Probable cause affidavit: SUBMITTED BY: HESSE, NICHOLAS 0689 (14-51815) (AR14-9916) \t\t\tPANETTI, JAMES 1304 DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WALMART, TO WIT: TWO WIPER BLADES, COLOGNE AND A TELEPHONE CASE, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00 WITH A PREVIOUS CONVICTION, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(3)(B). On 041514 AT APPROXIMATELY 1630 HOURS, I was dispatched to 1936 NORTH Lecanto HIGHWAY, IN LECANTO, in reference to a retaiL theft that had already occurred. Upon arrival at 1702 hours I made contact with loss prevention officer, MR BRIAN elam, in the loss prevention office. He stated that on TODAY’S date prior to my arrival the defendant, MR Charles dowd, had been observed stealing multiple items and moving past ALL pointS of sale. He initially watched the defendant obtain a CELLULAR TELEPHONE case, remove it from its packaging and exit the store without being apprehended. He explained that the defendant entered the store once again where he obtained a bottle of cologne, removed it from its packaging, concealed it in his pockets and continued to walk around the store. Mr elam then watched the defendant as he picked up two windshield wiper blade packages, remove them from the packaging and conceal them under his shirt. The defendant then walked to the front of the store and exited, passing all points of sale without making any attempt to pay for the products. Mr elam advised that he stopped the defendant and identified himself and the two went to the loss prevention office to notify this agency. I spoke with the defendant who originally identified himself aS, MR Richard MurphREy, at which time he stated that he took the objects and it was a stupid thing to do. During my conversation with him I also learned that the TELEphone case that he had previously stolen was located in his vehicle in the parking lot. I asked him if he would be cooperative and return the property to the store, TO WHICH The defendant explained that before obtaining the property he would like to make a deal. I instructed THE DEFENDANT to stand up, turn around and put HIS hands behind HIS back and ADVISED HIM that he was under arrest. The defendant was handcuffed double locked behind his back AND searched for weapons and identification. I located a wallet in his POCKET with several identification cards from north Carolina, which correctly identified him as MR Charles dowd. When I asked why he provided A FALSE name to the loss prevention officer and this deputy, he advised that he was trying to start over in florida and held active warrants for domestic violence in North Carolina. I conducted a wants and warrants check via teletype who advised the warrants were active however they would not extradite. Before leaving THE SCENE, I collected a sworn written statement from mr elam who advised a copy of the surveillance VIDEO would be completed later and he would notify this agency when it was ready. I escorted the defendant outside to his vehicle where he provided access to the passenger compartment and the previously stolen TELEphone case was located behind the front passenger seat. The TELEphone case and agency case card bearing this case number was provided to mr elam. The defendant was placed in the back seat of my patrol car and transported to THE CITRUS COUNTY DETENTION FACILITY for booking and processing. THE DEFENDANT’S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE.
