Probable cause affidavit: | SUBMITTED BY: REYNOLDS, CONNARY 1267 (AR 15-13369) (15-1607) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CRACK COCAINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 010415, AT APPROXIMATELY 2310 HOURS, WHILE DRIVING MY MARKED PATROL VEHICLE SOUTHBOUND ON HIGHWAY 19 I OBSERVED A BLACK MALE WEARING A BLACK HOODIE AND BLUE JEANS TO BE RIDING A BLACK MONGOOSE BICYCLE ACROSS ALL LANES OF TRAVEL IN THE MIDDLE OF HIGHWAY 19. THE RIDER AND BICYCLE WERE VERY DIFFICULT TO SEE DUE TO THE RIDERS DARK CLOTHING AND THE BICYCLE DID NOT HAVE A LAMP ON THE FRONT OF IT NOR DID IT HAVE A REFLECTOR OR A RED LIGHT VISIBLE on the REAR. THIS DEPUTY HAD TO AGGRESSIVELY APPLY THE BRAKES ON MY PATROL VEHICLE TO AVOID STRIKING THIS BICYCLE. THE RIDER CONTINUED EASTBOUND ON NORTHEAST SECOND STREET BEHIND MEEK'S WATER TREATMENT, LOCATED AT 200 HIGHWAY 19, SUITE B, CRYSTAL RIVER. I TURNED MY MARKED PATROL VEHICLE ON TO NORTHEAST SECOND STREET BEHIND THE RIDER AT WHICH TIME I CLEARLY OBSERVED HIM TO DROP A CLEAR PLASTIC BAGGIE ON TO THE GROUND ON NORTHEAST SECOND STREET. I ACTIVATED MY EMERGENCY EQUIPMENT AND CONDUCTED A TRAFFIC STOP ON THE BICYCLE AND RIDER, LATER IDENTIFIED AS THE DEFENDANT, MR CHESTER SCRIVEN. I ADVISED THE DEFENDANT WHY I HAD STOPPED HIM AND ASKED HIM WHAT WAS IN THE BAGGIE HE THREW ON THE GROUND. HE REPLIED HE DID NOT THROW ANYTHING. I REQUESTED BACK-UP AT WHICH TIME DEPUTY BARR ARRIVED ON SCENE A SHORT TIME LATER. I OBSERVED the CLEAR PLASTIC BAGGIE THROWN ON the GROUND BY THE DEFENDANT TO CONTAIN A WHITE POWDER AND ROCK SUBSTANCE WHICH I IDENTIFIED THROUGH MY TRAINING AND EXPERIENCE TO BE CRACK COCAINE. I APPROACHED THE DEFENDANT ONCE AGAIN AND PLACED HIM IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK. THE DEFENDANT WAS IMMEDIATELY READ MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE REPLIED THAT HE DID. I THEN ASKED HIM IF HE WISHED TO SPEAK WITH ME AT THIS TIME, TO WHICH HE ADVISED THAT HE WOULD. I ADVISED THE DEFENDANT I CLEARLY OBSERVED HIM DROP THE CLEAR PLASTIC BAGGIE. THE DEFENDANT BECAME COOPERATIVE AND ADVISED HE DID DROP THE BAGGIE. I ASKED THE DEFENDANT WHAT WAS IN the BAG TO WHICH HE REPLIED COCAINE. THE DEFENDANT STATED THAT HE PURCHASED IT FOR $20.00 AND IT WAS FOR PERSONAL USE ONLY. THE SUBSTANCE WAS FIELD TESTED UTILIZING AN AGENCY ISSUED FIELD TEST KIT WHICH YIELDED POSITIVE RESULTS FOR COCAINE. THE PACKAGE WEIGHTED APPROXIMATELY TWO GRAMS TOTAL PACKAGE WEIGHT. THE DEFENDANT WAS SEARCHED AND SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH POSSESSION OF A CONTROLLED SUBSTANCE WITH A BOND OF $2,000.00 PER THE BOND SCHEDULE. THE CRACK COCAINE WAS PACKAGED AND TURNED INTO EVIDENCE. THE DEFENDANT WAS ISSUED WRITTEN WARNING NUMBER 381375B FOR LIGHTS REQUIRED FOR BICYCLING AT NIGHT. THE DEFENDANT'S BICYCLE WAS LEFT ON SCENE PER HIS REQUEST. NO FURTHER ACTION BY THIS DEPUTY. |
