SUBMITTED BY: KNIGHT, CHRISTOPHER 1302 (AR17-23048) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 031817 AT APPROXIMATELY 0624 HOURS, I WAS CONDUCTING STATIONARY PATROL NEAR THE INTERSECTION OF EAST GOBBLER DRIVE AND SOUTH OLD FLORAL CITY ROAD. I THEN OBSERVED A GOLD IN COLOR CHEVROLET TAHOE VEHICLE TRAVELING WESTBOUND ON EAST GOBBLER DRIVE WITH A BROKEN TAIL LIGHT EMITTING WHITE LIGHT. I OBSERVED SAID VEHICLE TURN RIGHT ONTO SOUTH FLORIDA AVENUE AND CONTINUE TRAVELING NORTHBOUND. WHILE ATTEMPTING TO CATCH UP TO THE VEHICLE, I OBSERVED IT TURN RIGHT ONTO SOUTH CASTEL LAKE AVENUE WITHOUT USING ANY TURN SIGNAL. I THEN OBSERVED THE VEHICLE CONTINUE TRAVELING ON SOUTH CASTLE LAKE AVENUE AT A HIGH RATE OF SPEED. WHILE ATTEMPTING TO CATCH UP TO THE VEHICLE, IT TURNED RIGHT ONTO LAWLUS THEN RIGHT ONTO SOUTH KENNETH TERRACE. ONCE ON SOUTH KENNETH TERRACE, I WAS ABLE TO CATCH UP TO THE VEHICLE AT THE INTERSECTION OF SOUTH KENNETH AND EAST MOLLY LANE. I OBSERVED THE VEHICLE TURN RIGHT AND FAIL TO STOP AT THE STOP SIGN AT THE ABOVE INTERSECTION. AT THAT TIME, I ACTIVATED MY OVERHEARD LIGHTS AND SIRENS AND CONDUCTED A TRAFFIC STOP ON SAID VEHICLE BEARING FLORIDA LICENSE PLATE, Y49TRJ. I EXITED MY PATROL VEHICLE TO MAKE CONTACT WITH THE DRIVER OF THE VEHICLE, LATER IDENTIFIED AS THE DEFENDANT, MR CHRISTOPHER COLLAZO, JR. UPON MAKING CONTACT, I IDENTIFIED MYSELF AS A CITRUS COUNTY SHERIFFâS OFFICE DEPUTY AND INFORMED THE DEFENDANT AS TO WHY HE WAS STOPPED. BEFORE I COULD ASK THE DEFENDANT FOR HIS DRIVERâS LICENSE, PROOF OF INSURANCE AND IDENTIFICATION, THE DEFENDANT HANDED ME HIS FLORIDA IDENTIFICATION CARD. HE THEN SPONTANEOUSLY STATED, ââSHOULD I STEP OUT THE VEHICLE NOW?ââ I ASKED THE DEFENDANT IF HE HAD A VALID DRIVERâS LICENSE, TO WHICH HE STATED NO. I THEN ASKED THE DEFENDANT WHY HE WAS TRAVELING THROUGH A RESIDENTIAL NEIGHBORHOOD AT A HIGH RATE OF SPEED, TO WHICH HE STATED HE WAS LOST. WHILE SPEAKING WITH THE DEFENDANT, I OBSERVED THREE (3) OTHER PASSENGERS/OCCUPANTS INSIDE THE VEHICLE. AFTER OBTAINING THE NECESSARY INFORMATION FROM ALL OF THE OCCUPANTS INSIDE THE VEHICLE, I RETURNED TO MY PATROL VEHICLE TO RUN THE DEFENDANTâS INFORMATION. AFTER RUNNING THE DEFENDANTâS INFORMATION THROUGH THE ââDAVIDââ PROGRAM, IT INDICATED THAT HIS DRIVERâS LICENSE HAD BEEN SUSPENDED SINCE 030713. I THEN RAN THE DEFENDANTâS INFORMATION THROUGH THE TELETYPE DIVISION, AND WAS INFORMED THAT THE DEFENDANTâS DRIVERâS LICENSE HAD BEEN SUSPENDED SINCE 030713, WITH THE MOST RECENT AND DEFINITE SUSPENSION OCCURRING ON 041816 FOR FAILURE TO PAY CHILD SUPPORT. I EXITED MY PATROL VEHICLE AND AGAIN MADE CONTACT WITH THE DEFENDANT, AT WHICH TIME I INSTRUCTED HIM TO EXIT THE VEHICLE. THE DEFENDANT DID COMPLY WITH MY DIRECTIVE, AT WHICH TIME HE WAS PLACED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS THEN READ HIS MIRANDA WARNINGS VIA PRE-PRINTED AGENCY CARD AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. I THEN MADE CONTACT WITH THE OWNER OF THE VEHICLE, WHO WAS SITTING IN THE REAR PASSENGER SEAT. HE ADVISED THAT HE WOULD HAVE A LICENSED DRIVER REMOVE THE VEHICLE FROM THE ROADWAY. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT WAS TURNED OVER TO DETENTION STAFF. THE DEFENDANTâS BOND WAS SET AT $500.00, PER THE BOND SCHEDULE FOR THE LISTED CHARGE. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION, A21EMGP, FOR DRIVING WHILE LICENSE SUSPENDED/REVOKED (WITH KNOWLEDGE). THE DEFENDANT WAS ALSO ISSUED A WRITTEN WARNING, 415033B, FOR FAILURE TO STOP AT THE STOP SIGN AT THE INTERSECTION OF SOUTH KENNETH AND EAST MOLLY LANE. |
