Probable cause affidavit: | SUBMITTED BY: HUNTER, JEFFERY 0441 (AR12-1443) THE DEFENDANT DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: PUNCHED THE VICTIM IN THE NOSE, CAUSING PROFUSE BLEEDING FROM THE NOSE, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1) ON 060212 AT APPROXIMATELY 2035 HOURS, I WAS DISPATCHED TO 66 NORTH WEST AVENUE IN INVERNESS IN REFERENCE TO A BATTERY THAT HAD JUST OCCURRED. UPON ARRIVAL, I MADE CONTACT WITH THE VICTIM, MR KEVIN THOMPSON, WHO WAS STANDING IN HIS DRIVEWAY, BLEEDING PROFUSELY FROM HIS NOSE. HE ADVISED THAT A WHITE MALE SUBJECT BY THE NAME OF CHRIS SMITH HAD BEEN A PASSENGER IN A WHITE FORD RANGER PICKUP TRUCK THAT HAD FOLLOWED HIM HOME FROM THE AREA OF WEST NORVELL BRYANT HIGHWAY AND NORTH CROFT AVENUE. VICTIM THOMPSON ADVISED THAT AS HE EXITED HIS VEHICLE, IN HIS DRIVEWAY, MR SMITH RAN UP TO HIM AND PUNCHED HIM. VICTIM THOMPSON ADVISED THERE WAS A BRIEF STRUGGLE and HE RETREATED INSIDE HIS RESIDENCE. VICTIM THOMPSON ADVISED THAT WHEN HE CAME BACK OUTSIDE, A SHORT TIME LATER, MR SMITH WAS STANDING NEXT TO THE WHITE FORD RANGER PICKUP TRUCK AND DISPLAYED A FIREARM OF SOME SHORT BUT WAS UNABLE TO PROVIDE ANY OTHER DETAILS. VICTIM THOMPSON ADVISED THAT MR SMITH THEN GOT BACK IN THE WHITE FORD RANGER PICKUP TRUCK WITH A WHITE FEMALE DRIVER AND FLED THE AREA. HE STATED THE VEHICLE WAS LAST SEEN TRAVELING NORTH ON NORTH WEST AVENUE IN INVERNESS. THE WITNESS, MS AMANDA MICHAELSON, CONFIRMED VICTIM THOMPSONâS STATEMENT WITH THE EXCEPTION THAT SHE HAD NOT SEEN THE FIREARM. WITNESS MICHAELSON ADDITIONALLY STATED THERE HAD BEEN A BRIEF STRUGGLE BETWEEN HER AND THE WHITE FEMALE DRIVER OF THE WHITE FORD RANGER PICKUP TRUCK. EMERGENCY MEDICAL SERVICES (EMS) RESPONDED TO THE SCENE AND TREATED VICTIM THOMPSON FOR HIS INJURIES. VICTIM THOMPSON WAS NOT TRANSPORTED TO THE HOSPITAL. BOTH VICTIM THOMPSON AND WITNESS MICHAELSON PROVIDED SWORN WRITTEN STATEMENTS WHICH WERE LATER TURNED IN TO RECORDS. A FRIEND OF VICTIM THOMPSONâS WAS ABLE TO ADVISE THE RESIDENCE WHERE MR SMITH WAS BELIEVED TO be STAYING. I RESPONDED TO 2550 EAST MARS STREET IN INVERNESS AND OBSERVED THE WHITE FORD RANGER PICKUP TRUCK PARKED IN THE DRIVEWAY. I KNOCKED ON THE FRONT DOOR AND WAS APPROACHED BY A WHITE FEMALE SUBJECT FROM THE NEIGHBORING RESIDENCE. SHE ADVISED THAT CHRIS WAS HOME AND ASKED WHY I WAS THERE. SHE WAS ADVISED THAT I NEEDED TO SPEAK TO MR SMITH AND THAT I WOULD TELL HIM THE REASON FOR MY PRESENCE. THE WHITE FEMALE WENT IN THE BACKYARD OF THE HOME AND RETURNED A SHORT TIME LATER WITH MR SMITH. MR SMITH WAS HOLDING A CAN OF BEER. HE WAS SLURRING HIS SPEECH AND APPEARED TO BE INTOXICATED. MR SMITH ADVISED THAT HE HAD BEEN IN THE VEHICLE AND THAT THEY HAD FOLLOWED VICTIM THOMPSON TO HIS HOME. MR SMITH ADVISED THAT WHEN VICTIM THOMPSON EXITED HIS VEHICLE, IN HIS DRIVEWAY, VICTIM THOMPSON BEGAN AN ALTERCATION SO HE/MR SMITH MERELY DEFENDED HIMSELF. MR SMITH COULD NOT EXPLAIN WHY HE HAD THEN FLED THE AREA OR WHY HE HAD NOT CONTACTED LAW ENFORCEMENT. MR SMITH HAD NO VISIBLE MARKS ON HIM. I PLACED MR SMITH UNDER ARREST FOR ONE COUNT OF SIMPLE BATTERY. HE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL, DEFENDANT SMITH WAS BOOKED AND HELD ON A $500.00 BOND, IN ACCORDANCE WITH THE BOND SCHEDULE. |
