SUBMITTED BY: HRYC, CHRISTOPHER 0701 (AR11121713) did unlawfully and knowingly obtain, use or endeavor to obtain or use the property of THE VICTIM, MS ANITA BARDA,to wit: A 1994 RED JEEP GRAND CHEROKEE, by exercising control over said property with the intent to either temporarily or permanently deprive THE VICTIM of a right to the property or a benefit thereof, or did appropriate the property to HIS own use or the use of any person not entitled thereto, and knew or should have known that said property was stolen, in violation of Florida STATE Statute 812.014(2)(c)(6). Any person who knowingly gives false verification of ownership or who gives a false or altered identification and who receives money or other consideration from a secondary metals recycler, in return for regulated metals, AND THE value of the money or other consideration received is less than $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 538.23(3)(A). did unlawfully traffic in or endeavor to traffic in property that HE knew or should have known was stolen, to wit: A 1994 RED JEEP CHEROKEE, the property of MS ANITA BARDA, in violation of Florida STATE Statute 812.019(1). DID THEN AND THERE UNLAWFULLY AND KNOWINGLY UTTER AND PUBLISH AS TRUE CERTAIN FALSE, ALTERED OR FORGED WRITTEN ORDERS FOR MONEY, TO INTER COUNTY RECYCLING, TO WIT: THE TITLE TO A 1994 RED JEEP CHEROKEE, KNOWING FULL WELL THAT SAID WRITTEN ORDERS FOR MONEY WERE FALSE, ALTERED OR FORGED, SAID CHECKS BEING PASSED WITH THE INTENT THEN AND THERE TO INJURE AND DEFRAUD THE VICTIM, AND DIVERSE OTHER PERSONS TO THE STATE ATTORNEY UNKNOWN, IN VIOLATION OF FLORIDA STATE STATUTE 831.02. On 062411, the Victim, MS Anita Bard reported her 1994 Red Jeep Grand Cherokee as stolen. Deputy Alexander, who took the original report, stated that the vehicle was taken from 5015 SOUTH Sandspur POINt in Homosassa between the dates of 092710 and late February OF 2011. Ms Bard also stated that her son, Suspect/Defendant MR Christopher Andrew, was living with her at one point but had kicked him out due to the fact OF the people he was hanging out with. Ms Bard also stated that there was a physical altercation between her husband and Christopher and that at that time Christopher had admitted to taking the vehicle and scrapping it. Deputy Alexander's report further stated that the victim advised that she had not given anyone permission to remove the vehicle. On 062811, DetectIVE Serocki (ID 0322) made contact with Ms Bard by telephone. She advised that she had never given permission to her son to scrap the vehicle and that she wished to pursue charges against him. Detective Serocki then responded to Inter County Recycling due to the fact that it is the closest to the victim's residence, and that the place of business does scrap vehicles. The owner checked his records, and provided his receipt number 100651, dated 100810 which showed that MR Christopher Scott Andrew did scrap the 1994 Red Jeep Grand Cherokee (confirmed by checking the VEHICLE IDENTIFICATION NUMBER (VIN)), and did receive $238.80 for the transaction. Mr Andrew had also provided the scrap yard with the vehicles certificate of title (Number 84392736, state of Florida dated 110405) which had the victim's name signed as seller. Mr Andrew also provided his Florida driver's license and signed his name to the receipt. Detective Serocki took copies of the secondary metals recycler purchase transaction form, the recycler auto data direct inquiry report on the vehicle, and the title. The originals were later placed in to evidence, and a copy was sent to records. On 070111, Detective Serocki met with the victim, and she completed an affidavit of forgery (for the signed vehicle title), and an auto theft affidavit. On 071311, Detective Serocki sent this deputy an agency e-mail stating that he had probable cause for the arrest of the defendant Christopher Andrew for Grand Theft, Dealing in Stolen Property, uttering a forged instrument, and providing false verification of ownership to a second hand metals recycler. On 071311, I made contact with the defendant, MR Christopher Andrew, at his new residence located at 3489 Cherub COURt in Lecanto. Upon making contact with him, I advised him of his charges and read him Miranda warnings via pre-printed card. He advised he understood his rights and wished to speak with me. When asked about the red 1994 jeep Cherokee, he stated "Yeah I know what you're talking about, it used to be on my old property where I was living. My mom said I could scrap it." I asked where he scrapped it at and for how much, he replied, "I can't remember where it is, and I don't know how much I got." When I asked him about the title, he stated, "I don't know how the title was signed, it was signed when I got it. As far as I know, she signed it." He also stated that his mother was only doing this to get back at him because he had gotten into a fight with her husband AND That she was upset because her husband was arrested. He provided this deputy with a sworn written statement that said "While my mother was in Ohio I asked her what she was doing with her old broken down jeep and she had told me that this motor was blown so I asked her if she wanted me to scrap it to get it out of the yard. She had told me yes, then I askED her where the title was and she told me it was in the filing cabinet and I asked if it was signed. She told me I don't know, I then went and found it and told her that it was signed and she told me to go ahead and scrap it." The sworn written statement was turned in to records. The defendant was then placed under arrest for Grand Theft, Dealing in Stolen Property, uttering a forged instrument, and providing false verification of ownership to a second hand metals recycler. He was then handcuffed (double locked) behind his back and transported to the Citrus County Detention Facility for booking and processing. His bond was set at $10,000 per bond schedule. The defendant was also issued criminal UNIFORM traffic citation (UTC), number 4514-GQF-4, for Grand Theft involving a motor vehicle. THE UTC WAS ATTACHED TO THE ARREST AFFIDAVIT PAPERWORK.
