SUBMITTED BY: REYNOLDS, CONNARY 1267 (AR14-11240) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 071814, AT APPROXIMATELY 1730 HOURS, A CALL WAS DISPATCHED IN REFERENCE TO AN AGGRAVATED ASSAULT THAT JUST OCCURRED AT COPELAND PARK LOCATED AT 850 NORTH EAST 3RD STREET IN CRYSTAL RIVER. DISPATCH ADVISED THAT THE POSSIBLE SUSPECT VEHICLE WAS A 2006 NISSAN MAXIMA SILVER IN COLOR, WHICH HAD LEFT THE SCENE HEADING EASTBOUND ON WEST GULF TO LAKE HIGHWAY. AT THE TIME, I WAS TRAVELING WESTBOUND IN MY PATROL VEHICLE ON WEST GULF TO LAKE HIGHWAY. UPON REACHING THE AREA OF WEST GULF TO LAKE HIGHWAY AND NORTH PENNSYLVANIA AVENUE, I OBSERVED THE SUSPECT VEHICLE OCCUPIED BY TWO BLACK MALES, WHICH WAS HEADED EASTBOUND IN THE SLOW LANE. AT THIS TIME, I MADE A U-TURN IN AN ATTEMPT TO CATCH UP WITH THE VEHICLE AND CLEARLY OBSERVED IT NAVIGATE THROUGH A RED LIGHT AT THE INTERSECTION OF WEST GULF TO LAKE HIGHWAY AND HIGHWAY NORVELL BRYANT HIGHWAY. I THEN NAVIGATED THE INTERSECTION, WHERE I OBSERVED THE SUSPECT VEHICLE LOOK LIKE IT WAS GOING TO TURN INTO A PARKING LOT; HOWEVER HE TURNED BACK ONTO HIGHWAY AND CONTINUED EASTBOUND. I EVENTUALLY GOT BEHIND THE VEHICLE AND ACTIVATED MY EMERGENCY EQUIPMENT INCLUDING MY SIREN AND AIR HORN, BECAUSE IT APPEARED AS IF THE DRIVER WAS NOT STOPPING AT THIS TIME. HOWEVER, MOMENTS LATER THE DRIVER PULLED INTO THE FAMILY DOLLAR LOCATED AT 6440 WEST GULF TO LAKE HIGHWAY IN CRYSTAL RIVER, AND PULLED IN TO A PARKING PLACE. DEPUTY WEST AND I CONDUCTED A FELONY TRAFFIC STOP ON THIS VEHICLE DUE TO THE NATURE OF THE ORIGINAL INCIDENT THAT INVOLVED A GUN. DEPUTY WEST AND I BOTH HAD OUR FIREARMS AT A LOW READY POSITION, WHERE BOTH OCCUPANTS OF THE VEHICLE WERE SECURED WITHOUT FURTHER INCIDENT. THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR CLARENCE BRYANT, SEARCHED, HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN DEPUTY WESTâS VEHICLE. THE PASSENGER, MR LORIN WRIGHT, WAS SEARCHED, HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN MY PATROL VEHICLE. SHORTLY AFTER, K-9 DEPUTY HRYC ARRIVED AND DEPLOYED HIS CANINE PARTNER ZEUS FOR AN EXTERIOR SNIFF OF THE VEHICLE, WHICH YIELDED POSITIVE RESULTS. SEE HIS SUPPLEMENT FOR FURTHER. NO CONTRABAND OR WEAPONS WERE LOCATED IN THE VEHICLE DURING THE SEARCH. I THEN SPOKE WITH MR WRIGHT and read his MIRANDA RIGHTS VIA PREPRINTED AGENCY issued CARD, where I SPOKE WITH HIM ABOUT THE ALLEGED AGGRAVATED ASSAULT, SEE case NUMBER 14-98416. DURING THIS, MR WRIGHT STATED that THE DEFENDANT WAS UNSURE IF HE SHOULD STOP BECAUSE HE KNEW HE DID NOT HAVE A DRIVER'S LICENSE. THE WITNESS STATED THAT THE DRIVER STATED, âSHIT, I donât HAVE NO LICENSEâ. THE WITNESS WAS LATER RELEASED AFTER THE INVESTIGATION WAS COMPLETED. A SEARCH OF THE DEFENDANTâS DRIVER'S LICENSE REVEALED THAT IT HAS BEEN SUSPENDED MULTIPLE TIMES, MOST RECENTLY A SUSPENSION ON 012913, AND NOTICE PROVIDED ON 010913. the DEFENDANT HAD SEVERAL OTHER SUSPENSIONS AND ONE PREVIOUS DRIVING WHILE LICENSE SUSPENDED CONVICTION. i THEN READ THE DEFENDANT his MIRANDA RIGHTS VIA PREPRINTED AGENCY CARD AND ASKED IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE REPLIED THAT HE DID. I THEN ASKED HIM IF HE WISHED TO SPEAK WITH ME AT THIS TIME, TO WHICH HE ADVISED THAT HE WOULD. I THEN SPOKE with THE DEFENDANT, WHO STATED THAT EARLIER HE GOT INTO AN ARGUMENT WITH A FEMALE AND THE FEMALE ENDED UP CHASING HIM, WHICH WAS WHY HE RAN THE RED-LIGHT AT HIGHWAY 44 AND HIGHWAY NORVELL BRYANT HIGHWAY, BECAUSE HE WAS SCARED. IT SHOULD BE NOTED that THIS IS REFERENCE to AN AGGRAVATED ASSAULT CASE AND IT DID NOT APPEAR WHILE I WAS OBSERVING THE VEHICLE THAT HE WAS BEING CHASED BY ANYONE. I ASKED THE DEFENDANT WHY HE APPEARED UNEASY TO STOP, TO WHICH HE ADVISED THAT HE DID NOT KNOW I WAS BEHIND HIM, HOWEVER HE DID SEE ME MAKE AN U-TURN. WHEN I ASKED THE DEFENDANT ABOUT HIS DRIVER'S LICENSE STATUS HE ADMITTED that IT WAS INDEED REVOKED; HOWEVER AT NO POINT WAS HE TRYING TO ELUDE ME. the DEFENDANT STATED THAT HE WAS ONLY SCARED BECAUSE HE THOUGHT THAT THE FEMALE IN THE AGGRAVATED ASSAULT CASE WAS FOLLOWING HIM. i REMAINED ON SCENE FOR A SHORT TIME WHILE THE AGGRAVATED ASSAULT CASE WAS INVESTIGATED. SHORTLY AFTER, THE DEFENDANT WAS ADVISED THAT HE WAS BEING PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED OR REVOKED, WHERE HE WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY BY DEPUTY POLLIARD AND CHARGED WITH ONE COUNT of DRIVING WHILE LICENSE SUSPENDED OR REVOKED SECOND CONVICTION, WITH A BOND OF $1,000.00 PER THE BOND SCHEDULE. UPON MY ARRIVAL AT THE JAIL, THE DEFENDANT WAS ISSUED WRITTEN WARNING 369732B, FOR RUNNING A RED LIGHT AND CRIMINAL UNIFORM TRAFFIC CITATION 4319GJX6, FOR DRIVING WHILE LICENSE SUSPENDED OR REVOKED KNOWINGLY WITH A PRIOR CONVICTION, WITH A MANDATORY COURT DATE OF 081414 AT 1300 HOURS. THE DEFENDANT WAS EXPLAINED THE CITATION AND COURT DATE, SIGNED THE CITATION AND RECEIVED A COPY OF IT. THE DEFENDANTâS PROPERTY WAS TURNED OVER TO HIS GIRLFRIEND ALONG WITH THE VEHICLE, PER HIS REQUEST. NO FURTHER ACTION BY THIS DEPUTY. |
