SUBMITTED BY: WARD, KELLIE 0725 (AR13-6099) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, WALMART, TO WIT: PUT ITEMS IN HIS LEFT FRONT POCKET , SAID PROPERTY BEING OF A VALUE OF $50.24, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(1) and 812.014(3)(a). ON 061513, I RESPONDED TO THE SUPER WALMART CENTER which IS LOCATED AT 1936 NORTH LECANTO HIGHWAY IN LECANTO, IN REFERENCE TO A RETAIL THEFT. UPON MY ARRIVAL, I MADE CONTACT WITH THE LOSS PREVENTION OFFICER/WITNESS, MR BRIAN ELAM, WHO ADVISED THAT HE HAD OBSERVED THE DEFENDANT, MR CODIE ARNOLD, IN THE ELECTRONICS DEPARTMENT OF THE STORE, WHERE HE OBSERVED HIM SELECT AN OTTER CELLULAR PHONE CASE AND PLACE IT IN A BLUE WALMART SHOPPING BASKET. MR ELAM STATED THAT THE DEFENDANT THEN WENT DOWN A GROCERY AISLE, OPENED THE PACKAGE AND PLACED THE CELLULAR PHONE CASE IN HIS LEFT FRONT POCKET. HE CONTINUED TO SHOP AND WENT THROUGH THE REGISTER TO PAY FOR THE FOOD ITEMS HE HAD IN HIS BASKET, BUT NEVER ATTEMPTED TO PAY FOR THE CELLULAR PHONE CASE. THE DEFENDANT THEN PASSED ALL FINAL POINTS OF SALE, WHERE MR ELAM STOPPED HIM, IDENTIFIED HIMSELF AND ESCORTED THE DEFENDANT TO THE LOSS PREVENTION OFFICE. THE DEFENDANT ALSO RETURNED A HAIR CLIP AND EARRINGS THAT HE HAD HIS LEFT FRONT POCKET AS WELL. MR ELAM FILLED OUT A SWORN WRITTEN STATEMENT THAT WAS COLLECTED AND WILL LATER BE TURNED IN TO RECORDS. HE ALSO PROVIDED A RECEIPT FOR THE STOLEN RECOVERED MERCHANDISE, WHICH WILL LATER BE TURNED IN TO RECORDS. WHEN I MADE CONTACT WITH THE DEFENDANT, HE HAD NO EXPLANATION FOR WHY HE SHOPLIFTED TODAY. THE DEFENDANT WAS THEN ADVISED THAT HE WAS BEING PLACED UNDER ARREST FOR RETAIL THEFT, HANDCUFFED, (DOUBLE LOCKED), IN THE FRONT, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $250.00, PER THE BOND SCHEDULE. |
