SUBMITTED BY: ALEXANDER, DAWN 0561 (AR-1345) DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY ALEXANDER, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: DEPUTY WAS TAKING CUSTODY OF FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION ARRESTEES AND PLACING THEM IN THE REAR OF PATROL VEHICLE, WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. ON 052712, I RESPONDED TO PETEâS PIER IN CRYSTAL RIVER IN REFERENCE TO ASSISTING FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION (FWC) WITH TRANSPORTING TWO ARRESTED SUBJECTS THAT THEY HAD FOR BOATING UNDER THE INFLUENCE. UPON MY ARRIVAL, I MADE CONTACT WITH FWC RUSSO AND FWC CRANE, THEY ADVISED THAT THEY HAD TWO SUBJECTS UNDER ARREST FOR BOATING UNDER THE INFLUENCE. I PLACED ONE SUBJECT IN THE PASSENGER SIDE REAR SEAT OF MY PATROL VEHICLE. I THEN WENT TO PLACE THE SECOND SUBJECT IN THE DRIVERâS SIDE REAR SEAT OF MY PATROL VEHICLE, WHEN THE ARRESTEESââ FRIEND KEPT APPROACHING THIS DEPUTY ASKING IF HE COULD TALK TO THE ARRESTEE. I ADVISED THE WHITE MALE SUBJECT SEVERAL TIMES TO BACK AWAY FROM THIS DEPUTY AND THE ARRESTEE AND HE CONTINUED SPEAKING. I ADVISED HIM THAT THIS WAS HIS LAST WARNING AND THAT HE NEEDED TO STEP AWAY FROM THIS DEPUTY AND MY PATROL VEHICLE, OR THAT HE WOULD BE PLACED UNDER ARREST, HE THEN WALKED AWAY. THE ARRESTEE I WAS PLACING IN THE REAR DRIVERâS SIDE SEAT OF MY PATROL VEHICLE, ASKED IF I COULD REPOSITION HIS HANDCUFFS BECAUSE THEY WERE ON HIM TOO TIGHT. I GOT HIM OUT OF MY VEHICLE TO CHECK THEM FOR HIM. AT THAT TIME THE WHITE MALE SUBJECT AGAIN CAME RIGHT UP BEHIND ME, ON MY GUN SIDE, AND STATED THAT HE WANTED TO KNOW WHERE THE CITRUS COUNTY DETENTION FACILITY WAS, AND KEPT TRYING TO TALK TO THE ARRESTEE. I ADVISED HIM AGAIN TO BACK AWAY FROM THIS DEPUTY AND MY PATROL VEHICLE, AND HE STATED THAT HE WAS JUST TRYING TO TALK. I ADVISED HIM A SECOND TIME IN A RAISED VOICE TO STEP AWAY OR HE WOULD BE ARRESTED. FWC LIEUTENANT JONES, OBSERVED THE WHITE MALE CONTINUING TO TALK STATING THAT HE WAS JUST TRYING TO FIGURE OUT WHAT WAS GOING ON. LIEUTENANT JONES ADVISED HIM ALSO, THAT HE NEEDED TO BACK AWAY FROM MY PATROL VEHICLE, THE DEFENDANT STILL WOULD NOT BACK AWAY AND CONTINUED SPEAKING. AT THIS TIME, THE SUBJECT/DEFENDANT, WHO WAS LATER IDENTIFIED BY HIS FLORIDA DRIVER'S LICENSE AS MR CLINTON LEE YANCEY, WAS PLACED UNDER ARREST FOR OBSTRUCTION OF JUSTICE. I CALLED FOR ANOTHER UNIT TO TRANSPORT THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY. AS I WAS PLACING THE HANDCUFFS ON HIM HE KEPT STATING THAT HE JUST WANTED TO KNOW WHERE THE âJAILâ WAS AND WANTED TO TALK TO HIS FRIEND. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. UPON ARRIVAL AT THE CITRUS COUNTY DETENTION FACILITY, THE DEFENDANT ASKED TO SPEAK WITH ME AND HE STATED THAT HE DID âNOT UNDERSTAND WHYâ I HAD TO TAKE HIM TO âJAILâ, I AGAIN EXPLAINED THAT HE WAS ADVISED TO LEAVE NOT ONLY BY MYSELF, BUT BY FWC LIEUTENANT JONES SEVERAL TIMES, AND THAT HE REFUSED. THAT HE WAS CONTINUING TO OBSTRUCT IN THE ARREST OF HIS FRIEND THAT WAS IN MY CUSTODY. THE DEFENDANT WAS SO INTOXICATED THAT HE JUST KEPT REPEATING THAT HE DID NOT UNDERSTAND. |
