Probable cause affidavit: | SUBMITTED BY: STRICKLAND, DALE 276 (AR15-15166) ON 052615, AT APPROXIMATELY 1900 HOURS, I WAS IN THE AREA OF WEST YULEE DRIVE AND CHAMBERLIN POINT, WHEN I OBSERVED A BLACK CHEVROLET CRUZ APPROACH THE INTERSECTION AND DID NOT STOP EVEN BEHIND THE STOP BAR. THE VEHICLE PROCEEDED TO DRIVE TO WEST YULEE DRIVE. I FOLLOWED THE VEHICLE TO THE AREA OF WEST YULEE DRIVE AND WEST ANCHORAGE STREET, WHERE I ACTIVATED MY EMERGENCY LIGHTS AND SIGNALS AND PULLED THE VEHICLE OVER. I MADE CONTACT WITH THE DEFENDANT. I ASKED THE DEFENDANT FOR HIS REGISTRATION, DRIVER'S LICENSE, AND PROOF OF INSURANCE AND RETURNED TO MY PATROL VEHICLE. I BEGAN TO COMPLETE A WRITTEN TRAFFIC WARNING. K-9 DEPUTY DEARDEN (0363) AND HIS K-9 PARTNER TYSON ARRIVED ON SCENE. I APPROACHED THE DEFENDANT WHO WAS SITTING IN HIS DRIVER SEAT OF HIS VEHICLE. I ASKED HIM IF HE HAD ANY ILLEGAL SUBSTANCE IN THE VEHICLE, TO WHICH HE STATED NO. I ASKED IF HE MIND IF I SEARCH THE VEHICLE AND HE STATED HE WOULD RATHER I DID NOT. I ADVISED THE DEFENDANT THAT A K-9 SNIFF OF THE VEHICLE WOULD BE CONDUCTED AT THIS TIME. THE DEFENDANT APPEARED TO BE EXTREMELY NERVOUS AND AGITATED; IT WAS AT THAT TIME DEPUTY DEARDEN DEPLOYED HIS K-9 FOR AN EXTERIOR SNIFF OF THE VEHICLE. DEPUTY DEARDEN ADVISED ME THAT THE K-9 DID ALERT ON THE VEHICLE. IT WAS AT THAT TIME I ASKED THE DEFENDANT TO EXIT THE VEHICLE. AT FIRST THE DEFENDANT WOULD NOT COMPLY WITH ME ASKING HIM TO COME OUT OF THE VEHICLE, I ADVISED HIM AGAIN THAT THE K-9 HAD ALERTED ON HIS VEHICLE AND THAT HE SHOULD EXIT THE VEHICLE. THE DEFENDANT COMPLIED AND WALKED BACK TO MY PATROL VEHICLE. WHILE DEPUTY DEARDEN CONDUCTED A SEARCH OF THE DEFENDANTâS VEHICLE, I CONDUCTED A PAT DOWN OF THE DEFENDANT AND DISCOVERED IN HIS WALLET A PACK OF JUICY J ROLLING PAPERS. DEPUTY DEARDEN LOCATED A SMALL AMOUNT OF A GREEN LEAFY SUBSTANCE, WHICH IS KNOWN TO THIS DEPUTY BY HIS TRAINING AND EXPERIENCE TO BE MARIJUANA. I ASKED THE DEFENDANT WHY HE DID NOT ADVISE THAT HE HAD THE MARIJUANA IN HIS VEHICLE WHEN I ASKED HIM; HE STATED THAT HE DID NOT WANT TO GET INTO TROUBLE. THE DEFENDANT WAS GIVEN A NOTICE TO APPEAR CITATION, CITATION NUMBER 21004, AND A MANDATORY COURT DATE OF 060415, AT 1300 HOURS. THE DEFENDANT WAS RELEASED AT THE SCENE AFTER HE SIGNED AND RECEIVED HIS COPY OF THE NOTICE TO APPEAR. THIS DEPUTY SUBMITTED LESS THAN 20 GRAMS OF MARIJUANA AND THE JUICY J ROLLING PAPERS IN TO CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE. |
