Charge description: | A jury convicted Cliffton Javon Johnson of Injury to the Elderly on December 11, 2013. The 32-year-old Houston man was charged with knocking his grandfather to the ground during a disturbance earlier this year. 268th District Court Judge Brady Elliott then sentenced Johnson to three years in prison for his crime. According to prosecutor Alexandra Foley, Johnson was living with his grandfather, the victim in this case. The victim was at his daughters home in Houston when Johnson arrived and started an altercation with many of the people at the home. The defendant and his grandfather were standing alone as the grandfather tried to calm the defendant down. Johnson then struck his 82-year-old grandfather causing him to fall to the ground. At trial, Johnson testified that he did not recall knowingly striking his grandfather and that any contact was unintentional. The prosecution also presented testimony and photographs of the victims injuries. After deliberating for less than two hours, the jury rejected Johnsons claim that the injuries were unintentional or merely reckless. Judge Elliott immediately began a sentencing hearing where he heard evidence of Johnsons prior felony convictions. Although probation eligible, the evidence presented convinced the Court to deliver a prison sentence in this case. Injury to the Elderly is a third-degree felony punishable by 2-10 years in prison and a fine up to $10,000. Assistant District Attorneys Alexandra Foley and Zahra Jivani Fenelon prosecuted the case. Attorney Roderick Glass represented the defendant. |
