SUBMITTED BY: HUGHES, JAMES 0500 (AR11123056) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: PUNCHED THE VICTIM IN THE RIGHT SIDE OF HIS FACE IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 100711 AT APPROXIMATELY 0050 HOURS, I WAS DISPATCHED TO 3831 SOUTH LAKE TERRACE IN HOMOSASSA IN REFERENCE TO A PHYSICAL DISTURBANCE. UPON ARRIVAL, I OBSERVED A WHITE MALE STAGGERING FROM THE DRIVEWAY OF THE RESIDENCE GOING TOWARDS A VEHICLE PARKED ON THE SIDE OF THE ROAD. THIS INDIVIDUAL WAS BEING ESCORTED BY A MALE AND FEMALE. UPON EXITING MY PATROL VEHICLE, THE SUBJECT WAS ADVISING THAT HE WAS GOING TO GO BACK TO THE PARTY AND KNOCK A SUBJECT BY THE NAME OF "CURTIS" OUT. I THEN MADE CONTACT WITH THE WHITE MALE SUBJECT, LATER IDENTIFIED AS MR CORY THOMAS. I ASKED HIM WHAT WAS GOING ON, AT WHICH TIME, HE ADVISED THAT HE WAS LOOKING FOR HIS GIRLFRIEND WHO WAS AT THE PARTY WITH SOMEONE ELSE. THE SUBJECT STANDING NEXT TO THE DEFENDANT HAD ADVISED HIM THAT HE HAD BEEN KNOCKED OUT AND WHEN ASKED BY WHOM, THE INDIVIDUAL STANDING NEXT TO THE DEFENDANT ADVISED IT WAS BY "CURTIS". THE DEFENDANT STATED TO ME "I NEEDED TO GO BACK IN MY VEHICLE SO THAT HE COULD TAKE CARE OF BUSINESS". THERE WAS A STRONG ODOR OF AN ALCOHOLIC BEVERAGE EMITTING FROM THE DEFENDANT'S PERSON AND HIS SPEECH WAS SLURRED. I THEN ADVISED THE DEFENDANT TO PLACE HIS HANDS BEHIND HIS BACK AND THAT I WAS GOING TO DETAIN HIM PENDING FURTHER INVESTIGATION. THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. I THEN MADE CONTACT WITH THE VICTIM, MR CURTIS DUVAL, AND ASKED HIM WHAT HAD HAPPENED. HE ADVISED THAT THE DEFENDANT HAD CALLED HIS CELLULAR TELEPHONE LOOKING FOR THE LOCATION OF HIS EX-GIRLFRIEND. THE VICTIM ADVISED THAT HE TOLD HIM WHERE SHE WAS AND THAT THEY WERE ALL JUST HANGING OUT. THE VICTIM ADVISED A SHORT TIME LATER, HE OBSERVED THE DEFENDANT PULL UP IN A VEHICLE. THE VICTIM ADVISED HE APPROACHED THE DEFENDANT IN AN ATTEMPT TO TELL HIM TO JUST LEAVE AND NOT TO CAUSE ANY PROBLEMS. THE VICTIM ADVISED, AT THAT TIME, THE DEFENDANT PUNCHED HIM IN THE RIGHT SIDE OF HIS FACE. THE VICTIM ADVISED THAT HE HAD HIT THE DEFENDANT BACK, KNOCKING HIM UNCONSCIOUS. THE VICTIM ADVISED AT THAT TIME HE CONTACTED 911. I DID OBSERVE A LARGE RED MARK ON THE RIGHT SIDE OF THE VICTIM'S FACE AND EMERGENCY MEDICAL SERVICES (EMS) WAS REFUSED. I ADVISED THE DEFENDANT THAT HE WAS BEING PLACED UNDER ARREST FOR BATTERY. I DID OBSERVE A BUMP TO THE LEFT SIDE OF THE VICTIM'S FACE AND EMS WAS REFUSED. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY (CCDF) FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. ALL PAPERWORK WILL BE TURNED IN TO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) RECORDS DIVISION.
