SUBMITTED BY: ELMORE, PATRICK 3948/1755 (AR16-21875) THE DRIVER OF ANY VEHICLE INVOLVED IN A CRASH RESULTING ONLY IN DAMAGE TO A VEHICLE OR OTHER PROPERTY DRIVEN OR ATTENDED BY ANY PERSON, SHALL IMMEDIATELY STOP SUCH VEHICLE AT THE SCENE OF SUCH CRASH OR AS CLOSE THERETO AS POSSIBLE, AND SHALL, FORTHWITH RETURN TO AND IN EVERY EVENT SHALL REMAIN AT THE SCENE OF THE CRASH UNTIL SHE HAD FULFILLED THE REQUIREMENTS OF 316.061(1). DID, KNOWING HER DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2). ON 120716 AT APPROXIMATELY 2011 HOURS, I TROOPER P ELMORE (ID NUMBER 3948/1755) WAS DISPATCHED TO THE SCENE OF A HIT AND RUN CRASH INVOLVING A SILVER HONDA CRYSTAL RIVER-V (VEHICLE 2) IN THE AREA OF STATE ROAD 44 (WEST GULF TO LAKE HIGHWAY) AND NORTH JOYNER TERRACE. UPON MY ARRIVAL, I SPOKE WITH THE DRIVER OF VEHICLE 2, IDENTIFIED AS ELIZABETH B WINN BY HER FLORIDA DRIVER'S LICENSE, BEARING THE NUMBER W500-222-51-602-0. SHE STATED SHE HAD PREVIOUSLY BEEN TRAVELING EASTBOUND ON STATE ROAD 44 (WEST GULF TO LAKE HIGHWAY) IN THE OUTSIDE LANE STOPPED FOR A RED TRAFFIC SIGNAL AT THE INTERSECTION OF NORTH JOYNER TERRACE. THE DRIVER OF VEHICLE 2 WENT ON TO SAY WHILE SHE WAS SITTING THERE WAITING FOR THE LIGHT TO CHANGE WHEN HER VEHICLE WAS STRUCK IN THE REAR BY A BLACK FORD PICKUP (VEHICLE 1). AFTER BEING STRUCK, BOTH VEHICLE 2 AND THE BLACK FORD PICKUP PULLED INTO THE HUDDLE HOUSE PARKING LOT. THE DRIVER OF VEHICLE 2 THEN STATED SHE SPOKE WITH THE DRIVER OF THE BLACK FORD PICKUP, IDENTIFIED AS CINDY L DUNCAN BY HER FLORIDA DRIVER'S LICENSE, BEARING THE NUMBER D525-112-69-510-0. SHE STATED MS DUNCAN OFFERED HER $200.00 FOR DAMAGES TO HER VEHICLE. AT THAT TIME, THE DRIVER OF VEHICLE 2 WENT TO THE REAR OF THE BLACK FORD PICKUP AND WROTE DOWN THE LICENSE PLATE NUMBER, THE FLORIDA LICENSE PLATE WAS 341PSA. AFTER REFUSING TO TAKE $200.00 FOR DAMAGES, THE DRIVER OF VEHICLE 1 (MS DUNCAN) LEFT THE SCENE. AT APPROXIMATELY 2137 HOURS, I TROOPER P ELMORE (ID NUMBER 3948/1755) CLEARED THE SCENE OF THE CRASH AND DROVE TO THE ADDRESS OF MS DUNCAN. UPON MY ARRIVAL, I OBSERVED A BLACK FORD PICKUP, BEARING FLORIDA LICENSE PLATE 341PSA, PARKED IN THE DRIVEWAY. VEHICLE 1 STILL HAD A WARM ENGINE AND HAD PAINT TRANSFER ON THE RIGHT FRONT BUMPER CONSISTENT WITH THE DAMAGE OF VEHICLE 2. I THEN MADE CONTACT WITH MS DUNCAN WHO STATED THAT SHE WAS IN THE VEHICLE EARLIER IN THE NIGHT BUT WAS NOT DRIVING. SHE STATED THAT HER AND AN UNIDENTIFIED INDIVIDUAL, IDENTIFIED AS âTONYâ, LEFT MICKEYâS AND WERE HEADED BACK TO MS DUNCANâS RESIDENCE. WHILE SPEAKING WITH MS DUNCAN, I ASKED HER TO DESCRIBE âTONYâ. SHE STATED HE WAS A TALL HEAVY SET MAN WITH BROWN HAIR. I THEN WENT AND INSPECTED THE DRIVER SEAT OF VEHICLE 1 AND I NOTICED THAT THE SEAT WAS VERY CLOSE TO THE STEERING WHEEL, CONSISTENT WITH MS DUNCANâS HEIGHT. AT 2230 HOURS, MS CINDY L DUNCAN WAS PLACED UNDER ARREST, HANDCUFFED BEHIND HER BACK DOUBLE LOCKED, AND PLACED IN THE BACK OF MY MARKED PATROL CAR. MS DUNCAN WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR DRIVING WHILE LICENSE SUSPENDED (KNOWINGLY) AND LEAVING THE SCENE OF A CRASH WITH PROPERTY DAMAGE. MS DUNCANâS BOND WAS SET AT $10,500.00 PER THE BOND SCHEDULE. |
