SUBMITTED BY: ELDRIDGE, BRYAN 0722 (AR11119679) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: ELECTRONIC SCALE WITH METHAMPHETAMINE RESIDUE ON IT AND MULTIPLE SMALL PLASTIC BAGGIES AND A SMALL SILVER SPOON AND A METALLIC CYLINDRICAL DEVICE WHICH APPEARS TO BE A SMOKING DEVICE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 030811 AT APPROXIMATELY 0024 HOURS, DEPUTY MCEWEN OBSERVED THE DRIVER OF A PINK PONTIAC SEDAN NOT WEARING HER SEATBELT. AT THIS TIME DEPUTY MCEWEN CONDUCTED A TRAFFIC STOP ON THE VEHICLE AT THE INTERSECTION OF HIGHWAY 41 S AND SOUTH APOPKA AVENUE IN INVERNESS. DEPUTY MCEWEN AND I THEN APPROACHED THE VEHICLE. WHILE APPROACHING THE VEHICLE I DID NOT OBSERVED THE DEFENDANT, MS CLAUDIA GIBSON, TO BE WEARING HER SEATBELT. I THEN ASKED THE DEFENDANT FOR HER DRIVER'S LICENSE AND ASKED HER WHY SHE DID NOT HAVE HER SEATBELT ON, TO WHICH SHE STATED THAT SHE WAS WEARING IT BUT IT IS LOW RIDDING AND YOU CAN'T SEE IT. SHE ALSO STATED SHE HAD TAKEN THE SEATBELT OFF PRIOR TO OUR APPROACH. K-9 DEPUTY DEARDEN AND K-9 TYSON ARRIVED ON SCENE AND CONDUCTED AN OPEN AIR SNIFF AROUND THE DEFENDANT'S VEHICLE AND ALERTED TO THE SCENT OF NARCOTICS ON THE EXTERIOR OF THE VEHICLE. THE DEFENDANT WAS THEN ASKED TO EXIT THE VEHICLE AND STANDBY WITH DEPUTY MCEWAN. DEPUTY DEARDEN AND I THEN CONDUCTED A SEARCH OF THE DEFENDANT'S VEHICLE. DEPUTY DEARDEN THEN LOCATED A GREY ZIPPERED POUCH ON THE FRONT PASSENGER'S FLOORBOARD WITH THE LETTERS "OMG" ON IT. THE POUCH CONTAINED MULTIPLE SMALL BAGGIES, A SILVER SPOON AND AN ELECTRONIC SCALE WITH A WHITE FLAKY RESIDUE WHICH TESTED POSITIVE FOR METHAMPHETAMINE USING A FIELD TESTING KIT ISSUED BY THE CITRUS COUNTY SHERIFF'S OFFICE. DEPUTY DEARDEN ALSO LOCATED A SMALL METALLIC CYLINDRICAL TUBE WITH BLACK TAPE AROUND ONE END UNDER THE PASSENGER'S SIDE FLOORBOARD THAT APPEARS TO BE A SMOKING DEVICE. DEPUTY TEWELL THEN ARRIVED ON SCENE AND CONDUCTED A THOROUGH SEARCH OF THE DEFENDANT'S BODY. WHILE CONDUCTING THE SEARCH, DEPUTY TEWELL LOCATED A PRESCRIPTION BOTTLE TOP BETWEEN THE DEFENDANT'S LEGS. DEPUTY TEWELL ASKED THE DEFENDANT TO REMOVE THE BOTTLE AT WHICH TIME THE DEFENDANT SHOVED THE BOTTLE INTO HER VAGINAL CAVITY. SEE DEPUTY TEWELL'S SUPPLEMENT REPORT. THE DEFENDANT WAS PLACED UNDER ARREST FOR POSSESSION OF DRUG PARAPHERNALIA, HANDCUFFED, BEHIND HER BACK, (DOUBLE LOCKED), SECURED IN THE REAR OF DEPUTY TEWELL'S PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED A UNIFORM TRAFFIC CITATION FOR FAILURE TO WEAR A SAFETY BELT BY A DRIVER CITATION NUMBER 4939GJX6 WITH A FINE OF $116.00 DUE WITHIN 30 DAYS.
