SUBMITTED BY: COX, ANDY 0543 (AR08102431) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: METHAMPHETAMINE COMMONLY REFERRED TO AS"METH", IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: TWO CLEAR GLASS PIPES AND A HOMEMADE PIPE SAID OBJECT BEING A "MARIJUANA PIPE", IN VIOLATION OF FLORIDA STATE STATUTES 893.147(1)(B). ON 032908, AT APPROXIMATELY 0029, HOURS I OBSERVED A GOLD TWO DOOR CHEVROLET DISPLAYING FLORIDA TAG NUMBER 147KTD HEADING NORTH BOUND ON OLD FLORAL CITY ROAD. THE VEHICLE APPROACHED the CURVE NEAR SANDPIPER WHICH IS A POSTED 25 MILE PER HOUR ZONE AT 35 MILES PER HOUR. THE VEHICLE CONTINUED NORTH BOND SOUNDING AS THOUGH IT HAD A LOUD MUFFLER IT WAS AT THAT TIME, INITIATED A TRAFFIC STOP AT THE CORNER OF EDEN AND HIGHWAY 41. K9 OFFICER TACKETT ARRIVED ON SCENE AS the VEHICLE PULLED INTO THE KANGAROO PARKING LOT AT the CORNER OF EDEN AND HIGHWAY 41. I THEN MADE CONTACT WITH the DRIVER LATER IDENTIFIED THROUGH A RECORDS CHECK. THE DRIVER ADVISED HE LEFT HIS DRIVERS LICENSE AT HOME. I THEN RAN A RECORDS CHECK ON the DRIVER AND PASSENGER K9 DEPUTY TACKETT ASKED the DRIVER AND PASSENGER IF THERE WERE ANY ILLEGAL DRUGS IN the VEHICLE IN WHICH BOTH OCCUPANTS REPLIED "NO.” DEPUTY TACKETT THEN HAD K9 PRIEST WALK AROUND the VEHICLE AND K9 PRIEST ALERTED TO the VEHICLE. IT WAS AT THAT TIME, WE THEN ASKED the OCCUPANTS TO STEP OUT OF THE VEHICLE AND A SEARCH OF the OCCUPANTS REVEALED THAT MS DEANNA SWINT WAS IN POSSESSION OF TWELVE HYDROCODONE PILLS WHICH WERE LATER POSITIVELY IDENTIFIED BY IMPRINT AND NUMBER BY POISON CONTROL. the DRIVER, MR CHRISTOPHER MOUNT, WAS IN POSSESSION OF WHAT HE ADMITTED TO BEING, CANNABIS, METHAMPHETAMINE, TWO GLASS METHAMPHETAMINE PIPES, AND ONE HOME MADE PIPE CONSISTING OF AN AIR CHUCK FITTING IN BLACK FUEL LINE WHICH WAS USED FOR SMOKING CANNABIS AND HAD the ODOR OF CANNABIS ON THE HOMEMADE PIPE. BOTH DEFENDANTS WERE PLACED UNDER ARREST, HANDCUFFED, (DOUBLE LOCKED) BEHIND their BACK. I THEN TRANSPORTED DEFENDANT SWINT AND DEPUTY MENDIGUITA TRANSPORTED DEFENDANT MOUNT TO the CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. *NOT-EXEMPT* |
