Probable cause affidavit: SUBMITTED BY: STRICKLAND, JASON 0583 (AR11122419) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: THE DEFENDANT DID POKE AND PUNCH THE VICTIM IN HIS HEAD, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 082411, AT APPROXIMATELY 1730 HOURS I RESPONDED TO 5291 EAST LAMBERT LANE IN INVERNESS, IN REFERENCE TO A PHYSICAL DISTURBANCE IN PROGRESS. UPON MY ARRIVAL, I OBSERVED THE DEFENDANT, LATER IDENTIFIED AS MR CHRISTOPHER TURCO, TO BE IN THE DOORWAY OF A GRAY TRUCK. I OBSERVED THE COMPLAINANT/VICTIM, MR DANIEL TURCO, TO BE SITTING IN THE DRIVER'S SEAT. AT THAT TIME THE DEFENDANT WAS POINTING AT THE VICTIM IN AN ENRAGED STATE, WHERE I INTERVENED BETWEEN THE DEFENDANT AND THE VICTIM. THE DEFENDANT WAS STILL YELLING AT THE VICTIM WHERE HE WAS THEN DETAINED BY BEING PLACED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK, SEARCHED AND SECURED IN THE REAR OF MY PATROL VEHICLE. AFTER SECURING THE DEFENDANT IN THE REAR OF MY PATROL VEHICLE, I MADE CONTACT WITH THE COMPLAINANT/VICTIM, MR DANIEL TURCO. HE ADVISED THAT AT APPROXIMATELY1715 HOURS HE ARRIVED AT HIS SISTER'S RESIDENCE DUE TO her AIR CONDITIONER (A/C) NOT WORKING. WHILE HE WAS ON THE EAST SIDE OF THE RESIDENCE, THE DEFENDANT, CHRISTOPHER TURCO, CAME AROUND THE CORNER OF THE RESIDENCE AND GOT IN TO HIS FACE. THE VICTIM STATED THE DEFENDANT BEGAN YELLING AND SCREAMING AT HIM ABOUT THE VICTIM ACCUSING THE DEFENDANT OF STEALING THE A/C PARTS. AT THAT TIME THE VICTIM ATTEMPTED TO WALK AWAY BACK TO HIS VEHICLE WHERE THE DEFENDANT CONTINUED TO STEP IN FRONT OF HIM AND NOT ALLOW HIM TO PASS BY. AT THAT TIME THE VICTIM THEN PUSHED THE DEFENDANT OVER TO THE SIDE AND WALKED PAST HIM TO HIS VEHICLE WHERE HE SAT IN THE DRIVER'S SEAT. THE DEFENDANT AGAIN MADE CONTACT WITH THE VICTIM AND BEGAN POKING HIM IN HIS HEAD. AT ONE POINT IN TIME, THE VICTIM STATED THE DEFENDANT PUNCHED HIM ON THE SIDE OF HIS FACE, AT WHICH TIME THE DEFENDANT THEN STRUCK THE VICTIM'S CELLULAR TELEPHONE INSTEAD OF HIS FACE. THE VICTIM THEN ADVISED THAT THIS DEPUTY ARRIVED SHORTLY AFTER AND INTERVENED. AFTER SPEAKING WITH THE VICTIM, I SPOKE with WITNESS ONE, MS GERALYNN TURCO. HER STATEMENT CORROBORATED THE VICTIM'S STATEMENT. I THEN SPOKE TO WITNESS TWO, MR. ROBERT MICHAELSON. HE ADVISED THAT THE DEFENDANT, CHRISTOPHER TURCO, APPROACHED THE VICTIM IN REFERENCE TO ACCUSATIONS BEING MADE AGAINST HIM BY THE VICTIM. DURING THAT TIME A VERBAL ALTERCATION ENSUED WHERE THE VICTIM PUSHED ASIDE THE DEFENDANT AND THEN WALKED TO HIS TRUCK WHERE THE DEFENDANT FOLLOWED THE VICTIM TO HIS VEHICLE. AT THAT TIME THE VERBAL ALTERCATION CONTINUED WHERE THE DEFENDANT AT ONE POINT POKED THE VICTIM IN THE HEAD AND THEY CONTINUED THE VERBAL argument. HE ADVISED THAT THIS DEPUTY THEN ARRIVED AND INTERVENED. AFTER SPEAKING WITH WITNESS TWO I MADE CONTACT with the DEFENDANT, WHO WAS STILL SECURED IN THE REAR OF MY PATROL VEHICLE. AT THAT TIME I ATTEMPTED TO READ THE DEFENDANT HIS MIRANDA WARNINGS VIA PRE-PRINTED CARD. DURING that TIME, THE DEFENDANT INTERRUPTED ME MULTIPLE TIMES AND BEGAN TELLING ME HIS SIDE OF THE STORY. HE ADVISED THAT HE APPROACHED THE VICTIM ON THE SIDE OF THE RESIDENCE AND A VERBAL ALTERCATION ENSUED. HE STATED THE VICTIM THEN PUSHED HIM AND WALKED TOWARD HIS VEHICLE. THE DEFENDANT STATED HE THEN FOLLOWED THE VICTIM AND ONCE THE VICTIM ENTERED HIS VEHICLE, HE SAT DOWN IN THE DRIVER'S SEAT AND GRABBED A PAIR OF PLIERS WHICH HE HELD BY HIS SIDE. THE DEFENDANT THEN ADVISED WHILE THEY WERE ARGUING, THE DEFENDANT POKED THE VICTIM IN THE HEAD AND A SHORT WHILE LATER I ARRIVED ON SCENE AND DETAINED HIM. AT THAT TIME I ADVISED THE DEFENDANT HE WAS BEING PLACED UNDER ARREST FOR ONE COUNT OF SIMPLE BATTERY. HE WAS THEN TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL THE DEFENDANT WAS TURNED OVER TO DETENTION STAFF WHERE HIS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. WRITTEN STATEMENTS WERE OBTAINED FROM ALL INVOLVED PARTIES EXCEPT THE DEFENDANT. THE STATEMENTS WERE COLLECTED AND LATER SUBMITTED TO RECORDS. THERE WERE NO OBVIOUS MARKS OR INJURIES TO THE VICTIM.
