Probable cause affidavit: |
SUBMITTED BY: CUTLIP, JOSHUA 0721 (AR11119684) DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 030811 AT APPROXIMATELY 1430 HOURS, I RESPONDED AS BACKUP TO DEPUTY CROSNOE'S TRAFFIC STOP. UPON MY ARRIVAL, I MET WITH DEPUTY CROSNOE WHO WAS IN THE PROCESS OF DETAINING THE DEFENDANT, MR CLAYTON JAY PRUITT, FOR KNOWINGLY DRIVING ON A SUSPENDED DRIVER'S LICENSE. THROUGH CHECKING WITH FCIC/NCIC ALONG WITH "DAVID" IT WAS CONFIRMED THAT MR PRUITT'S DRIVER'S LICENSE WAS SUSPENDED INDEFINITELY AS OF 020911, FOR FAILURE TO PAY TRAFFIC CITATIONS. AT THAT TIME DEPUTY CROSNOE STATED TO ME THAT WHILE HE WAS ON ROUTINE PATROL ON HIGHLANDS BOULEVARD IN INVERNESS HE NOTICED A RED CHEVY S10 PICKUP BEING DRIVEN BY THE DEFENDANT. DEPUTY CROSNOE RAN THE DEFENDANT'S LICENSE PLATE, WHICH REVEALED THAT THE DEFENDANT'S DRIVER'S LICENSE WAS SUSPENDED. DEPUTY CROSNOE STATED TO ME SEVERAL TIMES THAT HE HAD NUMEROUS ENCOUNTERS WITH THE DEFENDANT AND THAT INDEED THE DEFENDANT HAD KNOWLEDGE THAT HIS LICENSE WAS CURRENTLY SUSPENDED. DEPUTY CROSNOE STATED THAT WHEN THE DEFENDANT PULLED UP ALONG SIDE OF HIM AT THE TRAFFIC LIGHT OF WEST MAIN STREET AND WEST HIGHLANDS BOULEVARD, THE DEFENDANT BEGAN TO ACT VERY NERVOUS AND THAT WAS WHEN DEPUTY CROSNOE NOTICED THE DEFENDANT TRYING TO CONCEAL HIS IDENTITY SO THAT DEPUTY CROSNOE WOULD NOT RECOGNIZE HIM. AT THAT TIME, HE CONDUCTED A TRAFFIC STOP ON THE DEFENDANT'S VEHICLE IN THE CITRUS PLAZA SHOPPING CENTER BY PLACING HIS PATROL VEHICLE DIRECTLY BEHIND THE DEFENDANT'S VEHICLE AND ACTIVATING HIS EMERGENCY OVERHEAD LIGHTS, WHERE THE DEFENDANT THEN PULLED INTO THE CITRUS PLAZA SHOPPING CENTER. THE DEFENDANT WAS ASKED TO STEP OUT OF THE VEHICLE AND AT THAT TIME, DEPUTY CROSNOE REQUESTED HIS DRIVER'S LICENSE WHERE HIS IDENTITY WAS CONFIRMED. AT THAT TIME, DEPUTY CROSNOE INFORMED THE DEFENDANT THAT HE WAS BEING PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED OR REVOKED (DWLSR). THE DEFENDANT STATED THAT HE KNEW HE HAD SOME PAST DUE CITATIONS THAT would PROBABLY SUSPEND HIS LICENSE. THE DEFENDANT WAS SEARCHED FOR CONTRABAND AND AFTER SAID SEARCH WAS COMPLETE, THE DEFENDANT WAS HANDCUFFED BEHIND HIS BACK (DOUBLE LOCKED) AND PLACED in the REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. PRIOR TO LEAVING the SCENE THE DEFENDANT'S VEHICLE WAS SECURED AND LEFT IN THE CITRUS SHOPPING PLAZA AT THE DEFENDANT'S REQUEST. I PLACED THE DEFENDANT'S KEYS in the CITRUS COUNTY DETENTION FACILITY PROPERTY BAG. I ISSUED THE DEFENDANT A CRIMINAL CITATION FOR DWLSR WITH KNOWLEDGE, CITATION NUMBER 6525-GJX8, AND DELIVERED IT TO THE CITRUS COUNTY DETENTION FACILITY STAFF ALONG WITH HIS PERSONAL BELONGINGS. THE DEFENDANT'S BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. NO FURTHER ACTION TAKEN BY THIS DEPUTY.
