Probable cause affidavit: | \tSUBMITTED BY: PRICE, BOBBY 0411 (AR16-18818) (16-41564) \tdid knowingly give false information to a law enforcement officer, to wit: DEPUTY PRICE, concerning the alleged commission of a crime, to wit: AUTO THEFT, in violation of Florida Statute 837.05(1). \t \tON 032816 AT APPROXIMATELY 1836 HOURS, THIS DEPUTY CONDUCTED A FELONY INVESTIGATION PERTAINING TO A GRAND THEFT MOTOR VEHICLE REPORT INVOLVING THE DEFENDANT, IDENTIFIED AS MR COREY PRIMO NICOLINI. DURING MY INVESTIGATION, THE NOW DEFENDANT, WHO WAS PREVIOUSLY LISTED AS A VICTIM, DID PROVIDE A FALSE REPORT TO THIS DEPUTY ABOUT THE COMMISSION OF THE ALLEGED CRIME. THROUGH THIS DEPUTY'S INVESTIGATION, IT WAS DETERMINED that THE DEFENDANT'S VEHICLE WAS NOT STOLEN AS HE ALLEGED. IT WAS DETERMINED THAT IN FACT THE DEFENDANT WAS ALSO THE DRIVER OF HIS VEHICLE THAT WAS INVOLVED IN A SINGLE VEHICLE CRASH IN MARION COUNTY WHERE the DEFENDANT WAS REPORTED TO HAVE FLED the SCENE OF the CRASH. THIS CRASH WAS INVESTIGATED BY FLORIDA HIGHWAY PATROL (FHP) REFERENCE THEIR CASE NUMBER FHPG160FF008202. \t \tTHIS DEPUTY WAS ABLE TO ASSIST FHP WITH THEIR CRASH INVESTIGATION BY PROVIDING the DEFENDANT'S NAME AND DRIVER'S LICENSE NUMBER. TROOPER WHITMORE FROM TROOP B WAS ABLE TO LATER TAKE THIS INFORMATION PROVIDED TO HIM AND CONTACT the WITNESS TO THE VEHICLE CRASH. TROOPER WHITMORE ADVISED that UPON SPEAKING TO THE CRASH WITNESS, the DEFENDANT'S IDENTITY WAS CONFIRMED AND THAT IN FACT THE DEFENDANT WAS THE PERSON WHO HAD FLED FROM THE SCENE OF the ACCIDENT. TROOPER WHITMORE ADVISED THAT THE DEFENDANT'S IDENTITY WAS CONFIRMED FROM HIS DRIVER AND VEHICLE INFORMATION DATABASE (DAVID) PHOTOGRAPH PRESENTED TO THE WITNESS. \t \tUPON DISCOVERING THIS INFORMATION AFTER CONCLUSION OF MY INITIAL INVESTIGATION, THIS DEPUTY MADE CONTACT AGAIN WITH THE DEFENDANT FOR A FOLLOW-UP INVESTIGATION PERTAINING TO THIS CASE. THE DEFENDANT WAS ADVISED OF HIS MIRANDA RIGHTS BY MEANS OF A PREPRINTED CARD WHERE THE DEFENDANT CHOSE TO SPEAK WITH THIS DEPUTY. \t \tWHILE SPEAKING with THE DEFENDANT, HE WAS MADE AWARE THAT HE HAD BEEN IDENTIFIED BY A WITNESS AS LEAVING THE SCENE OF A VEHICLE CRASH IN MARION COUNTY, TO WHERE THE DEFENDANT CONTINUED TO DENY BEING the DRIVER OF the VEHICLE. THE DEFENDANT CONTINUED TO INSIST THAT HIS VEHICLE WAS STOLEN AS HE PREVIOUSLY REPORTED TO THIS DEPUTY. AT THE CONCLUSION OF OUR CONTACT, I ASKED the DEFENDANT JUST TO MAKE SURE I WAS CLEAR, "YOU'RE TELLING ME YOU WERE NOT THE DRIVER OF THE VEHICLE NOR WERE YOU INVOLVED IN A VEHICLE CRASH", TO WHERE the DEFENDANT BEGAN TO SHAKE HIS HEAD. I ASKED the DEFENDANT IF HE WOULD VERBALIZE HIS RESPONSE TO YES OR NO TO WHERE HE THEN ADVISED THAT HE HAD BEEN ADVISED OF HIS MIRANDA RIGHTS AND HE WAS INVOKING HIS RIGHTS AND DID NOT WANT TO SPEAK ANY FURTHER. MY CONVERSATION WITH THE DEFENDANT PERSISTENT TO THIS INVESTIGATION WAS CONCLUDED and THE DEFENDANT WAS PLACED UNDER ARREST BASED ON THE FOLLOWING FACTORS. \t \tTHE DEFENDANT WAS PLACED UNDER ARREST BASED ON THE FACT that THE DEFENDANT SIGNED A CITRUS COUNTY SHERIFF'S OFFICE AUTO THEFT AFFIDAVIT REPORT, WHICH CLEARLY STATED HE UNDERSTANDS THAT IF ANY INFORMATION PROVIDED TO THIS AGENCY IS FALSE HE POSSIBLY could BE PROSECUTED FOR FILING A FALSE POLICE REPORT. ALSO THE FACT that THE DEFENDANT HAD SIGNED AND FILLED OUT AND ATTESTED TO A VICTIM'S STATEMENT INDICATING HIS VEHICLE WAS STOLEN AND THAT HE HAD NO INVOLVEMENT WITH THE THEFT. THIS COUPLED WITH THE FHP'S INVESTIGATION THROUGH the COOPERATION OF A WITNESS THAT INDICATED THE DEFENDANT WAS IN FACT DRIVING THE VEHICLE THAT HE WAS NOW TRYING TO REPORT AS STOLEN IS THE BASIS FOR THE DEFENDANT'S ARREST. \t \tthe DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK and TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING.. THE DEFENDANT'S BOND WAS SET AT $1,000.00 PER THE BOND SCHEDULE. |
