SUBMITTED BY: ALEXANDER, DAWN 0561 (AR13-5207) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 0.9 GRAMS OF METHAMPHETAMINES, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: ONE OXYCONTIN 40 MILLIGRAM PILL, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: BROKE GLASS METHAMPHETAMINE PIPE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: ONE HEMOSTAT, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 041313, I WAS FLAGGED DOWN AT A GAS STATION LOCATED AT LONGFELLOW AND HIGHWAY 19 IN REFERENCE TO A SUSPICIOUS SUBJECT SITTING IN THE PARKING LOT OF THE RACE TRAC GAS STATION LOCATED AT 3861 SOUTH SUNCOAST BOULEVARD. THE ANONYMOUS COMPLAINANT ADVISED ME that THE SUBJECT WAS A WHITE MALE SITTING IN A WHITE FORD ESCORT IN THE CORNER PARKING LOT BY THE AIR TANK. HE STATED the SUBJECT APPROACHED HIM and ASKED HIM IF HE COULD SEE INTO THE VAN THAT WAS LOCATED BY THE DOLLAR GENERAL STORE. THE COMPLAINANT ADVISED THAT THE SUBJECT HAD A SINGULAR BINOCULAR THAT HE WAS LOOKING THROUGH INTO THE VAN. THE COMPLAINANT ADVISED THAT THE SUBJECT STATED THAT HE WAS SUPPOSED TO TAKE THE PASSENGER OF THE VAN TO NEW PORT RICHEY FOR A DEAL. HE STATED THAT HE BELIEVED THE WHITE MALE WAS POSSIBLY LOOKING TO ROB SOMEBODY OR DO SOMETHING UNKNOWN BECAUSE OF HIS ACTION. I ADVISED DISPATCH OF THIS COMPLAINT AND RESPONDED TO RACE TRAC WHERE I DID OBSERVE A WHITE FORD ESCORT PARKED IN THE CORNER OF THE LOT WITH A WHITE MALE SITTING IN THE DRIVERâS SEAT. THE VEHICLEâS LICENSE PLATE WAS K4879I. AS I WAS APPROACHING, THE MALE DRIVER STARTED THE VEHICLE AND ATTEMPTED TO BACK UP WHEN I ADVISED HIM TO SHUT THE VEHICLE OFF. I ASKED THE MALE SUBJECT/DEFENDANT, MR CODY JAMES MELVIN, IF HE HAD ANY IDENTIFICATION ON HIM AND HE HANDED ME HIS FLORIDA DRIVER'S LICENSE. I ASKED HIM WHY HE WAS SITTING IN THE PARKING LOT OF THE RACE TRAC AND HE STATED THAT HE WAS âJUST SITTING THERE DOING NOTHING, HE WAS BEING GOOD.â DEPUTY SETTLES HAD ARRIVED ON SCENE ALSO. I THEN ADVISED THE DEFENDANT WHY I WAS STOPPING HIM THAT I HAD A COMPLAINT IN REFERENCE TO HIM WATCHING THE VAN WITH A BINOCULAR. THE DEFENDANT THEN PULLED OUT A SINGLE BINOCULAR FROM UNDERNEATH HIS SHIRT AND STATED THAT HE WAS âLOOKING AT THE CLOUDS BECAUSE THEY WERE PRETTY TODAY.â I THEN ADVISED HIM THAT A SUBJECT STOPPED ME WHO HE HAD STOPPED AND TOLD TO LOOK INTO THE VAN FOR HIM. HE THEN STATED THAT HE WAS LOOKING FOR THE VAN BECAUSE HE WAS SUPPOSED TO BRING SOMEBODY TO NEW PORT RICHEY. I ASKED THE DEFENDANT IF HE HAD ANYTHING ILLEGAL ON HIM DUE TO HIM ACTING VERY NERVOUS AND SHAKING. THE DEFENDANT STATED THAT HE DID NOT HAVE ANYTHING ON HIM. I ASKED HIM IF I COULD SEARCH HIS VEHICLE AND HE ADVISED THAT I COULD. I THEN WENT BACK TO MY VEHICLE AND RAN A NCIC/FCIC CHECK ON THE DEFENDANT. DEPUTY COX THEN ARRIVED WITH K-9 PRIEST WHERE HE DID AN EXTERIOR SNIFF OF THE VEHICLE AND K-9 PRIEST ALERTED ON the PASSENGERâS SIDE DOOR IMMEDIATELY. DEPUTY COX THEN SEARCHED THE VEHICLE AND ON THE FRONT SEAT WAS THE DEFENDANTâS WALLET. INSIDE THE DEFENDANTâS WALLET WHERE HIS IDENTIFICATION WAS, DEPUTY COX LOCATED A WHITE WRAPPER WITH A SUBSTANCE IN IT THAT LATER TESTED POSITIVE FOR METHAMPHETAMINES. IT WAS LATER WEIGHED AND WEIGHED APPROXIMATELY 0.9 GRAMS. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) AND PLACED IN THE REAR OF MY PATROL VEHICLE. DEPUTY COX CONTAINED TO SEARCH THE VEHICLE AND LOCATED A CLEAR PLASTIC BAGGIE WITH APPROXIMATELY 1.8 GRAMS OF CANNABIS ALONG WITH A BROKEN METHAMPHETAMINE PIPE INSIDE A CIRCLE K STYROFOAM CUP THAT WAS INSIDE THE VEHICLE. ALSO LOCATED IN the CENTER CONSOLE WAS A SILVER IN COLOR PAIR OF HEMOSTATS WITH RESIDUE ON THEM. UNDER THE PASSENGER SEAT WAS A SILVER IN COLOR FLASK WITH ONE YELLOW ROUND PILL INSIDE WITH OP ON ONE SIDE AND 40 ON THE OTHER. DEPUTY COX MADE CONTACT WITH POISON CONTROL WHICH VERIFIED THE PILL WAS OXYCONTIN 40 MILLIGRAMS. I READ THE DEFENDANT HIS MIRANDA WARNINGS VIA PRE-PRINTED AGENCY ISSUED CARD AND HE AGREED TO SPEAK WITH ME. HE ADVISED ME THAT HE HAS PRESCRIPTIONS FOR PAIN MEDICINE BUT DOES NOT HAVE A PRESCRIPTION FOR THE OXYCONTIN AND HAS NO IDEA HOW IT GOT INTO HIS VEHICLE. HE ALSO STATED HE HAS NO IDEA HOW THE METH OR THE METH PIPE GOT IN THERE BECAUSE ALL HE DOES IS SMOKE MARIJUANA. THE DEFENDANT STATED THAT HE IS DISABLED AND HAS NO KNOWLEDGE OF HOW THE METHAMPHETAMINES WOULD HAVE GOTTEN INTO HIS WALLET EVEN THOUGH HE HAD JUST STARTED USING THAT WALLET. THE DEFENDANT STATED THAT HE TAKES A LOT OF PRESCRIPTION MEDICATIONS. WHEN I ASKED HIM WHY SO MANY WERE MISSING OUT OF THE PILL BOTTLES, THE DEFENDANT STATED HE HAD HIDDEN SOME OF THE PILLS AT HOME SO PEOPLE DID NOT TAKE THEM. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HIS BOND WAS SET AT A TOTAL OF $11,500.00 PER THE BOND SCHEDULE. THE EVIDENCE WAS LATER TURN IN TO EVIDENCE. THE DEFENDANTâS VEHICLE WAS TOWED BY ADAMâS TOWING. NO FURTHER INFORMATION AT THIS TIME. |
