SUBMITTED BY: SCHAFFER, HEATH 0652 (AR14-9355) DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: A CLONAZEPAM TWO MILLIGRAM TABLET, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID, KNOWING her DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 030414 AT APPROXIMATELY 2000 HOURS, I BEGAN FOLLOWING A 2008 BLACK CADILLAC, BEARING FLORIDA LICENSE PLATE 425PIJ, WHICH WAS HEADED NORTH ON HIGHWAY 19 NEAR THE INTERSECTION OF GROVER CLEVELAND BOULEVARD UTILIZING AN UNMARKED AGENCY VEHICLE. I THEN OBSERVED THE REGISTERED DECAL ON THE LICENSE PLATE WAS EXPIRED. AT THAT TIME, I CONTACTED DISPATCH, PROVIDED THEM THE LICENSE PLATE NUMBER AND REQUESTED THE REGISTRATION INFORMATION. WHILE WAITING FOR THE RETURN INFORMATION, THE VEHICLE HAD TURNED EAST ON TO GROVER CLEVELAND BOULEVARD AND BEGAN TO ACCELERATE. I THEN BEGAN TO PACE SAID VEHICLE AND REACHED A SPEED OF 54 MILES PER HOUR (MPH) IN A 40 MPH ZONE. DURING THIS TIME, DISPATCH ADVISED THE REGISTRATION OF THE VEHICLE HAD BEEN EXPIRED SINCE 021614. THE VEHICLE THEN TURNED NORTH ON TO MISSOURI AVENUE AT WHICH TIME I ACTIVATED MY LIGHTS AND SIRENS AND CONDUCTED A TRAFFIC STOP ON THE VEHICLE. THE VEHICLE THEN PULLED OVER TO THE SHOULDER OF THE ROAD AT WHICH TIME I APPROACHED THE DRIVER ON THE DRIVER SIDE AND REQUESTED HER DRIVER'S LICENSE AND INSURANCE INFORMATION. THE DRIVER/ DEFENDANT, MS CHRISTINE WATERS, THEN BEGAN TO CRY AS SHE STATED SHE DOES NOT HAVE A DRIVER'S LICENSE BECAUSE IT WAS SUSPENDED. I THEN OBTAINED HER INFORMATION AND RAN IT THROUGH TELETYPE WHO ADVISED THAT IN FACT THE DEFENDANTâS DRIVER'S LICENSE WAS SUSPENDED FOR FAILURE TO PAY FINES AND THAT SHE DID receive NOTICE BY COURT ORDER OF THE SUSPENSION. AT THAT TIME, I MADE CONTACT WITH THE PASSENGER, MS AMBER WATERS, AND REQUESTED HER INFORMATION. HER INFORMATION WAS ALSO RUN THROUGH TELETYPE AND IT WAS ADVISED THAT SHE ALSO DID NOT HOLD A VALID DRIVER'S LICENSE. AT THAT TIME, DEPUTY RITLI ARRIVED ON SCENE AND DEPLOYED K-9 AJAX TO CONDUCT A FREE AIR SNIFF AROUND THE VEHICLE. I WAS THEN ADVISED BY DEPUTY RITLI THAT THE K-9 ALERTED. SEE K-9 SUPPLEMENT FOR FURTHER. AT THAT TIME, I REQUESTED THE OCCUPANTS OF THE VEHICLE TO EXIT AT WHICH TIME THEY WERE PATTED DOWN FOR WEAPONS. DEPUTY VIGGIANO THEN ARRIVED ON SCENE aND ASSISTED IN THE SEARCH OF THE VEHICLE WHILE I STOOD BY WITH THE OCCUPANTS. I WAS ADVISED SHORTLY AFTER THE START OF THE SEARCH THAT DEPUTY VIGGIANO HAD FOUND A WHITE CIRCULAR TABLET WITH IMPRINT NUMBER 2532 ON ONE SIDE AND THE OTHER SIDE WAS UNREADABLE DUE TO A CHIP OF THE TABLET BEING BROKEN OFF. DEPUTY VIGGIANO ADVISED THAT HE FOUND THE TABLET IN PLAIN VIEW NEAR THE GEAR SHIFT LEVER. AS DEPUTY VIGGIANO ADVISED ME OF WHAT HE FOUND, BOTH OCCUPANTS OF THE VEHICLE BEGAN TO DENY KNOWING ANYTHING ABOUT THE TABLET. I THEN CONTACTED POISON CONTROL, PROVIDED TABLET INFORMATION AND THEY ADVISED THE TABLET WAS CLONAZEPAM TWO MILLIGRAMS AND WAS A SCHEDULE THREE NARCOTIC. THE DEFENDANT WAS THEN PLACED UNDER ARREST FOR POSSESSION OF A CONTROLLED SUBSTANCE AND DRIVING WHILE LICENSE SUSPENDED. SHE WAS HANDCUFFED, (DOUBLE LOCKED), BEHIND HER BACK, SECURED IN THE REAR OF DEPUTY CORBINâS PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $5,500.00, PER THE BOND SCHEDULE A VEHICLE STORAGE RECEIPT WAS COMPLETED ON SCENE AND THE VEHICLE TOWED BY DAVEâS BODY SHOP. A CRIMINAL CITATION WAS PROVIDED TO THE DEFENDANT WHERE SHE WAS GIVEN A COURT DATE OF 032714 AT 1300 HOURS. |
