SUBMITTED BY: SMITH, STEVE 0292 (AR07004854) did knowingly, actually and intentionally touch or strike DEPUTY B LAMBERT, a DEPUTY WITH THE CITRUS COUNTY SHERIFF'S OFFICE, against the will of that person while knowing that the said DEPUTY was engaged in a lawful performance of HIS legal duties, in violation of Florida Statute 784.07(2); AND did knowingly and willfully resist, obstruct or oppose DEPUTY S SMITH AND DETECTIVE E SEROCKI, who wERE then and there in the lawful execution of a legal duty, or execution of legal process, to-wit: THE ARREST AND DETENTION OF THE DEFENDANT, by offering or doing violence to the person of such officer, in violation of Florida Statute 843.01; AND did unlawfully and intentionally threaten by word or act to do violence to the person of THE VICTIM, coupled with an apparent ability to carry out said threat, did an act or acts which created a well-founded fear in THE VICTIM that such violence was imminent, in violation of Florida Statute 784.011; AND did unlawfully endanger the safety of another or their property while intoxicated or did while intoxicated or drinking alcoholic beverages in a public place cause a public disturbance, in violation of Florida Statute 856.011. ON 090107, MYSELF AND DETECTIVE SEROCKI WERE WORKING AN OFF DUTY DETAIL AT NATURE'S RESORT CAMPGROUND IN REFERENCE TO IT BEING LABOR DAY WEEKEND. DURING THAT TIME, WE RECEIVED A CALL FROM THE BAR LOCATED TOWARD THE END OF THE CAMPGROUND BY THE BOAT RAMP IN REFERENCE TO TWO WHITE MALES, ONE WHO WAS EXTREMELY INTOXICATED, CAUSING A DISTURBANCE. UPON ARRIVAL AT THE BAR, THE DEFENDANT, MR CHRISTOPHER WORSHAM, AND ANOTHER WHITE MALE WERE POINTED OUT TO US. AT THAT TIME, WE MADE CONTACT WITH BOTH SUBJECTS. IT SHOULD BE NOTED THAT THE DEFENDANT WAS EXTREMELY INTOXICATED, BOISTEROUS AND TALKING EXTREMELY LOUD USING OBSCENITIES. WE ASKED THEM IF THEY WERE STAYING IN THE CAMPGROUND, TO WHICH THEY STATED NO AND THAT THEY JUST WANTED TO LOAD THEIR BOAT SO THEY COULD LEAVE. THIS DEPUTY ADVISED THE SUBJECTS NOT TO GO BACK INTO THE BAR BUT TO LOAD THEIR BOAT SO THEY COULD LEAVE THE CAMPGROUND. AT THAT TIME, THE SUBJECTS LEFT THE AREA TO GET THEIR VEHICLE AND BOAT TRAILER. MYSELF AND DETECTIVE SEROCKI STAYED IN THE AREA IN CASE THERE WAS FURTHER TROUBLE. UPON THEM RETURNING, THE SUBJECTS ATTEMPTED TO LOAD THEIR BOAT ON THEIR TRAILER, WHICH TOOK APPROXIMATELY FIFTEEN TO TWENTY MINUTES. IT SHOULD BE NOTED THAT THERE WAS ANOTHER BOAT WAITING TO LOAD WHY THEY WERE LOADING THEIR BOAT. IT SHOULD ALSO BE NOTED THAT WHILE THEY WERE ATTEMPTING TO LOAD THEIR BOAT, THE DEFENDANT WAS CONTINUOUSLY SCREAMING OBSCENITIES IN REFERENCE TO BYSTANDERS WHO WERE OBSERVING THE INCIDENT. UPON THEM FINALLY GETTING THEIR BOAT LOADED ON THEIR TRAILER, THEY PULLED IT FROM THE WATER. THE SUBJECT/VICTIM WAITING TO LOAD HIS BOAT, WHO THIS DEPUTY WAS STANDING BESIDE, ASKED THE DEFENDANT IF THEY COULD PLEASE PULL FORWARD AND STRAP THEIR BOAT DOWN ON THE SIDE SO HE COULD LOAD HIS OWN BOAT. THE DEFENDANT THEN STATED, "FUCK YOU, YOU SON OF A BITCH." AT THAT TIME, THE VICTIM STATED, "ALL I WANT TO DO IS LOAD MY BOAT." THE DEFENDANT THEN BEGAN TO RAPIDLY APPROACH THE VICTIM WITH HIS HANDS CLINCHED IN FISTS. UPON GETTING WITHIN FOUR FEET OF THE VICTIM, I STEPPED BETWEEN THE SUBJECTS, TURNED THE DEFENDANT AROUND AND ADVISED HIM THAT HE WAS UNDER ARREST FOR DISORDERLY INTOXICATION. THE DEFENDANT BECAME EXTREMELY BELLIGERENT AND IRATE AND BEGAN ATTEMPTING TO KICK MYSELF AND DETECTIVE SEROCKI WHILE TWISTING AND PULLING AGAINST BOTH OF US AND THE HAND RESTRAINTS. THE DEFENDANT HAD TO BE PHYSICALLY PLACED ON THE GROUND, AT WHICH TIME, I CALLED FOR A MARKED PATROL UNIT. DEPUTY B LAMBERT ARRIVED AT THE SCENE AND UPON PLACING THE DEFENDANT ON THE TRUNK AREA OF DEPUTY LAMBERT'S PATROL VEHICLE SO HE COULD BE PATTED DOWN, THE DEFENDANT BEGAN SLAMMING HIS HEAD AGAINST THE TRUNK. DEPUTY LAMBERT THEN ATTEMPTED TO PLACE THE DEFENDANT IN HIS PATROL VEHICLE. IT SHOULD BE NOTED THAT DURING THE DEFENDANT'S STRUGGLES, HE SUSTAINED A SMALL LACERATION TO HIS CHIN, WHICH WAS BLEEDING SLIGHTLY, AND A SMALL ABRASION TO HIS NOSE. AS DEPUTY LAMBERT BEGAN PLACING THE DEFENDANT IN HIS PATROL VEHICLE, THE DEFENDANT LOOKED STRAIGHT AT DEPUTY LAMBERT, SCREAMED OBSCENITIES AND THEN SPIT DIRECTLY INTO DEPUTY LAMBERT'S FACE. THE DEFENDANT WAS THEN SECURED IN THE REAR SEAT OF DEPUTY LAMBERT'S PATROL VEHICLE. AFTER DEPUTY LAMBERT FLUSHED HIS FACE WITH WATER AT THE SCENE, HE TRANSPORTED THE DEFENDANT TO SEVEN RIVERS HOSPITAL. UPON ARRIVAL, THE DEFENDANT WAS BELLIGERENT TO THE HOSPITAL STAFF AND REFUSED ANY TYPE OF TREATMENT. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY BY DEPUTY BARRY SO DEPUTY LAMBERT COULD HAVE HIS EYES AND FACE FLUSHED AT THE HOSPITAL. CONTACT WAS MADE WITH THE DETENTION FACILITY PRIOR TO DEPUTY BARRY'S ARRIVAL IN REFERENCE TO THE DEFENDANT BEING EXTREMELY AGITATED AND COMBATIVE. UPON ARRIVAL, DETENTION FACILITY STAFF TOOK CUSTODY OF THE DEFENDANT IN THE SALLY PORT. THIS DEPUTY WAS ABLE TO MAKE CONTACT WITH THE VICTIM OF THE ASSAULT AT THE SCENE. HE PROVIDED ME WITH A SWORN WRITTEN STATEMENT ADVISING THAT HE BELIEVED THAT THE DEFENDANT WAS GOING TO PUNCH HIM IN HIS FACE. HE ADVISED THAT HE DID WANT TO PRESS CHARGES AGAINST THE DEFENDANT. HE ALSO THANKED THIS DEPUTY FOR STEPPING IN-BETWEEN HIMSELF AND THE DEFENDANT. THIS DEPUTY ALSO OBTAINED A WRITTEN STATEMENT FROM A WITNESS AT THE SCENE WHO OBSERVED THE ENTIRE INCIDENT. THESE DOCUMENTS WERE LATER TURNED IN TO THE CITRUS COUNTY SHERIFF'S OFFICE RECORDS DEPARTMENT. THE DEFENDANT'S TOTAL BOND WAS SET AT $10,400.00 PER THE BOND SCHEDULE. IT SHOULD BE NOTED THAT DEPUTY LAMBERT TOOK PHOTOGRAPHS OF THE DEFENDANT'S INJURIES ONCE HE WAS AT THE CITRUS COUNTY DETENTION FACILITY. *NOT-EXEMPT* |
