SUBMITTED BY: CONLEY, STEPHEN 0290 (AR08104683) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN DWELLING OR CURTILAGE THEREOF, LOCATED IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM, AS OWNER OR CUSTODIAN THEREOF, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO WIT: GRAND THEFT, IN VIOLATION OF FLORIDA STATE STATUTES 810.02(1) AND 810.02(3). DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: MULTIPLE ITEMS INCLUDING ELECTRONICS, JEWELRY, DVD'S, MONEY, FOOD (DETAILED LIST IN REPORT) OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS,: WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)C(1) did unlawfully traffic in or endeavor to traffic in property that HE knew or should have known was stolen, to-wit: VARIOUS ITEMS LISTED IN THE REPORT 08080365, the property of THE VICTIM, in violation of Florida Statute 812.019(1); DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, MARIJUANA, TO WIT A SMALL METAL PIPE WITH RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 081008 THE VICTIM REPORTED A BURGLARY AND GRAND THEFT AT 4575 SOUTH EVERGREEN AVENUE. THE VICTIM LISTED NUMEROUS ITEMS STOLEN FROM HIS RESIDENCE INCLUDING DVD'S, VIDEO GAME SYSTEMS, COMPUTER HARDWARE, LAPTOP COMPUTER, JEWELRY, MONEY AND SEVERAL OTHER ITEMS OF VALUE, AS BEING STOLEN. ON 081208 DEPUTY PERUCHE MADE CONTACT WITH A WITNESS. THE WITNESS SPOKE WITH DEPUTY PERUCHE AND ADVISED THAT THE DEFENDANT ASKED THE WITNESS TO STORE SEVERAL ITEMS AT HER HOME AND LATER REQUESTED HER TO PAWN MULTIPLE ITEMS FOR HIM. THE WITNESS STATED SHE PAWNED ITEMS AT THE AMERICAN TRADING POST PAWN SHOP, THE GETTING' PLACE AND HUNTERS HIDEOUT. THE WITNESS STATED SHE DID NOT KNOW THE ITEMS WERE STOLEN AND PAWNED THEM FOR THE DEFENDANT BECAUSE HE DID NOT HAVE IDENTIFICATION. THE VICTIM ALSO RESPONDED TO THE WITNESS'S HOME WHERE SHE TURNED OVER NUMEROUS OTHER ITEM THAT ARE LISTED AS STOLEN. THE WITNESS ALSO ADVISED THAT THE DEFENDANT SOLD A LAPTOP COMPUTER AND A VIDEO GAME SYSTEM TO ANOTHER WITNESS. DEPUTY PERUCHE RESPONDED TO THAT WITNESS'S HOME AND MADE CONTACT WITH HIM, AS DID THE VICTIM. THE WITNESS ADVISED THAT THE DEFENDANT DID SELL HIM A LAPTOP COMPUTER AND VIDEO GAME SYSTEM, AND THE VICTIM POSITIVELY IDENTIFIED THOSE ITEMS AS HIS. ON 081308 I RECEIVED INFORMATION THAT THE DEFENDANT COULD BE LOCATED AT 4505 SOUTH EVERGREEN AVENUE, AT WHICH TIME I RESPONDED. I HAD ALSO SPOKEN TO THE DEFENDANT'S PROBATION OFFICER, MR JAMES GUTCH, WHO ADVISED THAT THE DEFENDANT WAS IN VIOLATION OF HIS PROBATION AND A WARRANT WAS FORTHCOMING. UPON MY ARRIVAL AT 4505 SOUTH EVERGREEN AVENUE, I MADE CONTACT WITH THE DEFENDANT AND IDENTIFIED HIM AS MR CHRISTOPHER SCHLOER. BASED ON THE STATEMENTS FROM THE WITNESSES STATING THAT THE DEFENDANT BROUGHT STOLEN ITEMS FROM THE VICTIM'S RESIDENCE TO THEM AND EITHER SOLD OR ASKED THEM TO PAWN ITEMS FOR HIM, HE WAS ARRESTED FOR THE CHARGE OF BURGLARY, GRAND THEFT, AND DEALING IN STOLEN PROPERTY. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL THE DEFENDANT STATED HE WISHED TO SPEAK WITH ME ABOUT THE CASE. I READ THE DEFENDANT MIRANDA VIA PREPRINTED CARD. AT THAT TIME THE DEFENDANT STATED TO ME THAT HE DID BREAK INTO THE VICTIM'S RESIDENCE, STOLE MULTIPLE ITEMS, AND EITHER SOLD OR HAD THEM PAWNED BY OTHER PEOPLE. THE DEFENDANT COMPLETED AND SIGNED A WRITTEN STATEMENT GIVING HIS CONFESSION. IT SHOULD BE NOTED WHEN THE DEFENDANT WAS ARRESTED, A SEARCH INCIDENT TO ARREST WAS CONDUCTED OF HIS PERSON, AND DURING THIS SEARCH, A SMALL METAL PIPE WITH BURNT MARIJUANA RESIDUE WAS LOCATED IN HIS FRONT LEFT POCKET. THIS CONTRABAND WAS LATER PACKAGED AND TURNED OVER TO SHERIFF'S OFFICE EVIDENCE. THE DEFENDANT'S TOTAL BOND WAS SET AT $25,500.00. *NOT-EXEMPT* |
