SUBMITTED BY: SAAYMAN, FRANCO 1340 (AR15-13898) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: STRUCK THE VICTIM AND BIT HIM ON THE TOP OF HIS HEAD, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 021515, AT APPROXIMATELY 1855 HOURS, I RESPONDED TO 4797 NORTH APACHE TRAIL, HERNANDO, IN REFERENCE TO A PHYSICAL ALTERCATION. UPON ARRIVAL, I OBSERVED THE VICTIM, LATER IDENTIFIED AS MR TIMMY HADEN, STANDING IN THE MIDDLE OF THE ROAD IN FRONT OF THE RESIDENCE WITH BLOOD ON HIS FOREHEAD AND FACE AND A TORN SHIRT. I MADE CONTACT WITH THE VICTIM AND HE TOLD ME THAT HE WAS BATTERED AND BIT BY DEFENDANT ONE, MR CHAD MEDEIROS AND DEFENDANT TWO, MR CARLOS PONTON. THE VICTIM SAID THAT HE TOOK HIS DAUGHTER TO DEFENDANT MEDEIROSâ RESIDENCE TO PICK UP HER DOG. THE VICTIM TOLD ME THAT HIS EX-WIFE/WITNESS FOUR, MS SAMANTHA STRICKLER, RESIDES AT THE DEFENDANTâS RESIDENCE. WITNESS STRICKLER CONTACTED HER DAUGHTER AND ASKED HER IF IT WOULD BE OK FOR HER TO TAKE HER DOG HOME WITH HER, BECAUSE THERE WERE TOO MANY DOGS AT THE RESIDENCE. THE VICTIM ADVISED THAT UPON ARRIVAL, DEFENDANT MEDEIROS TOLD THE VICTIM TO LEAVE HIS PROPERTY AND HE DID, BUT CALLED THE DOG OVER TO HIM WHILE STANDING IN THE MIDDLE OF THE PUBLIC ROAD. THE VICTIM ADVISED THAT DEFENDANT MEDEIROS, WHO IS AN AMPUTEE, GOT OUT OF HIS WHEELCHAIR AND STARTED HITTING THE VICTIM AND THEN BIT HIM ON THE TOP OF HIS HEAD. I OBSERVED THE BITE MARKS ON TOP OF THE VICTIM'S HEAD. ACCORDING TO THE VICTIM, THE ALTERCATION MOVED INTO DEFENDANT MEDEIROSâ DRIVEWAY, WHERE DEFENDANT PONTON THEN JOINED THE ALTERCATION AND PUT THE VICTIM IN A HEADLOCK. DEFENDANT PONTON ALSO RESIDES AT 4797 NORTH APACHE TRAIL. WITNESS STRICKLER, THE VICTIM'S SON/WITNESS ONE, TIMOTHY HADDEN, AND TIMOTHYâS FRIEND/WITNESS TWO, LOGAN WINTER, TRIED TO INTERVENE AND STOPPED THE FIGHT. THE VICTIM TOLD ME THAT HIS HAIR WAS RIPPED OUT OF HIS HEAD, WHICH I DID OBSERVE IN THE DRIVEWAY. THE VICTIM WAS OFFERED EMERGENCY MEDICAL SERVICES, WHICH HE REFUSED. I TOOK PHOTOGRAPHS OF THE SCENE AND THE VICTIM'S AND DEFENDANTSâ INJURIES; SEE MY CRIME SCENE TECHNICIAN REPORT. I MADE CONTACT WITH WITNESS THREE (WHO LIVES ACROSS THE STREET)/SHAUNA CARPENTER. SHE, ALONG WITH TIMOTHY AND LOGAN CORROBORATED THE VICTIMâS ACCOUNT OF EVENTS. I THEN MADE CONTACT WITH WITNESS STRICKLER (WHO IS ALSO DEFENDANT MEDEIROSâ GIRLFRIEND). SHE TOLD ME THAT SHE CALLED HER DAUGHTER TO SEE IF SHE WANTED HER DOG TO COME LIVE WITH HER AT HER RESIDENCE WITH HER FATHER/VICTIM. WITNESS STRICKLER ADVISED THAT WHEN THE VICTIM AND HER DAUGHTER ARRIVED AT THE DEFENDANTâS RESIDENCE SHE HAD DECIDED TO GIVE THE DOG TO SOMEONE ELSE. SHE TOLD ME THAT THE VICTIM THEN TOOK THE DOG AND SPONTANEOUSLY ATTACKED DEFENDANT MEDEIROS. I MADE CONTACT WITH DEFENDANT MEDEIROS AND OBSERVED BLOOD ON HIS FOREHEAD. DEFENDANT MEDEIROS WAS OFFERED MEDICAL SERVICES, WHICH HE DECLINED. HE STATED THAT HE HAD THE RIGHT TO DEFEND HIS PROPERTY. THE DEFENDANT SAID THAT THE VICTIM WAS TRESPASSING AND STEALING HIS DOG. I TALKED TO DEFENDANT PONTON, WHO STATED THAT HE INTERVENED BY PLACING THE VICTIM IN A HEADLOCK, BECAUSE HE HAD TO HELP HIS FRIEND. BECAUSE THE VICTIM AND HIS DAUGHTER WERE INVITED TO THE RESIDENCE AND GIVEN PERMISSION OVER THE TELEPHONE BY WITNESS STRICKLER, I INFORMED DEFENDANT MEDEIROS AND DEFENDANT PONTON THAT THEY WERE BEING PLACED UNDER ARREST FOR BATTERY. AT THAT TIME, BOTH DEFENDANTS WERE HANDCUFFED (DOUBLE LOCKED) BEHIND THEIR BACK, PLACED INTO THE REAR OF MY PATROL VEHICLE, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE VICTIM, WITNESS STRICKLER, TIMOTHY AND LOGAN ALL FILLED OUT SWORN WRITTEN STATEMENTS, WHICH WERE COLLECTED AND WILL LATER BE TURNED IN TO RECORDS. DEFENDANT MEDEIROSâ BOND WAS SET AT $1,000.00, PER THE BOND SCHEDULE. |
