Probable cause affidavit: | SUBMITTED BY: JAKOB, RAINER 0670 (AR10113430) UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011. ON 022010, THE DEFENDANT, MR CHRISTOPHER VOGEL, WAS INSIDE CLUB RAIN, AND WAS ASKED BY THE BOUNCERS TO LEAVE, BECAUSE THE BAR CLOSES AT 0200 HOURS. THE DEFENDANT REFUSED TO LEAVE, AND STARTED A VERBAL ALTERCATION WITH THE BOUNCERS. AS HE EXITED THE CLUB, THE VERBAL ALTERCATION CONTINUED. DEPUTY DAVIS WAS DOING A SECURITY CHECK OF THE ESTABLISHMENT WHEN HE OBSERVED THE VERBAL ALTERCATION, AT WHICH TIME I RESPONDED AS BACK UP FOR DEPUTY DAVIS. UPON MY ARRIVAL I SAW THE DEFENDANT, MR VOGEL, ARGUING WITH DEPUTY DAVIS AND CALLING HIM A RACIST. HE CONTINUED TO REFUSE TO LEAVE THE ESTABLISHMENT. I GAVE HIM SEVERAL OPPORTUNITIES TO MAKE A TELEPHONE CALL TO GET A RIDE, AT WHICH TIME HE STARTED TO CALL ME A RACIST. THE CLUB RAIN STAFF DID NOT WANT THE DEFENDANT TO RETURN TO THE BUSINESS BECAUSE OF THE WAY HE WAS ACTING. MR VOGEL THEN USED HIS CELLULAR TELEPHONE TO CALL HIS FATHER. WHILE MR VOGEL WAS ON THE TELEPHONE HE CONTINUED TO REFER TO ME AS A RACIST DEPUTY, AND I CONTINUED TO TELL HIM THAT HE NEEDED TO GET SOMEONE TO TAKE HIM HOME, AT WHICH TIME HE STATED HE DID NOT NEED TO LEAVE THE PROPERTY BECAUSE HE WAS NOT BREAKING ANY LAWS. I TOLD MR VOGEL HE DID NEED TO LEAVE THE PROPERTY BECAUSE THE BUSINESS DID NOT WANT HIM THERE. MR VOGEL BECAME VERY LOUD, YELLING AT ME TELLING ME HE WAS NOT GOING TO LEAVE. I THEN PLACED MR VOGEL UNDER ARREST FOR DISORDERLY INTOXICATION, HE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND PLACED IN THE REAR SEAT OF MY PATROL VEHICLE. HIS FATHER ARRIVED AT CLUB RAIN AND SAID HE WAS THE ONE HIS SON WAS TALKING TO ON THE TELEPHONE AND HE COULD HEAR THE CONVERSATION, HE SAID HE COULD NOT BELIEVE HIS SON WAS CALLING US RACISTS AND HE SAID HE DID HIS BEST TO TRY TO CALM HIS SON DOWN. HE ALSO STATED THAT HIS SON GETS LIKE THIS WHEN HE HAS HAD TOO MUCH TO DRINK. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS CHARGED WITH DISORDERLY INTOXICATION AND HIS BOND WAS SET AT $150.00 PER THE BOND SCHEDULE. *NOT-EXEMPT* |
