SUBMITTED BY: SEFFERN, JONATHAN 0623 (AR12-991) the defendant did KNOWINGLY SELL, PURCHASEd, MANUFACTUREd, DELIVERed OR BRought INTO THIS STATE OR KNOWINGLY was IN ACTUAL OR CONSTRUCTIVE POSSESSION OF FOURTEEN GRAMS OR MORE OF AMPHETAMINE, AS DESCRIBED ON STATUTE 893.03(2)C(2) OR METHAMPHETAMINE, AS DESCRIBED IN STATUTE 893.03(2)C(4), IN VIOLATION OF FLORIDA STATE STATUTE 893.135(1)(F) and the defendant DID UNLAWFULLY AGREE, CONSPIRE, COMBINE, OR CONFEDERATE WITH ANOTHER PERSON OR PERSONS TO COMMIT AN OFFENSE OF CRIMINAL CONSPIRACY, TO WIT: CONSPIREd TO MANUFACTURE or deliver METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.135(5) and the defendant DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: hydromorphone, alprazolam and hydrocodone IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(a) and the defendant DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, OBJECTs INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: methamphetamine, said objects being plastic baggies and a digital scale, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1) ON 050112 WHILE CONDUCTING A NARCOTICS INVESTIGATION IN THE AREA OF SOUTH GARDENIA TERRACE IN CRYSTAL RIVER, I OBSERVED A VEHICLE FAIL TO COME TO A COMPLETE STOP AT THE STOP SIGN LOCATED AT SOUTH GARDENIA TERRACE AND WEST OZELLO TRAIL IN CRYSTAL RIVER. AT THAT TIME, I INITIATED A TRAFFIC STOP, UTILIZING ALL EMERGENCY EQUIPMENT, ON THE OBSERVED VEHICLE. UPON MAKING CONTACT WITH THE DRIVER, IDENTIFIED AS DEFENDANT ONE, MS CHRISTINE WATERS, I REQUESTED HER DRIVERâS LICENSE, THE VEHICLE REGISTRATION AND PROOF OF VEHICLE INSURANCE. DEFENDANT WATERS WAS ONLY ABLE TO PROVIDE ME WITH THE VEHICLE REGISTRATION. WHILE SpEAKING WITH DEFENDANT WATERS, I OBSERVED DEFENDANT TWO, MR WILLIAM WOOD, TO BE SITTING IN THE FRONT PASSENGER SEAT AND DEFENDANT THREE, MS JENNIFER DOUGLAS, TO BE SITTING IN THE PASSENGER SIDE REAR SEAT. I AM FAMILIAR WITH ALL THREE DEFENDANTS BEING INVOLVED IN NARCOTICS ACTIVITY, AT WHICH TIME I ASKED DEFENDANT WATERS IF THERE WERE ANY ILLEGAL NARCOTICS INSIDE OF HER VEHICLE. DEFENDANT WATERS STATED THERE WERE NO ILLEGAL NARCOTICS INSIDE HER VEHICLE. HOWEVER, WHILE SPEAKING TO DEFENDANT WATERS, ALL THREE DEFENDANTS WERE DISPLAYING INDICATORS THAT GAVE SUSPICIOn THAT NARCOTICS WERE PRESENT INSIDE THE VEHICLE. OF THE THREE DEFENDANTS WOULD LOOK AT ME WHEN SPEAKING TO ME AND THEY WERE VISIBLY SHAKING. CANiNE DEPUTY RITLI, who was ON SCENE, was requested to DEPLOY CANINE AJAX TO CONDUCT AN EXTERIOR SNIFF ON THE VEHICLE. CANINE DEPUTY RITLI DEPLOYED CANINE AJAX, BEGINNING AT THE CENTER OF THE REAR BUMPER AND PROCEEDING IN A COUNTER CLOCKWISE ROTATION. CANINE AJAX ALERTED AT THE REAR OF THE VEHICLE, ON THE PASSENGER SIDE OF THE VEHICLE AND THE DRIVER SIDE OF THE VEHICLE. AT THAT TIME, CANINE DEPUTY RITLI RE-SeCURED CANINE AJAX IN HIS PATROL VEHICLE. I THEN REQUESTED THAT ALL THREE DEFENDANTS EXIT THE VEHICLE AND A SEARCH OF THEIR PERSONS WAS CONDUCTED. NO NARCOTICS WERE LOCATED ON THEIR PERSONS. AT THAT TIME, CANINE DEPUTY RITLI AND I CONDUCTED A SEARCH OF THE VEHICLE. UPON SEARCHING THE VEHICLE, A HIDDEN COMPARTMENT WAS LOCATED BELOW THE GLOVE COMPARTMENT, INSIDE THE DASH BOARD. INSIDE OF THIS HIDDEN COMPARTMENT WAS A BLACK ZIPPER BAG THAT CONTAINED A DIGITAL SCALE and THREE SMALL PLASTIC BAGGIES CONTAINing A CRYSTAL-LIKE SUBSTANCE THAT I WAS ABLE TO IDENTIFY AS METHAMPHETAMINE THROUGH MY TRAINING AND EXPERIENCE. ALSO INSIDE OF THE BLACK ZIPPER BAG WAS A SMALL PLASTIC BAGGIE THAT CONTAINED FOUR ROUND WHITE HYDROMORPHONE FOUR MILLIGRAM PILLS, TWO ROUND PEACH IN COLOR ALPRAZOLAM .5 MILLIGRAM PILLS AND ONE ROUND GREEN IN COLOR OXYCODONE FIFTEEN MILLIGRAM PILL. the crystal-like substance was field tested and yielded a positive result for the presence of methamphetamine. THE NARCOTICS WERE LATER WEIGHED ON A CERTIFIED SCALE AND WEIGHED EIGHTEEN GRAMS. the pills which were located were identified by poison control. DURING THE SEARCH, I ALSO LOCATED A BLACK BOOK BAG THAT DEFENDANT WOOD CLAIMED OWNERSHIP OF. THE BOOK BAG CONTAINED A LARGE number OF PLASTIC BAGGIES THAT WERE THE SAME COLOR AND HAD THE SAME DESIGNS on them as the baggies THAT THE previously located NARCOTICS WERE CONTAINED IN. AS I REMOVED THE NARCOTICS FROM DEFENDANT WATERSâ VEHICLE AND PLACED THEM ON THE HOOD OF MY PATROL VEHICLE, DEFENDANT WATERS SPONTANEOUSLY STATED THAT THE NARCOTICS INSIDE HER VEHICLE BELONGED TO HER. ALL THREE DEFENDANTS WERE THEN READ THEIR MIRANDA WARNINGS FROM A PREPRINTED AGENCY CARD, TO WHICH ALL THREE DEFENDANTs STATED THEY UNDERSTOOD THEIR RIGHTS AND AGREED TO SPEAK WITH ME. I THEN INTERVIEWED EACH DEFENDANT SEPARATELY, BEGINNING WITH DEFENDANT WATERS. DEFENDANT WATERS STATED THAT SHE PURCHASED THE NARCOTICS DOWN SOUTH AND HAD USED THE NARCOTICS EARLIER IN THE EVENING. DEFENDANT WATERS STATED HER FINGERPRINTS WOULD BE ON ALL THREE BAGgieS WHICH CONTAINED THE METHAMPHETAMINE. SHE STATED WHEN SHE USED THE NARCOTIC EARLIER IN THE EVENING, SHE ATE IT, AS THAT WAS HER PREFERRED METHOD OF INGESTING THE NARCOTIC. I THEN INTERVIEWED DEFENDANT WOOD WHO STATED THAT HE HAD ALSO USED THE NARCOTIC EARLIER IN THE EVENING AND HAD POSSESSION OF ALL THREE BAGGIES CONTAINing THE METHAMPHETAMINE. HE STATED HE SMOKED THE METHAMPHETAMINE OUT OF A GLASS PIPE WHICH HE BELIEVED HAD BEEN LEFT AT DEFENDANT WATERSâ RESIDENCE. DEFENDANT WOOD STATED THAT HIS FINGERPRINTS WOULD BE ON ALL THREE BAGGIES CONTAINing THE METHAMPHETAMINE, AS HE HAD REMOVED THE METHAMPHETAMINE FROM EACH INDIVIDUAL BAGGIE. I THEN made CONTACT WITH DEFENDANT DOUGLAS WHO ALSo STATED THAT SHE HAD USED THE NaRCOTIC EARLIER IN THE EVENING. SHE STATED SHE ALSO SMOKED THE METHAMPHETAMINE OUT OF A GLASS PIPE THAT SHE AND DEFENDANT WOOD SHARED. SHE STATED SHE HAD POSSESSION OF ALL THREE BAGGIES CONTAINing THE METHAMPHETAMINE, AS SHE HAD USED THE NARCOTIC FROM ALL THREE BAGGIES. AT THAT TIME, WITH ADMISSIONS FROM ALL THREE DEFENDANTS, THEY WERE PLACED UNDER ARREST and HANDCUFFED (DOUBLE LOCKED) behind their backs. deputy ferguson arrived on scene and transported defendant waters and defendant douglas to the citrus county detention facility for further processing. prior to leaving the scene, defendant watersâ was advised that her vehicle was being seized under the violation of florida contraband act. forfeiture paperwork was completed and later signed by defendant waters at the detention facility. detective blair responded to the scene and drove defendant watersâ vehicle to the sheriffâs office impound yard where it was later secured. the narcotics collected were packaged and later turned in to evidence. i then transported defendant wood to the detention facility for further processing. upon arrival at the detention facility, all three defendants were each charged with one count of trafficking in methamphetamine, one count of conspiracy to traffic in methamphetamine, three counts of possession of controlled substances and one count of possession of drug paraphernalia. each of the three defendantsâ total bond was set at $75,500.00 individually, in accordance with the bond schedule. defendant waters was issued florida uniform traffic citation number 7184-gqf7, possession of A CONTROLLED SUBSTANCE while in physical control of a motor vehicle. she was also issued florida uniform traffic citation number 7185-gqf8, for violation of a traffic control device, failure to come to a complete stop at a stop sign, and florida uniform traffic citation number 7186-gqf9, for failure to exhibit driverâs license on demand. |
