Probable cause affidavit: SUBMITTED BY: MARSHALL, AIDAN 0453 (AR12-2788) DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS OVER 20 GRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). on 091712 at appROXIMATELY 1600 hours, depUty reeves and i were driving on north rooks avenue appROACHING the intERSECTION of east walker street. upon arrIVAL AT the interSECTION we obSERVED a red 2-door chevrolet beARinG flORIDA tag NUMBER bfr-y96 backing up in the opposite lane of traFfiC toward our vehicle. we also observed a white male who was standinG on thE siDe of the road approAchING the drIVER’S side of the vehicle and begAn taLking to the driver thrOUGH an open window. deputy reeves activated our emergency equIpMENT and condUCTED a traffic stop on thE red 2-door vehicle for stopPing in the roAdway in the wrong lane of traffic. i approAched the driver’s side of the vehicle and made conTact with the driver requeSTING his dRIVER’S LICENSE and registrAtion and adVised him of why we had stopped the vehicle. while i was speakinG with the driver, the white male who had been stanDING at the drIVER’S side window was standing on thE right of way next to thE vEhIcle holding an alcoholic beverage in his left hand. i then requested identificaTION FROM the INDIVIDUAL HOLDING THE ALCOHOLIC BEVERAGE. AT THAT TIME, HE PROVIDED A FLORIDA IDENTIFICATION CARD IDENTIFYING HIMSELF AS MR CODY CLAYTOR. I ADVISED MR CLAYTOR THAT HE WAS NOT FREE TO LEAVE DUE TO HIM CONSUMING AN ALCOHOLIC BEVERAGE IN THE ROADWAY. I THEN RETURNED TO OUR VEHICLE AND RAN MR CLAYTOR THROUGH NCIC/FCIC. DEPUTY REEVES MADE CONTACT WITH MR CLAYTOR AND ASKED HIM IF HE WE COULD PAT HIM DOWN FOR ANY WEAPONS OR CONTRABAND, TO WHICH MR CLAYTOR CONSENTED TO A PAT-DOWN. DURING THE PAT-DOWN MR CLAYTOR REMOVED A CIGARETTE PACKAGE AND INSIDE THIS CIGARETTE PACKAGE WAS A PLASTIC BAGGIE CONTAINING CANNABIS. AFTER DEPUTY REEVES COMPLETED THE PAT-DOWN HE OBSERVED TWO PLASTIC BAGGIES ALSO CONTAINING CANNABIS NEAR WHERE WE HAD FIRST OBSERVED MR CLAYTOR TO BE STANDING BEFORE HE HAD APPROACHED THE VEHICLE. AFTER DEPUTY REEVES FOUND the CANNABIS, I THEN READ MR CLAYTOR HIS MIRANDA VIA PRE-PRINTED CARD, TO WHICH HE ADVISED AND WISHED TO SPEAK TO THIS DETECTIVE. MR CLAYTOR ADMITTED THAT BOTH the CANNABIS FOUND ON HIS PERSON AND THE OTHER TWO BAGGIES FOUND BY DEPUTY REEVES ON THE GROUND WERE ALSO HIS. MR CLAYTOR FURTHER STATED THAT ALL OF THE CANNABIS WAS FOR PERSONAL USE DESPITE THE FACT THAT THE CANNABIS WAS PACKAGED IN SEVERAL SMALLER BAGGIES WITHIN THE LARGER BAGGIE. MR CLAYTOR WAS ASKED HOW MUCH THE CANNABIS WOULD WEIGH, TO which HE STATED, “IT IS OVER 20 GRAMS. I KNOW IT IS A FELONY.” I THEN PLACED MR CLAYTOR IN HANDCUFFS (DOUBLE LOCKED ) BEHIND HIS BACK. A PAT-DOWN SEARCH OF MR CLAYTOR REVEALED ANOTHER ROLL OF PLASTIC BAGGIES WHICH WERE EMPTY BUT ARE CONSISTENT with the SAME BAGGIES found CONTAINING THE CANNABIS. MR CLAYTOR WAS ASKED WHERE HE HAD OBTAINED THE CANNABIS, TO WHICH HE STATED THAT HE HAD OBTAINED A WHOLE PLANT AND HAD DRIED AND PACKAGED IT HIMSELF; HOWEVER, WAS INSISTENT THAT HE WAS NOT ACTIVELY SELLING CANNABIS. THE CANNABIS WAS FIELD TESTED AND TESTED POSITIVE FOR CANNABIS. THE CANNABIS WEIGHED APPROXIMATELY 23.5 GRAMS. DEPUTY REEVES PACKAGED the CANNABIS, WHICH WAS LATER TURNED IN TO THE CITRUS COUNTY SHERIFF’S EVIDENCE DIVISION. DEPUTY REEVES TRANSPORTED MR CLAYTOR TO the CITRUS COUNTY JAIL FOR PROCESSING. HIS BOND WAS SET AT $5,000.00, PER THE BOND SCHEDULE.
