHETAMINE. THE DEFENDANT ADMITTED THAT IT WAS âSPEEDâ MORE COMMONLY KNOWN AS METHAMPHETAMINE. I TOOK THE METHAMPHETAMINE AND GLASS SMOKING DEVICE INTO CUSTODY. THE WHITE POWDERY SUBSTANCE TESTED POSITIVE WITH A NARC REAGENT PRESUMPTIVE FIELD TEST KIT INDICATING THAT OF METHAMPHETAMINE. THE DEFENDANT WAS ADVISED THAT HE WAS ALSO BEING CHARGED WITH POSSESSION OF A CONTROLLED SUBSTANCE AND PARAPHERNALIA. A PHOTOGRAPH WAS TAKEN OF THE FIELD TEST KIT INDICATING THE BLUE COLOR. THE STOLEN AND RECOVERED ITEMS WERE LATER RETURNED TO WALGREENS AND TURNED OVER TO THE EMPLOYEES OF WALGREENS. AFTER COLLECTING ALL INFORMATION THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS BOOKED PROCESSED AND HELD WITH A TOTAL OF $5,500.00, BOND, PER THE BOND SCHEDULE. |
