Probable cause affidavit: |
SUBMITTED BY: GREATREX, ROBERT 0287 (AR11121282) did unlawfully enter or remain in a certain conveyance, to-wit: A FOUR DOOR TOYOTA, 1999, WHITE IN COLOR, VEHICLE TAG NUMBER Q328RZ, the property of THE VICTIM, without said person's consent, with the intent to commit an offense therein, to-wit: GRAND THEFT, and the said conveyance was not open to the public at the time, AND THE DEFENDANT was not licensed or invited to enter or remain in said conveyance, in violation of Florida Statute 810.02; (AND) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: A PURSE, WALLET, MONEY, A CHECKBOOK, CREDIT CARDS, OXYCODONE, AND TEMAZAPAM, OF A VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: $333.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014. ON 061611, AT APPROXIMATELY 0330 HOURS, I WAS NOTIFIED THAT A TRAFFIC STOP WAS CONDUCTED BY DEPUTY MOORE AT THE INVERNESS RACE TRAC GAS STATION IN CITRUS COUNTY. DEPUTY MOORE STATED THAT AFTER CONDUCTING THE TRAFFIC STOP, HE HAD A CANINE ALERT ON THE VEHICLE, WHICH GAVE HIM CONSENT TO SEARCH THE VEHICLE. DEPUTY MOORE STATED WHILE CONDUCTING THE SEARCH OF THE DEFENDANT'S VEHICLE, A RED IN COLOR FOUR DOOR HONDA BEARING TENNESSEE LICENSE PLATE NUMBER 801YDEK, HE DID FIND PROPERTY WHICH IS RELATED TO THIS CASE NUMBER. THE VICTIM'S PROPERTY CONSISTED OF A PURSE, WALLET, MONEY, A CHECKBOOK, CREDIT CARDS, OXYCODONE, AND TEMAZAPAM WHICH HAD A VALUE OF APPROXIMATELY $333.00. DEPUTY MOORE STATED THAT DUE TO FINDING THIS PROPERTY IN THE SUSPECT'S VEHICLE, HE NOTIFIED THIS DETECTIVE TO RESPOND DUE A LARGE AMOUNT OF BURGLARIES WHICH HAVE TAKEN PLACE IN THE INVERNESS AREA. AT THAT TIME I DID RESPOND TO THE TRAFFIC STOP AT THE RACE TRAC GAS STATION IN INVERNESS AND UPON ARRIVING, DEPUTY MOORE, ALONG WITH CANINE DEPUTY PRICE EXPLAINED THEIR PROBABLE CAUSE FOR THE STOP, ALONG WITH THE STOLEN PROPERTY WHICH WAS LOCATED IN THE TRUNK OF THE VEHICLE. AT THAT TIME I MADE CONTACT with THE DRIVER OF THE VEHICLE, WHO IS THE SUSPECT, MR CHRISTOPHER BRADY HANNETT. I ADVISED SUSPECT HANNETT THAT I WAS A PROPERTY CRIMES DETECTIVE FOR THE CITRUS COUNTY SHERIFF'S OFFICE AND WANTED TO SPEAK WITH HIM IN REFERENCE TO SEVERAL ITEMS WITHIN HIS VEHICLE. SUSPECT HANNETT STATED THE VEHICLE IS REGISTERED TO HIS MOTHER, BUT HE DOES USE THE VEHICLE BECAUSE SHE DRIVES A PICKUP TRUCK AND ALLOWS HIM TO USE IT. AT THAT TIME I ADVISED SUSPECT HANNETT THAT I WAS INVESTIGATING SEVERAL BURGLARIES WHICH HAD TAKEN PLACE IN THE INVERNESS AREA, AND DUE TO THE PROPERTY LOCATED IN HIS VEHICLE BY DEPUTY MOORE AND CANINE DEPUTY PRICE, I WANTED TO SPEAK WITH HIM ABOUT IT. AT THAT TIME I DID READ MIRANDA WARNINGS TO SUSPECT HANNETT. SUSPECT HANNETT STATED HE WOULD SPEAK WITH ME. SUSPECT HANNETT STATED THE PROPERTY IN THE VEHICLE IS NOT HIS AND THAT HE HAD NOT DONE ANY BURGLARIES. HE STATED THE PASSENGER IN THE VEHICLE, MR JUSTIN LOPEZ, DOES LIVE NEXT DOOR TO HIM IN THEIR APARTMENT COMPLEX AND HE WAS GIVING HIM A RIDE TO THE STORE WHEN THEY GOT STOPPED. AT THAT TIME I ATTEMPTED TO FURTHER QUESTION SUSPECT HANNETT REGARDING THE PROPERTY LOCATED IN HIS VEHICLE, WHICH BELONGS TO THE VICTIM IN THIS CASE. SUSPECT HANNETT WAS UNABLE TO EXPLAIN WHY THE PROPERTY WAS IN HIS TRUNK AND AT THAT TIME REQUESTED TO SPEAK WITH A LAWYER AND NOT TO MOVE FORWARD WITH ANY MORE QUESTIONING. AT THAT TIME I ADVISED THE DEFENDANT HE WAS BEING PLACED UNDER ARREST FOR ONE COUNT OF BURGLARY AND ONE COUNT OF GRAND THEFT. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND PLACED IN THE REAR SEAT OF DEPUTY WILLIAM'S PATROL VEHICLE, WHERE HE WAS LATER TAKEN TO THE CITRUS COUNTY DETENTION FACILITY AND BOOKED IN. THE DEFENDANT'S BOND WAS SET AT $5,000.00 FOR BURGLARY TO A CONVEYANCE AND $2,000.00 FOR GRAND THEFT. THE DEFENDANT'S VEHICLE WAS TOWED AND WILL BE HELD AT CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE ROOM, WHERE A SEARCH WARRANT WILL BE WRITTEN TO GAIN ACCESS TO THE VEHICLE FOR PROCESSING, DUE TO THE LARGE AMOUNT OF POSSIBLY STOLEN PROPERTY WITHIN THE VEHICLE AND THE LARGE NUMBER OF BURGLARIES WHICH HAVE TAKEN PLACE IN THE INVERNESS AREA. THE PASSENGER OF THE VEHICLE, MR JUSTIN LOPEZ, WAS QUESTIONED AND RELEASED AT THE SCENE. *NOT-EXEMPT* |
