Probable cause affidavit: SUBMITTED BY: EMRICK, AL 0104 (AR11122745) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WAL-MART, TO WIT: BUDLIGHT BEER AND PIZZA, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). ON 091111, I WAS DISPATCHED TO THE INVERNESS WAL-MART, IN REFERENCE TO A RETAIL THEFT. I MADE CONTACT WITH THE COMPLAINANT WHO STATED THAT HE HAD OBSERVED A WHITE MALE LEAVE THE STORE WITH A CART CONTAINING A LARGE PIZZA AND TWO CASES OF BUDLIGHT BEER WITHOUT PAYING FOR THEM. HE ATTEMPTED TO INTERVENE WHEN THE DEFENDANT WAS LOADING THE STOLEN ITEMS INTO THE VAN. THE DEFENDANT IGNORED HIM, GOT INTO THE PASSENGER SIDE OF THE VAN, AND THE VAN LEFT WAL-MART. THE COMPLAINANT WAS ABLE TO GET THE LICENSE PLATE NUMBER AND ATTEMPTS TO LOCATE THE VAN WERE UNSUCCESSFUL. ON 091411, CONTACT WAS MADE WITH THE OWNER OF the VAN WHO STATED THE DEFENDANT APPROACHED HER AND HER BOYFRIEND WHILE THEY WERE AT SCORES BAR AND ASKED THEM TO TAKE HIM TO WAL-MART. WHEN THEY ARRIVED AT WAL-MART, THE DEFENDANT WENT INTO THE STORE AND SHE WENT TO the WAL-MART BATHROOM AND RETURNED TO HER VEHICLE CONDUCTING NO BUSINESS WITH WAL-MART. THE DEFENDANT SHOWED UP AT THE VAN WITH A LARGE PIZZA, CHEESE NIPS, AND TWO CASES OF BUDLIGHT BEER. SHE THOUGHT IT WAS UNUSUAL THAT HE HAD THE BUDLIGHT BEER AS IT WAS AFTER 0200 HOURS, AND SHE DID NOT BELIEVE THAT WAL-MART WAS ALLOWED TO SELL IT AT THAT TIME. SHE QUESTIONED HIM ABOUT THE BEER SEVERAL TIMES AND HE ASSURED HER HE PAID FOR THE BEER SO SHE LEFT. I THEN MADE CONTACT WITH THE DEFENDANT AT HIS PLACE OF BUSINESS AND I ASKED HIM WHAT HAPPENED AT WAL-MART ON SATURDAY NIGHT. AT FIRST HE STATED NOTHING. I THEN ADVISED HIM THAT I HAD HIM ON DVD AND WOULD LIKE TO HEAR HIS VERSION OF WHAT occurred. HE STATED THAT HE LEFT WAL-MART WITHOUT PAYING FOR BEER AND PIZZA. THE DEFENDANT WAS ARRESTED, HANDCUFFED (DOUBLE LOCKED), AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS HELD IN LIEU OF $250.00 BOND.
